Promotion Event Terms and Conditions – All Eyes On ROG Phone 8
This online campaign – All Eyes On ROG Phone 8 (“Promotion”) is hosted by ASUSTeK Computer Inc. (“ASUS”).
1. Detailed information with respect to how to participate this Promotion, play and win prizes in connection with this specific Promotion,

, constitutes part of this Promotion Event Terms and Conditions – All Eyes On ROG Phone 8 (“Terms and Conditions”). Your participation in this Promotion is deemed as your acceptance of these Terms and Conditions. ASUS may at any time revise the Terms and Conditions and other rules set forth by ASUS. Participators shall be bound by any such revisions.

This Promotion is held worldwide excluding Canada, Russia, Belarus, Italy and territories or countries where applicable laws either (i) prohibit participating or receiving a prize in giveaways; or (ii) require extra process (such as registration and reporting) for holding giveaways or providing prizes exceeds certain value (“Promotional Territory”) from 12:00pm December 11th, 2023 (UTC+8) to 00:00am December 31st, 2023 (UTC+8) (“Promotional Period”).
3. Employees of ASUS and its parent companies, affiliates, subsidiaries, advertising representatives and agencies, who are involved in this Promotion, and the immediate families of any of the foregoing persons, are NOT ELIGIBLE for this Promotion.
4. Eligibility of Participation and Prize Winning –
A. People who live in Promotional Territory and would like to participate in this Promotion during the Promotional Period acknowledge that you shall be at least TWENTY (20) years old and considered an adult by the laws of the country where you reside in (“Participator”).
B. In order for a Participator to further become an entrant qualified for winning the prizes of this Promotion (“Eligible Entrant”), you further acknowledge as follows:
★ You are required to sign in as an ASUS member before actions required under this Promotion are taken; and
★ You are required to complete Required Actions as further described under Section 5.A.
5. Details of this Promotion are as follows –
A. During the Promotional Period, Participators are invited to share thoughts by voting on a series of photo sets following precise instructions as shown on the webpages at
https://rog-blind-camera-test.asus.com/ (“Required Actions”). Participators are also welcomed to leave comments under each set of photos but are not required to do so.
B. Only Eligible Entrants are qualified to win the prizes of this Promotion. One ASUS member account will be counted only once for this Promotion during the Promotion Period, and one Eligible Entrant is only allowed to win one Prize
C. ASUS provides three (3) new ROG Phone 2024 as the prizes of this Promotion (each, a “Prize”) in total. For reference, the RRP (recommended retail price) value of ROG Phone 7 Ultimate is over USD 1,000. ASUS reserves the right to substitute a Prize for one of equal or greater value should it become unavailable for any reason.
D. There will be three (3) Prize winners in total and each Prize winner will receive one (1) new ROG Phone 2024. Regardless of how many times you complete the Required Actions, your participation will only be counted as once (i.e. multiple participations do not increase your chance of Prize winning as an Eligible Entrant).
E. Three (3) Prize winners will be selected randomly on January 9, 2024 (UTC+8) (“Lucky Draw Date”). Odds of winning will depend on the total number of eligible entries received. winners need not to be present to win. Winners will be subsequently notified by ASUS within one (1) week after the Lucky Draw Date via e-mail, and list of winners will also be announced on ASUS’ official Facebook page, Twitter and Instagram account.
F. Prize winners shall inform ASUS of their contact information for Prize delivery purpose (i.e. full names, phone numbers and physical addresses) within seventy-two (72) hours after receiving the notification from ASUS. Any failure of a Prize winner to make the contact information available to ASUS during the above seventy-two (72) hours will be deemed a waiver of his/her right for the Prize awarded, and ASUS, in its sole discretion, reserves the right to conduct a redraw to decide a substitute. Prize winners guarantee that all information provided is accurate and truthful. ASUS reserves the right to reject winning claims with incomplete or incorrect information.
G. Prizes are non-exchangeable, non-transferable, and cannot be converted into cash or substituted for any other item, model, or color. Any cash or substation request will be rejected.
H. Prize winners should bear the corresponding tax amount in accordance with the tax laws of the respective country, and declare the income in accordance with the laws and regulations of that country. ASUS shall have no responsibility in respect thereof.
I. Prize winners have the choice to reject the Prize if he/she does not want to provide the required information or pay the applicable tax, duty, levy or similar impost relating to the award of the Prize.
J. The Prize will normally be delivered to Prize winner’s indicated address within two (2) months after the Lucky Draw Date. ASUS reserves the right to change the delivery date without prior notices.
6. NO PURCHASE NECESSARY. No purchase is necessary to participate in this Promotion. A purchase will not improve your chances of winning.
7. To the fullest extent permitted by law, ASUS accepts no liability for any damage, loss, liability, injury, cost or expense incurred or suffered by any participants in connection with this Promotion (whether or not arising from any person's negligence), provided that the above shall not exclude the liability of ASUS for any such liability that cannot be excluded by applicable law (including death or personal injury as a result of negligence), where liability shall be limited to the minimum permissible by applicable law. Winner(s) understands and agrees that the Prize may be provided “AS-IS” without ASUS standard. Prizes consist of only the items specifically described herein, and no additional items, services or subscriptions are included.
8. For any reviews/articles/posts/ratings about Participators’ user-generated content or using experience of ASUS products/ services on ASUS or on 3rd party platforms, Participators should always disclose material connections between Participators and ASUS in such reviews/articles/posts/ratings (for example, by stating “sponsored post by ASUS” or “promoted post by ASUS” in Participators’ reviews/articles/posts/ratings).
9. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter and Instagram. Participators agree to grant Facebook a complete release regarding this Promotion. Participators acknowledge that you are providing your comments and personal information to ASUS and not to Facebook, and such information and personal information will only be used for this Promotion – All Eyes On ROG Phone 8.

11. If winner is an U.S. tax resident, the Prize valued over USD 600.00 shall be reported by the winner as income, and winner may be issued a tax form (W9) based on applicable laws and regulations.
12. Disputes. Except where prohibited, Participator agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the Santa Clara County Superior Court, U.S.A; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will Participator be permitted to obtain awards for, and Participator hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participator and ASUS in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules.
