1. These terms and conditions set out all of the information regarding the Brisbane Economic Development Agency – Visit Brisbane Competition (the Terms and Conditions).

2. The promoter of this competition is Brisbane City Council ABN 72 002 765 795 whose principal offices are at 266 George Street Brisbane 4000, acting through its wholly owned subsidiary, Brisbane Economic Development Agency Pty Ltd ACN 094 633 262 (the Promoter).

3. Information on how to enter this competition forms part of these Terms and Conditions.

4. Competition entry is deemed acceptance of these Terms and Conditions.

5. Prizes: There is one (1) prize available to be won for this competition, where the prize consists of one (1) unique Visit Brisbane “package” (the Prize) consisting of the following:

a) Accommodation for two (2) people to stay for three (3) nights in the Frangipane Suite (Penthouse Suite on Level 20) and complimentary valet parking at the Emporium Hotel South Bank located at 267 Grey St, South Brisbane QLD 4101 to be redeemed on or prior to 11 May 2027.

The total value of this prize inclusion (a) is approximately $7,000.00

b) Business Class return flights for two (2) from Prize winner’s nearest capital city with Virgin Australia to be redeemed on or prior to 1 August 2025.
The total value of this prize inclusion (b) is approximately $2,828.00.

c) Adventure Package for two (2) at Tangalooma Island Resort located at Tangalooma, Moreton Island QLD 4025 and inclusive of two (2) nights’ accommodation in a Hotel Standard Room, 6-minute Scenic Helicopter Tour, 4WD Desert Safari Tour, ATV Quad Bike Tour, Wild Dolphin Feeding Experience and Return boat transfers from Holt St Wharf to be redeemed on or prior to 1 August 2025.

The total value of this prize inclusion (c) is approximately $1,459.00.

d) Helicopter Winery Tour & Lunch Package for two (2) with Elite Helicopters located at 404 Wirraway Avenue, Archerfield, QLD 4108 to be redeemed on or prior to 1 August 2026.
The total value of this prize inclusion (d) is approximately $1,199.00.

e) $300 spa voucher, $300 wellness voucher and two (2), one-day passes to Total Fusion Platinum located at 18 Longland St, Newstead QLD 4006 to be redeemed on or prior to 1 August 2025.
The total value of this prize inclusion (e) is approximately $720.00.

f) Twilight Story Bridge Adventure Climb for two (2) with Story Bridge Adventure Climb located at 170 Main St, Kangaroo Point QLD 4169 and $1,000 dining voucher for Howard Smith Wharves located at 5 Boundary St, Brisbane City QLD 4000 to be redeemed on or prior to 1 August 2025.
The total value of this prize inclusion (d) is approximately $1,340.00.

g) Vertigo dining experience for two (2) and two (2) tickets to a show Brisbane Powerhouse located at 119 Lamington St, New Farm QLD 4005 to be redeemed on or prior to 1 August 2025.
The total value of this prize inclusion (d) is approximately $600.00.

h) Exclusive dining experience for two (2) hosted by Martin Boetz at his new Brisbane restaurant, Short Grain located at 15 Marshall St, Fortitude Valley QLD 4006 to be redeemed on or prior to 12 May 2026.
The total value of this prize inclusion (d) is approximately $400.00.

The total value of the Prize, being the unique Visit Brisbane “package” as described in (a) to (h) above, is approximately $15,546.00.

The Prize is not exchangeable or transferable and cannot be redeemed for cash. Any additional expenses incurred by the Prize winner, other than those outlined in these Terms and Conditions, are the responsibility of the Prize winner.

The Prize is subject to the specific terms and conditions of the Prize providers (including, without limitation, age restriction policies and to the extent the Prize is a ticket to an event, the terms and conditions applicable to that ticket and event) and the Prize winner will not be entitled to any monetary compensation (including any refund of the ticket price or otherwise) in connection with the Prize.  Entrants acknowledge the risk of delay, postponement or cancellation of an event is beyond the control of the Promoter. The Prize must be redeemed by the Prize winner.

6. Competition period: This competition will open at midday AEST on 25 June 2024 and close at 11.59pm AEST on 27 July 2024. No entries will be accepted after this time

7. How to enter: Entrants must fully complete and submit the online entry.

Only one entry per entrant will be accepted, and any subsequent entries from the same entrant will be deemed invalid.

8. Eligibility: To be eligible to enter this competition, a person must:

be a resident of New South Wales or Victoria, identified by the postcode provided on the online entry form (and be able to provide proof of residency if required by the Promoter);
not be an employee or contracted staff of the Promoter or prize providers; and be 18 years of age or older.

9. Competition draw: The winner of the competition will be the first eligible entry randomly drawn by an officer of the Promoter at approximately midday AEST on 1 August 2024.

The decision of that officer shall be conclusive and no correspondence will be entered into.

Winner notification: The winner will be notified via phone or email by an officer of the Promoter by 5pm AEST on 1 August 2024.

10. Prize claim and Prize re-draw: The winner must claim the Prize by contacting the Promoter on the details notified by the Promoter (either by phone or email), by 10.00am AEST on 5 August 2024 (the Prize Claim Date).

If a Prize is not claimed by the Prize Claim Date, the winner (as originally drawn) will cease to be the winner and will not be entitled to claim the Prize.

The Promoter will be entitled to re-draw a new winner and provide a period of time for that new winner to claim that Prize. If that new winner fails to claim the Prize in the applicable period of time, that new winner will cease to be the winner and will not be entitled to claim the Prize.  This re-draw process may continue to apply on any number of occasions (at the discretion of the Promoter), until such time as the Prize is claimed by the winner within the applicable period. 

The Promoter, in its absolute discretion, reserves the right not award the Prize to any entrant, including without limitation, if the Prize is not claimed by the Prize Claim Date or any subsequent period provided for a new winner to claim the Prize.

11. Prize redeem: To redeem the Prize, once a Prize winner has claimed the Prize and provided an email address, the Prize will be sent out to the Prize winner by email.

12. No liability of Promoter: The Promoter accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of the Prize. Despite any other provision of these Terms and Conditions, to the maximum extent permitted by law, the Promoter is not liable for:

any loss or damage whatsoever (including but not limited to direct loss, indirect loss, economic loss, special loss or consequential loss) which is suffered or incurred by an entrant (including without limitation any Prize winner); or

without limiting paragraph (a), any personal injury or death or loss of, or damage to, property in connection with the entry into the competition or acceptance of the Prize,

howsoever such liability arises and whether arising in tort (including without limitation in negligence), for breach of contract (including without limitation under any indemnity), under statute, in equity of otherwise.

This condition is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of the Prize.

13. Privacy consent: By entering this competition, the entrant acknowledges and consents to their personal information being collected, stored and shared by the Promoter for the purpose of this competition and the providing of the prizes as describe in the above clause 5 (a) to (h).

14. Force Majeure: If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter), which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition. The Promoter reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.

15. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same Terms and Conditions.
