Information on how to enter and prizes form part of these Terms & Conditions. Any entry not complying with these Terms and Conditions is invalid. The Promoter is Toby's Estate Coffee Pty Limited (ABN 86 084 104 423), 32-36 City Road, Chippendale New South Wales 2008. The Promoter can be contacted via email at

Entry is open to natural persons who are residents of Australia and living in Australia, aged 18 and over (“Eligible Entrant”). Directors, management, employees, officers, contractors, affiliates of the Promoter, Promoter licensees, Promoter café employees or of the agencies associated with this Promotion and their immediate families are ineligible to enter. “Immediate families” includes a spouse, ex-spouse, de-facto spouse, parent, step-parent, child or step-child (whether natural or adopted), sibling or step-sibling (whether natural or adopted), grandparent, aunt, uncle, niece, nephew or cousin, whether or not they live in the same household as the director, manager, employee, officer, contractor, affiliates of the Promoter, Promoter licensees, Promoter café employees and the agencies associated with this Promotion.
The promotion commences Tuesday 1 October 2024 and closes at 11.59pm AEST on Tuesday 22 October 2024 (“Promotion Period”).
To be eligible to win, Eligible Entrants must, during the Promotion Period, vote for their favourite Toby’s Estate café and fill in the competition entry form including the answer to the question “What makes you excited to visit Seattle and explain what you'd love to explore”. Entrants can only vote once.
Additional competition entries can be earnt if entrants spend $100 or more in one transaction online at tobysestate.com.au. Eligible Entrants are automatically entered into the draw when they spend $100 or more. Any purchases made after the competition closing date are not valid. Purchases made in physical stores and cafes are not valid. Entries are deemed to be received at the time and on the date that they are received by the Promoter. Each entrant must create their own entry and only submit an entry in their own name.
The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process. All valid entries received during the Promotion Period will be entered in the draw or determination for which the entry is submitted.
The Total Prize Pool is $8,500AUD. There is only 1 Winner. The prize includes a trip for 2x to Seattle, the State of Washington, USA, to be booked through Linkd Tourism’s travel agent. This will include economy flights to Seattle from an Australian capital city, 3.5 star minimum accommodation for a 5-night stay and 2x Seattle CityPass valued at $386AUD. Total prize is up to the value of $8500AUD. Any additional costs above $8500AUD will be up to the competition winner to cover. Prize trip must be booked before 12 Dec 2024 with travel to be taken by the end of 2025. The Prize will be booked via Linkd Tourism on behalf of Visit Seattle.
a. The prize includes airfares, accommodation and CityPass as stipulated. Spending money, gratuities, merchandise & souvenirs, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, parking fees, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included, except as specified as part of the prize. Prize is valid for a stay in Seattle, Washington, USA only, and is subject to availability within the budget allocated for the prize. Final itinerary will be approved by Linkd Tourism on behalf of Visit Seattle.
The Winner will be notified in writing by email on Thursday 24 October 2024. The winners details (last name, first initial and postcode) will be announced via Toby’s Estate channels (Website, Email and Social Media Channels) on the 28th October 2024. If The Winner cannot be contacted or does not claim the prize within 14 days, the competition will be redrawn at 2pm AEST on Thursday 7th November 2024, at 32-36 City Road, Chippendale NSW and the replacement Winner notified in writing by email on Thursday 7th November 2024.
No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability, and the Promoter reserves the right to substitute any prize with another of equivalent value without giving notice, subject to regulatory approval. The Promoter, and its partners, accept no responsibility for any tax implications that may arise from the prize. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s guidance. The Promoter, and its partners, are not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
Each entry becomes the property of the Promoter. All personal information will be collected and stored by the Promoter in accordance with the Privacy Act 1988. All entrants have the right to access their personal information and request correction of any errors pursuant to the Privacy Act 1988. The prize winner will be required to sign and complete prize acceptance forms from the Promoter and prize suppliers in order to claim and travel on their prize.
The winner and their companion are responsible for obtaining any and all visa requirements and travel insurance for the prize when necessary and if applicable. The winners will be asked to sign that they have taken suitable travel insurance out as part of their prize acceptance forms. By entering this competition, the Entrant agrees to receive marketing communications from the Promoter and Linkd Tourism on behalf of Visit Seattle. There may be specific state or government health agency instructions, guidelines and requirements for all destinations visited as part of this prize, and during travel. The winner and their guests will travel at their own health and safety risk. The prize can be redeemed by the winner only and cannot be transferred to any other person, including family members, unless specified by the Promoter.
The Promoter’s decision is final, and no correspondence will be entered into. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for personal injury suffered or sustained as a result of accepting the prize. The winner and their companion must depart from and return to the same departure point and travel together on the same itinerary. Itinerary to be determined by the Promoter in its absolute discretion. The winner will be required to present their credit card at time of accommodation check in as a security deposit. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
The Promoter reserves the right to vary these Terms and Conditions or to modify, suspend, terminate or reschedule the Promotion, subject to regulatory approval. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, none of the Promoter or any prize supplier (including their respective officers, employees and agents) are responsible for and all liability (including negligence) is excluded, for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter or a prize supplier's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or a prize supplier) due to any reason beyond the reasonable control of the Promoter or the prize supplier; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use / taking of the prize. A prize supplier's responsibilities are limited to the provision of its component of the prize to the Promoter. The prize supplier shall not be liable to any other person, including any entrant or winner, and is not responsible for the promotion, administration or execution of the competition.
By accepting the prize, the Winner agrees that the Promoter will publish his or her surname, initial and postcode on tobysestate.com.au within 30 days of the draw. The Promoter may use his or her name, image and/or photograph/s for publicity and promotion purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the images and/or photograph/s.
If a redraw is required, the Promoter will publish the surname, initial and postcode of the replacement Winner on tobysestate.com.au within 30 days of the redraw. The Winner (and any person receiving the benefit of a prize) may be required to sign a release in a form determined in the absolute discretion of the Promoter (or, where relevant, a prize provider).
If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
