Terms and Conditions;
1. “The Promoter” is The Coffee Club Franchising Company Pty Ltd ACN 128 563 333 trading as The Coffee Club, Level 13, 199 Grey Street, South Bank QLD 4101.
2. By entering this competition, you agree and are automatically deemed to have read, understood, and accepted these terms and conditions (terms).
3. If there is any inconsistency between these terms and anything else that refers to this competition, these terms will prevail.
4. A Participating Store means any The Coffee Club restaurant or café in Australia, offering the menu items referred to at [9(a)] below.
Participation
5. Participation is open to all Australian residents, except employees and immediate families of the Promoter and their associated companies and agencies. Immediate family includes but is not limited to; spouse, child or step-child (whether natural or by adoption), parent, step parent, grandparent, sibling, uncle, aunt, niece, nephew.
When to Enter
6. The competition commences at 12:01am (AEST) on Monday, 28 April 2025 and will close at 11:59pm (AEST) on Sunday,11 May 2025 (Competition Period).
7. The Promoter accepts no responsibility for any inability for a customer to access the competition due to technical disruptions, network congestion or for any other reason.
8. To participate, entrants must have downloaded the Promoter’s “The Club” app (App), and have a valid, active account in the App (Account). For further details regarding the App.
How to Enter
9. This is a game of skill, where entrants are required to (Entry):
a. Visit entry form on app
i. complete the online form by providing their full name, phone number, email
address, suburb and state;
ii. tell the Promoter in 50 words or less, why it is time for their mum to be spoiled with an ultimate Mother’s Day experience; and
iii. select the tick box to opt-in to The Coffee Club email marketing.
10. Entrants may submit more than one (1) entry, subject to each entry containing only one (1) nominated prize recipient.
11. Entrants are required to take full responsibility for the content of their Entry and for ensuring that their Entry complies with these terms.
12. Any Entry that is made on behalf of a participant by a third party will be invalid, unless the participant requires the assistance of a third party to enter due to a disability.
13. The Promoter reserves the right to:
a. disqualify any participant who:
i. tampers with the Entry process (including but not limited to entrants and households who use multiple email addresses or third-party software or applications);
ii. submits an Entry that is not in accordance with these terms; or
iii. in the opinion of Promoter, engaged in conduct, which is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the competition and/or Promoter;
b. moderate, monitor, delete, or reject any or all entries submitted at its sole discretion, including removing content it considers to be incomplete, indecipherable, inappropriate, offensive, unlawful, or otherwise not in the spirit of the competition.
Draw and Notification
14. At the end of the Competition Period, all valid Entries will be reviewed and judged at Level 13, 199 Grey Street, South Bank QLD 4101 and one (1) First prize winner (First prize winner) and twenty (20) Runner up prize winners (Runner Ups) will be selected based on the skill of the entry, at 11:00AM (AEST) on 15 May 2025 (Prize Winners).
15. The First prize winner will be notified via phone and email, to their nominated phone number and email address connected to their Entry, by the Promoter, by no later than 5:00pm (AEST) on Wednesday, 14 May 2025. If the First prize winner does not register their acceptance of the prize by return email to the Promoter by 11:59pm (AEST) on 16 May 2025, the First prize winner will be deemed to have not accepted and forfeit their entitlement to the prize.
16. The Runner Ups will be notified via email, to their nominated email address connected to their entry, by the Promoter, by no later than 3:00pm (AEST) on 16 May 2025.
17. All Prize Winners will have their name published at
www.coffeeclub.com.au from 18 May 2025.
18. A draw for any unclaimed First prize will take place at 3:00PM (AEST) on 19 May 2025 at the same place and in the same method as the original draw. The substitute First prize winner, if any, will be notified by phone and email within two (2) business days of the draw and their name will be published at
www.coffeeclub.com.au from 21 May 2025 (Unclaimed Prize winner).
19. If an Unclaimed Prize winner does not register their acceptance of the prize by return email to the Promoter by 3:00PM on 21 May 2025, the Unclaimed Prize winner, if any, will be deemed to have not accepted and forfeit their entitlement to the prize. The Promoter may then dispose of such prize, at its sole discretion, and does not need to select any further prize winners.
20. The prize will be awarded to the person named in and who submitted the valid Entry.
21. Any prize draw decisions are final and binding, no correspondence will be entered into regarding the competition result, or any other decisions the Promoter makes in connection with the promotion.
22. Delivery of the First prize will be made within 2 weeks of the First prize winner acknowledging acceptance of their prize in accordance with these terms, and providing a valid contact and postal address for any applicable delivery. Failure for the Frist prize winner to provide a correct personal information, including without limitation a correct email and postal address may result in forfeiture of the prize.
23. Delivery of the Runner Up prize will be made within 2 weeks of each Runner Up prize winner/s being selected in accordance with these terms, and providing a valid email address for any applicable delivery. Failure for a Runner Up prize winner to submit correct personal information, including without limitation a correct email address and/or postal address may result in forfeiture of the prize.
24. The First prize winner will receive the Ultimate Mothers Day Gift, which includes:
a. a $1,000.00 Visa E-Gift Card issued to the First prize winner for their mum to use for clothes purchase at the local styling session;
b. a styling session with a local stylist of the Promotor’s choice for their mum, valued up to $800.00 (inclusive of GST); and
c. A $200.00 The Coffee Club E-Gift Card issued.
25. The total First prize pool is valued up to AUD $2,000.00.
26. For avoidance of doubt, payment of the local styling session will be made directly to the local supplier and not to the First prize winner.
27. The Promotor is not obliged to but will use reasonable endeavours to locate a local stylist for the First prize winner within two (2) hours driving distance from the First prize winner’s home address.

29. The First prize cannot be resold, exchanged, or redeemed for cash.
30. It may be a condition of accepting the First prize that the First prize winner signs a legal release in a form determined by the Promoter in its absolute discretion.
31. The Promoter takes no responsibility if the First prize is lost, stolen, damage or becomes void upon being supplied to the First prize winner.
32. All Entrants agree that if they win the prize, they will:
a. be solely responsible for booking the styling appointment. The First prize winner acknowledge and agree that the Promoter is not liable to assist the Frist prize winner with making any booking or travel arrangements in any form, or for any losses that the First prize winner may incur or suffer as a result of, or arising in connection with, the use of the First prize in any form;
b. not sell or otherwise provide their story and/or photographs to any media or other organization, without the prior written consent of the Promoter;
c. comply with all the conditions of use of the First prize and First prize supplier’s requirements, if any;
d. receive and take the First prize on an “as is” basis, without warranty of any kind, express or implied (including but not limited to without any implied warranty of merchantability or fitness for a particular purpose); and
e. be liable for all costs associated with the use of the First prize, including but not limited to flights, transport, parking, insurance, transfers, spending money and accommodation, if applicable.
33. The First prize must be taken as stated and no compensation will be payable if the First prize winner is unable to use the First prize as stated.
34. Where the First prize includes a ticket, ticket allocation (date and seating) will be at the Promoter’s sole discretion.
35. If the First prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the First prize for a prize of equal or greater value, subject to State or Territory legislation.
The Runner Up Prize
36. Twenty (20) Runner Ups will each receive one (1) The Coffee Club $50.00 E-Gift Card, valued at a total of AUD $1,000.00.

38. The Runner Up prize cannot be transferred, resold, exchanged, or redeemed for cash.
39. It may be a condition of accepting the Runner Up prize that the Runner Up’s sign a legal release in a form determined by the Promoter in its absolute discretion.
40. The Promoter takes no responsibility if the prize is lost, stolen, damage or becomes void upon being supplied to the Runner Up’s.
41. All entrants agree that if they win the Runner Up prize, they will:

44. If the Runner Up prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Runner Up prize for a prize of equal or greater value, subject to State or Territory legislation.
Entrant’s Warranties
45. By partaking in the competition, entrants:
a. consent to the collection, use and or disclosure of information provided by it for internal research, and current and future competitions, advertising and marketing activities of the Promoter, its associates and its sponsors, whether in Australia or overseas;
b. agree for the Promoter and its associates to contact them and send and/or provide information via telephone, mail, in person, email, SMS and any other form of communication medium;
Liability
d. consent to, and authorises the use of, their name and image in any publicity material as determined by the Promoter at its sole discretion and/or as may be required by the relevant lottery and/or gaming legislation;
e. consent to their entry becoming the property of the Promoter pursuant to the Copyright Act 1968 (Cth) or otherwise; and
f. acknowledge and agree that the Promoter is entitled to do any of the abovementioned acts without compensation or fee, and that such consent is enduring.
46. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend the competition, including but not limited to circumstances where:
a. an outside act, agent or event prevents or significantly hinders the Promoter’s ability to proceed with the competition, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, pandemic, war, act of terrorism;
b. the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or technical failures which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition.
47. The participant acknowledges and agrees that the Promoter is not responsible or liable for:
b. unauthorised human intervention in any part of the competition;
c. electronic or human error which may occur in the administration of the competition;
d. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
e. any theft, unauthorised access or third party interference;
f. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
g. any variation in value to that stated in these terms;
h. any delay, cancellation, postponement or attendance of a Coupon, if applicable; and
i. any tax liability incurred by an entrant.
a. the unavailability or inaccessibility of any service whether or not caused by traffic
congestion on the Internet or at any website;
48.
Statutory Warranties

These conditions do not affect, and are not intended to affect, any rights a consumer might
have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any
such rights is limited to the payment of the cost of having the Prize supplied again
49. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (Cth) or any other relevant legislation which cannot be excluded, restricted, or modified.
50. Notwithstanding clause 44, to the fullest extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever which is suffered, including but not limited to direct, indirect

or consequential loss, or for any personal injury suffered or sustained in connection with the Coupon or competition except for any liability which cannot be excluded by law.
51. Each entrant shall indemnify the Promoter (and their respective directors, officers, employees and agents (each an “indemnified person”) for any loss, liability, cost, damage or expense suffered or incurred by any indemnified person as a result of:
c. the entrant breaching any of these terms;
d. a warranty given by the entrant proving to be untrue; or
e. any personal injury arising from or related to any wrongful or negligent act or omission by the entrant in connection with this competition.
52. The Promoter collects personal information about the entrant for the purposes of conducting this competition. Any disclosure of such information will be made as required by law and in accordance with The Coffee Club’s Privacy Policy available at
www.coffeeclub.com.au.
53. All entries will be entered into a database and the Promoter may use the entrant’s names and email address for future competitions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
54. By entering this competition, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out on its website
www.coffeeclub.com.au. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
General
55. The Promoter may amend, cancel and/or suspend the competition at any time, without notice. If the Promoter does so, the Competition Period will automatically expire.
56. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered.
57. To the extent it is legally possible, this agreement is governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of the courts of Queensland, Australia.
