Eligible Entrants Residency Restriction
Entry is available to residents nationally in Australia.

Age restriction

Entrants must be 18 years or older.

How to Enter To enter the Competition, during the Competition Period the Entrant must:
purchase (2) Nude by Nature products or more; and
answer the question in 40 words or less: “What 2 Nude by Nature products did you purchase and why?”
Entrants must retain a copy of their receipt to claim their prize should they be deemed a winner, and provide this through email correspondence when claiming a prize.

Entries Permitted Only one (1) entry per eligible transaction will be permitted.
Content Criteria Responses will be judged on their:
accuracy in answering the question;
originality;
creativity; and
compliance to the word limit.

Determining the Winner(s) Nude by Nature will select the winners based on their response to the question and notify the winners to collect their prize. Winner selection will take place at 10 Bridge Street Sydney, 2000, within 3 business days of the competition close date.
Major Prize

The Judge(s) will assess submissions against the Content Criteria. The Major Prize will be awarded to the entry that best aligns to the Content Criteria in the opinion of the Judge(s).

Minor Prizes

The Judge(s) will assess submissions against the Content Criteria. The Minor Prizes will be awarded to the entries that the Judge(s) rank as being the top 10 (excluding the Major Prize winner) based on alignment to the Content Criteria in the opinion of the Judge(s).

Judge(s) The Judge(s) of the Competition will be: 1 member of the Nude by Nature team.
PART A – INTRODUCTION

1. Information on how to enter and prize details form part of these terms and conditions.

2. By participating in the Competition, entrants accept and agree to be bound by these terms and conditions. For the avoidance of doubt, the terms and conditions include the Schedule above.

3. Entries must comply with these terms and conditions to be valid.

4. Where there is an inconsistency between the Schedule and Parts A to M of these terms and conditions, the Schedule will prevail.

PART B – PRIVACY

5. The Promoter will collect and use each entrant’s personal information for the purposes of:

a) conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) and for promotional purposes, public statements, and advertisements in relation to the Competition.
b) providing information about the products and services offered by the Promoter and its related companies and its affiliated retailers; and
c) research to improve its products and services.
6. By entering the Competition, entrants’ consent to the use of their personal information as described in clause 5.

7. Entrants may access, change and/or update their personal information in accordance with the Promoter’s privacy policy [https://nudebynature.com/policies/privacy-policy].

PART C – WHO CAN ENTER THE COMPETITION

8. Entry in the Competition is only open to Australian residents.

9. If the Schedule permits entrants to be under the age of 18 years, such entrants must seek permission from their parent or guardian to enter. If the winner of a Prize is under 18 years of age, the Prize will be awarded to the winner’s parent or legal guardian with the requirement of attendance alongside the minor to be regarded as part of the additional winners.

10. Employees (and their immediate families) of the Promoter, participating retail stores and agencies associated with this Competition, or firms or companies associated with the Competition (including suppliers of the prizes) are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin; and

11. Persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter are not eligible to enter.

PART D – HOW TO ENTER THE COMPETITION

12. To enter, each Entrant must follow the ‘How to Enter’ section set out in the Schedule, during the Competition Period.

13. Entries must not have been published previously or used to win prizes in other competitions.

14. An entry cannot be modified after it has been submitted.

15. If an Eligible Entrant submits an entry:

a) which complies with these Terms, they will receive an on-screen notification confirming that their entry has been successfully submitted; or
b) which does not comply with these Terms, they will receive an on-screen notification that their entry has not be successfully submitted, whichever is applicable in the circumstances.
16. The Promoter reserves the right, at any time, to request verification of the age, identity, residential address, or any other information relevant to participation in the Competition of all entrants. The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter.

17. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these terms and conditions or which contravene any applicable laws or regulations.

18. The Promoter reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these terms and conditions, has engaged in unlawful or improper conduct or otherwise acts to cheat or undermine the fairness of the Competition by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants.

19. The eligibility of entries is solely within the discretion of the Promoter.

20. The Promoter accepts no responsibility for late, lost, misdirected, or damaged entries or other communications.

PART E – PRIZES

21. Each Prize is not transferrable, exchangeable, or redeemable for cash.

22. If a Prize is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Prize with a prize of equal or greater monetary value. This right is subject to any applicable legislation, regulations, or directions from a regulatory authority.

23. Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for the Prize being damaged, lost or stolen.

24. All taxes (excluding GST, if any) which may be payable as a consequence of receiving a Prize are the sole responsibility of each winner.

25. A winner’s use of the Prize is entirely at their own risk. Before a Prize is awarded, a winner may be required to sign an agreement to release the Promoter from any liability arising from the winner’s acceptance and use of the Prize and the winner’s participation in the Competition.

PART F – HOW THE WINNER(S) ARE DETERMINED

26. The Competition is a game of skill. Chance plays no part in determining the winner(s).

27. At the time and date specified in the “Determining the Winner(s)” section of the Schedule, each valid entry will be judged individually on its merits by the Judges based on the Content Criteria.

28. The winning entry or entries will be the entry or entries that best satisfy the Content Criteria, as determined by the Judges.

29. The number of winning entries to be selected will be the same as the total number of Prizes specified in the Schedule.

30. The Judges’ decision will be final and binding and no correspondence with entrants or any other person will be entered. Each winner will receive a Prize.

PART G – NOTIFICATION AND CLAIMING THE PRIZE(S)

31. The Promoter will provide each winner with instructions on how to claim their Prize. It is the responsibility of each winner to comply with the Promoter’s instructions.

32. The Promoter reserves the right to request each winner to provide proof of their identity and/or proof that they were responsible for the winning entry.

33. Each winner agrees to participate and cooperate, as required, in all publicity activities relating to the Competition, including, without limitation, being interviewed, photographed, filmed, and recorded. Each winner authorises the Promoter to use such content for advertising and publicity purposes in any media in perpetuity worldwide.

34. It is the responsibility of each entrant to notify the Promoter of any change to their contact details.

PART H – UNCLAIMED PRIZES

35. The Promoter will take all reasonable steps to identify and notify each winner to ensure that each winner receives their Prize. However, if a winner cannot be identified or does not claim the Prize within one (1) week of the date on which the winners are determined, their Prize is forfeited and will be awarded to the next best entry.

36. Each winner of an unclaimed Prize will be determined and notified in accordance with Parts F and G.

PART I – NO LIABILITY

37. Any Prize supplied by a third-party supplier is subject to the terms and conditions of that third-party supplier. Each Prize may come with guarantees that cannot be excluded under the Australian Consumer Law. If those guarantees are not complied with, then you will have rights under the Australian Consumer Law. Subject to those guarantees and rights, the Promoter shall not be liable and excludes all liability (including negligence) for any loss or damage whatsoever which is suffered for damage to property, personal injury or death suffered or sustained in connection with the Competition or the use or taking of any Prize except for any liability which cannot be excluded by law including as provided for under the Australian Consumer Law.

38. Despite anything to the contrary, but subject to the Non-Excludable Guarantees, neither party will be liable under these Terms & Conditions for any consequential, special or indirect loss including but not limited to loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use (including both real and anticipatory) and/ or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

39. A party’s liability for any liability in relation to these terms and conditions will be reduced proportionately to the extent the relevant liability was caused or contributed to by the acts or omissions of the other party, including any failure by that other party to take reasonable steps to mitigate its loss.

40. If entry is via Facebook or if the Competition is promoted on Facebook, the Competition is in no way sponsored, endorsed, administered by or associated with Facebook and each entrant agrees to grant Facebook a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:

a) any information they provide in connection with the Competition is provided to the Promoter and not to Facebook or any other social network; and
b) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Facebook or any other social network.
41. If entry is via Instagram or if the Competition is promoted on Instagram, the Competition is in no way sponsored, endorsed, administered by or associated with Instagram and each entrant agrees to grant Instagram a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:

a) any information they provide in connection with the Competition is provided to the Promoter and not to Instagram or any other social network; and
b) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Instagram or any other social network.
PART J – TERMINATION OF COMPETITION

42. The Promoter reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other person, subject to applicable laws.

PART K – INTELLECTUAL PROPERTY

43. All intellectual property rights in the entries vest in the Promoter upon submission of the relevant entry. Where the Competition involves submission of any materials including but not limited to answers to questions, a statement, idea or opinion, video or voice recordings, images, works of art, designs or photographs (Content), all entrants represent, warrant and agree that:

a) the Content must not contain any viruses or cause or be likely to cause any injury or harm to any person or entity;
b) the Content must be the work of the individual submitting it;
c) the Content must not have been published elsewhere or have won a prize in any other competition or promotion;
d) entrants have obtained all appropriate consents and/or permission relating to a person who appears in, or whose property appears in, the Content;
e) the submission of the Content does not infringe the intellectual property rights of any third party and that the Content they are submitting is their own work and that they own the copyright for it;
f) the Promoter may remove or decline to publish any Content without notice to the relevant entrant;
g) the Promoter may use their likeness, image and/or voice in the event that the entrant is the Winner (including photograph, film or recording) in any media whatsoever throughout the world for the purpose of promoting this Competition or other similar competitions and promoting any products manufactured, distributed and or supplied by the Promoter. The entrant will not be entitled to any remuneration for such use.
PART L – DISPUTE RESOLUTION

44. A party may not commence court proceedings relating to any dispute arising from, or in connection with, these Terms (Dispute) without first meeting a representative of the other party within 10
