Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The promotion is only open to Australian residents.
Entrants under the age of 18 must have parent or legal guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Employees (and their immediate families) of the Promoter, Participating Independent Supermarkets, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
A “Participating Independent Supermarket” is any Metcash IGA Supermarket nationally that displays advertising materials for this promotion and stocks Eligible Products (defined below) during the Promotional Period.
Entry into the promotion opens at 12:01am AEST on 16/06/2025 and closes at 11:59pm AEST on 13/07/2025 (“Promotional Period”).
To be eligible to enter for the chance to win the total cost of their shop up to the value of $250.00 instantly, entrants must complete the following steps during the Promotional period.
Purchase any Birds Eye Deli Veg, Air Baked Fish or Golden Crunch 750g or 900g product in a single transaction -refer to table for all participating products (“Eligible Product”) from a Participating Independent Supermarket within Australia which displays advertising for this Promotion and collect a receipt at the time of purchase (“Qualifying Transaction”). In the event that a receipt is not automatically provided to an individual upon completion of their Qualifying Transaction, it is the individual’s responsibility to request one from the retailer.
Scan the QR code on the Birds Eye promotional material in the freezer at the Participating Independent Supermarket or on the takeaway leaflet or visit the promotion’s URL at winwith.birdseye.com.au to locate the online entry form;
Fully complete and submit the online entry form with their personal details including, but not limited to, first name, last name, mobile number and email address;
A time-based algorithm will then determine whether or not they have won an Instant Cash Prize. Winner/s will be notified instantly on-screen. All eligible entrants will also be placed into the Second Chance draw.

Values for purchases of tobacco, fuel, gaming and/or liquor are excluded for this promotion and will not count towards the total value of the Qualifying Transaction.
Multiple entries are permitted, subject to the following: (a) only one (1) valid entry submitted permitted per Qualifying Transaction, (b) each entry must be submitted separately and in accordance with entry requirements at clause 7; and (c) a maximum of one (1) entry permitted per person per day and any additional entries submitted by an entrant will be deemed invalid. Qualifying receipts and online invoices may only be used once and any sharing of receipts or invoices will deem all entrants sharing receipts or invoices as invalid to win a prize.
Instant Win Prizes: There are one hundred (100) x Instant Cash Winners, awarded up to a maximum value of AUD$250.00 (depending on total spend of their Qualifying Transaction) per winner.
Entrants will be notified immediately in writing on screen whether or not they have provisionally won an Instant Cash Prize. Instant Cash Prize winners will be emailed instructions on how to redeem their prize via EFT. Winners must provide all other necessary contact details including but not limited to Name, Address and Bank Account Number for the Promoter and its agents to validate their claim and then process payment of their prize.
Each Prize will be paid by the Promoter or its agent to each winner via direct electronic funds transfer into the nominated winner’s Australian bank account in their name, subject to verification. Winners are to allow up to twenty-eight (28) working days to receive their prize via bank transfer, following validation of their prize claim.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used by the entrant.
All entries are deemed to be received at the time of receipt into the promotion database and not at the time of transmission by the entrant.
Entrants must retain their original purchase receipt or online invoice for all entries as proof of purchase for each entry ("Proof of Purchase"). If an entrant fails to produce the Proof of Purchase for a specific entry or each entry, as and when requested by the Promoter, the Promoter has the right to invalidate the entrant's respective entry/entries for which Proof of Purchase cannot be provided and/or all entries submitted by that entrant and/or forfeit the entrant's right to a prize. Purchase receipt(s) or invoice(s) must clearly specify the product purchased, the store of purchase (for in-store purchases) and the date of purchase on the receipt(s) or invoice(s)/online order confirmation must be during the Promotional Period and prior to entry.
The Second Chance Draw will take place at Unit 5, 9 Fitzpatrick St, Revesby, NSW 2212 on 14/07/2025 at 12pm AEST. The Promoter may draw additional entries and record them in order, in the event that an invalid entry or ineligible entrant is drawn. The Promoter will draw one (1) x Second Chance Prize winner from all valid entries received during the Promotional Period. The Second Chance Prize winner will be the registered owner of the phone number provided at the time of entry.
The Second Chance Prize winner will be contacted by email within two (2) business days of the prize draw. Winner will be published (first initial, surname and postcode) online at winwith.birdseye.com.au from 21/07/2025.
The Second Chance Prize winner will win a AUD$500 gift voucher for a Participating Independent Supermarket of their choice (“Second Chance Prize”). The Second Chance Prize will be available for collection at the nominated store within 28 days of the Second Chance Prize draw date.
This Second Chance Prize is subject to the terms and conditions of the third-party prize supplier including those specified on the gift voucher and will apply to the prize at the time it is issued to the winner. Any ancillary costs associated with redeeming the gift voucher are not included. Any unused balance of the gift voucher will not be awarded as cash.
A draw for any Instant Win Prize(s) that have been won but not claimed (if any) and the Major Prize if unclaimed, will take place on 18/08/2025 at 12:00pm AEST at Unit 5, 9 Fitzpatrick St, Revesby, NSW 2212. Winners (if any) will be notified via email within two (2) business days of the draw. The winners of any unclaimed prize draw will be published online (first initial, surname and postcode) at winwith.birdseye.com.au from 25/08/2025.
The total prize pool value is up to AUD$25,500.
Prizes or any unused portion of a prize, are not transferable, changeable or redeemable for cash unless otherwise specified.
If any prize is unavailable, the promoter, in its discretion, reserves the right to substitute the Prize with a prize of greater or equal value, subject to any written directions from a regulatory authority.
Subject to an unclaimed prize draw, if any winner chooses not to take their prize (or is unable to), or does not take/redeem a prize at/by the time stipulated by the Promoter, for any reason, then the prize will be forfeited, and no compensation will be payable.
In the event an invalid or ineligible entry is drawn, or the Promoter is unable to contact a winner within one (1) month of the first attempting to notify that winner, having made reasonable attempts to do so, the Promoter may deem that winner’s entry invalid, and no compensation will be payable.
Acceptance of any prize is deemed consent for the Promoter to use the winner’s name, likeness, image and /or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process or engages in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the promoter's discretion. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an entrant, the promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The promoter’s decision is final and no correspondence will be entered into.
All entries become the property of the Promoter.
The Promoter and its associated agencies and companies accept no responsibility for prize damaged or lost in transit.
If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
If the promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including, but not limited to, technical difficulties or unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured.
To the extent permitted by law, the Promoter and its agents take no responsibility for any failure of any entry to be entered into the promotion due to, without limitation, technical malfunction or human error. The Promoter and its agents are not responsible for late, lost or misdirected entries. Incomplete or indecipherable entries will be deemed invalid.
As a condition of participating in the promotion, each winner indemnifies the Promoter, all organisers, sponsors and all other persons and organisations associated in any way with this promotion against all claims, damages, liabilities, costs and expenses (including costs on a solicitor-client basis) which a winner may incur arising out of their participation in the promotion and/or use of a prize, howsoever caused. For the sake of clarity, nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act (ASIC) Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia.
Except for any liability that cannot be excluded by law, the Promoter excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected; (d) any variation in the prize; (e) any tax liability incurred by a claimant or entrant; or (f) use of a prize.
The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to a claimant’s or any other person's mobile device or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
The Promoter collects and holds personal information provided by entrants for the purposes of this promotion and for future promotional purposes. For this promotion, which includes notifying the winners and facilitating redemption/supplying of Major Prizes, the Promoter may pass the winners’ personal details to their agencies and other associated organisations. Failure to provide requested personal information may disqualify a person from being able to enter the promotion and/or receive a Major Prize. All personal information provided by entrants will be held by the Promoter and used and handled in accordance with its Privacy Policy, which can be viewed at

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Under the Privacy Act 1988 (Cth), entrants have the right to access and correct any such personal information.
