Competition details
These terms (Terms) apply to the competition known as the "SeaLink KI Cup Competition" (Competition).
The Competition is run by Kangaroo Island SeaLink Pty Ltd ABN 69 007 122 367 of Level 3, 26 Flinders Street Adelaide 5000 (Promoter).
Your agreement to the Terms
By entering the Competition you acknowledge that you have read and understand these Terms, and you acknowledge that your entry into the Competition is deemed to be an acceptance of these Terms.
Competition Period
The Competition commences at 12:01am (Australian Central Standard Time) on 01 January 2026 and closes at 11:59pm (Australian Central Standard Time) on 19 January 2026 (Competition Period).
Eligible Participants
Entry to the Competition is open to South Australian residents only who are 18 years old or over who are not directors, management or personnel of the Promoter and its related entities (Eligible Participant(s)).
For the avoidance of doubt, whilst directors, management and employees of the Promoter and its related entities are not eligible to enter the Competition, their immediate family members are eligible to enter the Competition subject to satisfying the criteria in paragraph 5.
Entry process
To enter the Competition, an Eligible Participant must complete the entry form located at
www.sealink.com.au, and submit the completed entry form online during the Competition Period (Entry). No other form of entry is permitted.
All details provided on the Entry must be true and correct, and the Entry must be completed in full.
Each Eligible Participant may only submit one Entry to the Competition.
Verification
An Entry is valid only where it was submitted in accordance with paragraph 7, is the first such Entry submitted by that Eligible Participant as required by paragraph 9, and otherwise complies with these Terms.
The Promoter reserves the right, at any time, in its sole discretion to verify the validity of each Entry as described in paragraph 10, and may disqualify any entry that does not meet those requirements.
Draws and Prizes
The winning Entry will be drawn at random by the Promoter on 20 January 2026 (Draw) and will be the first valid Entry drawn as part of the Draw (Winning Entry).
The Eligible Participant of the Winning Entry (Winner) will win the SeaLink Kangaroo Island Racing Carnival Kangaroo Island Spirits Long Lunch Day Package for two departing Adelaide for Saturday 21 February 2026 (Prize). The total Long Lunch Day Package is valued at $1,022.
Winner will be notified by phone and email, within 5 business days of the Draw, using the details provided as part of the Winner’s Entry. The name of the Winner will also be published and displayed at on the Promoter's website at
www.sealink.com.au and on the Promoter's Facebook & Instagram page at
https://www.facebook.com/sealinkkangarooisland.
The Winner will told of their Prize by the Promoter within 5 business days of the Draw.
If the Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize for a prize of the same value (which will not exceed AUD$1022).
The Prize is not transferable and cannot be taken, refunded, exchanged or transferred as cash.
The Prize must be taken as described and no compensation will be payable if a Winner is unable to use the Prize (or any portion of it) or the Prize does not operate as the Winner expected.
The Promoter's decision about the Winner of the Prize is final and no correspondence will be entered into with any person in relation to any disputes about the Promoter's decision as to the Winner.
Any tax liability arising as a result of accepting the Prize is the responsibility of the Winner.
Liability
To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied by statute, custom or the common law are excluded from the Competition and these Terms. If any supply under these Terms is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, nothing contained in these Terms excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, to the extent that the Australian Consumer Law permits the Promoter to limit its liability, then the Promoter's liability will be limited to: (i) in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; and (ii) in the case of goods, the cost of replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity or profit); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
any theft, unauthorised access or third party interference;
any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in Prize value to that stated in these Terms;
any tax liability incurred by the Winner or Eligible Participant; or
use of or condition of the Prize.
