Terms and Conditions of Entry – Nintendo, Donkey Kong Competition
1. Information on how to enter form part of these Conditions of Entry for the Nickelodeon
& Nintendo, Donkey Kong Competition.
2. There is one method of entry for this competition.

To enter, entrants must log onto the Nickelodeon website (
www.nickelodeon.com.au)
and either; 1) Register their Nick Name and Password by providing the following
information; First name, Last name, Address, State, Postcode, Date of birth, whether they
are a girl or a boy, their email address, and some other optional information; or 2) If the
entrant has previously registered their details they are only required to enter their Nick
Name and Password in order to enter the competition.
Entrants will need to answer in 25 words or less the following question:
What are you most looking forward to about Donkey Kong Country Returns?
3. Entry is open only to all ages, as at Thursday, 2nd November 2010 who are Australian
residents. Employees and immediate families of Nickelodeon Australia and agencies
associated with this promotion are ineligible to enter.
4. The Promoter at their absolute discretion require photographic identification including
proof of age before awarding the prize. Identification considered suitable is at the
discretion of the Promoter.
5. The Nintendo, Donkey Kong Competition commences from Thursday, 2nd November
2010 at midnight ADST and entries close Friday, 31st December 2010 at 11:59pm ADST.
Entries received after the closing date will not be eligible to enter. Entries are deemed to
be received at the time of receipt of the web entry into the competition database and NOT
the time of transmission by the entrant.
6. The competition will be judged on Wednesday, 5th January 2010
7. The competition is a game of skill.
8. The judging will be held at Nickelodeon offices, 5 Thomas Holt Drive, North Ryde,
NSW 2113.
9. There are three major prizes to be won. Each of the three winners will receive:
1 x Wii prize pack, including 1 x Wii console and a 1 x copy of Donkey Kong Country
Returns for Wii!
10. Total AUD value of prizing is SRP $399.90 ($99.95 for Donkey Kong Country Returns
game and $299.95 for Wii console).
11. Within 14 days of the competition ending winners will be notified in of the prize they
have won and how the prize will be delivered. In the event that a winner is unable to be
contacted, and all methods of communication are unsuccessful, unclaimed prizes will be
dealt with as prescribed by the law of the State or Territory of Australia in which the prize
winner resides. The prize remains the property of the Promoter until claimed by the prize
winner.
12. No responsibility will be taken for late or lost entries.
13. Prizes are not transferable or redeemable for cash. The Promoter accepts no
responsibility for any variation in the value of the prizes. The Promoter reserves the right
to substitute any prize for an item of similar value.
14. The Promoter reserves the right to use the winner’s name, voice, and likeness for
advertising and publicity purposes in any media in perpetuity without additional
compensation.
15. The Promoter accepts no responsibility for any additional costs that may be
associated with prize, or any loss or damage.
16. By entering, entrants agree that the Promoter, their respective parent companies,
affiliates, subsidiaries, advertising and promotions agencies, and their respective officers,
directors, and employees shall not be liable for injury, loss (including but not limited to
indirect or consequential loss), or damage of any kind resulting from participating in this
promotion or from the acceptance or use/misuse of the prize awarded. This includes,
without limitation, personal injury, death, and property damage, and claims based on
publicity rights, defamation, or invasion of privacy.
17. The Promoter is not responsible for any incorrect or inaccurate information, or for any
of the equipment or programming associated with or utilised in this competition, or for any
technical error that may occur in the course of the administration of this competition. The
Promoter assumes no responsibility for any error, omission, interruption, deletion, defect,
delay in operation or transmission, communications line failure, theft or destruction or
unauthorised access to or alteration of entries.
18. In the event of war, terrorism, state of emergency, disaster or cancellation, the
promoter reserves the right to cancel, terminate, modify or suspend the promotion.
19. The judge’s decision is final. No correspondence will be entered into.
20. All entries become the property of Nickelodeon Australia and may be used for
promotional purposes. By entering the competition, each entrant consents to their
personal information being entered on to a database. Subject to the Promoter’s privacy
policy. Entrants who do not want their personal information used for the above purposes,
or who want to gain access to or correct their personal information should contact the
Promoter.
