Terms and Conditions

The promoter of the Competition is Witchery Fashions Pty Ltd ABN 70006897230 of 111 Cambridge Street, Collingwood VIC 3066 Australia.

By participating in the Competition, participants agree to be bound by these terms and conditions. Entries must comply with the terms and conditions to be valid.
The Promoter reserves the right in its sole and absolute discretion and to the extent permitted by law to amend any aspect of this Competition at any time (including these terms and conditions) without prior notification. Participants are encouraged to regularly check http://www.witchery.com.au/ for any amendments to these terms and conditions or to the Competition.

The Competition is open to all Australian and New Zealand residents over the age of 18.

The following persons are ineligible to enter:
(i) employees of the Promoter and its related parties (as that term is defined in the Corporations Act 2001 in relation to a 'public company' and as extended to bodies corporate generally) and employees of associated agencies and companies. For the purposes of this clause (i) "associated agencies and companies" means the agencies and companies associated with the Competition including airlines, magazines, advertising agencies and hotels.
(ii) the immediate families of the persons listed in clause (i) above. For the purposes of this clause (ii), "immediate families" of an employee of the Promoter includes his or her spouse, ex-spouse, de facto spouse, child, step child, adopted child, parent, step-parent, grandparent, uncle, aunt, siblings, step-siblings, or first cousin.

The Competition commences at 9:00am AEST on 4 August 2010 and closes at 5:00pm AEST on 30 September 2010. Entries received outside of the Promotional Period will not be accepted by the Promoter.

To enter the Competition, participants must obtain a boarding pass distributed through one of the following channels:
(i) EDM (Email for Witchery Loyalty Program members);
(ii) any Virgin Blue lounge in Australia between 23 August 2010 and 6 September 2010 inclusive;
(iii) the September 2010 issue of Marie Claire;
(iv) the September 2010 issue of Men's Health;
(v) the September 2010 issue of InStyle; and
(vi) the September 2010 issue of Women's Health,

Boarding Pass Prizes
Each boarding passwill be individually barcoded and will have a random prize comprising of between $20.00 and $1000.00. The Boarding Pass Prize can be redeemed by the participant in accordance with the procedure set out in clause 11.

Entry into Major Prize Draw
(i) In addition to being entitled to the Boarding Pass Prize, the holder of a boarding pass may use the boarding pass to enter the major prize draw.
(ii) No portion of the Boarding Pass Prize is redeemable for cash and the Boarding pass Prize cannot be retained or reused after it has been redeemed.
(iii) Stolen, onsold, transferred or copied Boarding Passes will be deemed invalid.
(iv) Only one (1) major prize draw entry is permitted per boarding pass.
(v) Each major prize draw entry will be individually assessed based on the validity of the original boarding pass. A decision by the Promoter in relation to the validity of the boarding pass is final and binding.

Limits on claiming prizes. Unless otherwise indicated, any prize available in the Competition may not be used in conjunction with any other special offers, discounts or promotions. Boarding Pass Prizes may not be used on lay-by purchases, gift vouchers or the Witchery Silver Gift collection.

Any refunds made in store on merchandise obtained through this Competition will be honoured based only the cash component (if any) paid by the participant and will not include the value of the Boarding pass Prize applied to the purchase price of the merchandise.
Participants may exchange any merchandise obtained through the Competition for an equal or higher value within 14 days of participating in the Competition. Where the exchange is for a higher value, the Participant must pay any additional costs.

The Promoter will distribute 682,500 Boarding Passes through the Distribution Channels as follows:

Men's Health 120,000
InStyle 95,000
Women's Health 130,000
Virgin Blue Lounges 27,500
EDM Digital passes 150,000

The Boarding Pass Prize pool will consist of the following values:
$20 Quantity: 671,546
$50 Quantity: 6,825
$100 Quantity: 3,413
$250 Quantity: 410
$500 Quantity: 205
$1000 Quantity: 101

How to enter the Competition
The entry procedure is as follows:
(i) the participant obtains a Boarding Pass through one of the Distribution Channels.
(ii) the participant goes to a participating Witchery store (excluding Witchery concession stores in David Jones (AUST), Smith and Caughey (NZ), Ballantynes (NZ) and on witchery.com.au).
(iii) the participant selects clothing or accessories (excluding the Silver Gift collection) at any participating Witchery store to the value of not less than $40.00.
(iv) participant surrenders the Boarding Pass at the POS for a Witchery staff member to scan.
(v) participant will find out the value of his/her Boarding Pass Prize at the POS when the Boarding Pass is scanned.
(vi) in the event the value of the Boarding Pass Prize exceeds the value of merchandise presented by the participant, the participant can elect to shop for more merchandise to obtain the full value of the Boarding Pass Prize or surrender the additional prize value.
(vii) participants must redeem the total value of the Boarding Pass Prize at the time of purchase and cannot return to the store at a later date to redeem any portion of the Boarding Pass Prize.
(viii) the Boarding Pass must be surrendered to a Witchery staff member once it has been scanned at the POS.
(ix) participant will automatically go into the major prize draw if they are a Witchery Loyalty Program member. The participant will be required to show valid photo identification at this stage.

Major Prize
The major prize in the Competition is a trip for two to Vomo Island Resort Fiji and includes:
(i) return economy flights from the winners nearest capital city in AUST or NZ (valued at AUD$3,000);
(ii) 5 nights' accommodation, all meals and soft drinks during meal times and all non-motorised activities together with daily laundry service (valued at AUD$5,710.00);
(iii) all airport transfers, including return transfers to and from Vomo island (valued at AUD$500.00);
(iv) AUD$500.00 spending money; and
(v) two Witchery wardrobes valued at AUD$2,000.00)

Value of Major Prize Package
The total value of the Major Prize Package is AUD$11,710.00 (including taxes) and is subject to change based on the point of departure and date of travel.

Date of Travel
Travel is valid from 31 October 2010 to 1 August 2011. Block out periods include Australian and New Zealand public holidays, long weekends and school holidays, special event periods together with the period between 10 December 2009 and 15 January 2010 inclusive.

Spending money
The winner is responsible for additional spending money and other ancillary costs not specifically included as part of the Major Prize Package which includes, but is not limited to, insurance and any applicable insurance excesses.

Travel
(i) All travel arrangements are to be made at least 30 days prior to travel.
(ii) Travel arrangements are subject to the terms and conditions of the Promoter or its assigned representatives.
(iii) All travel is subject to availability and may be dependent on select seat classes with airlines or specific room category availability with the accommodation partner.
(iv) Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by the Promoter and the airline carriers in accordance with normal travel practices. Airline and hotel terms and conditions apply to all airline travel and accommodation provided as part of the prize.

Redemption and transfer of the Major Prize Package
(i) No portion of the Major Prize Package is redeemable for cash.
(ii) The Major Prize Package is not refundable or transferable.
(iii) The Major Prize Package must be taken as stated and no compensation will be paid if a winner is unable to use the Major Prize Package as stated.

Taxes
Except as otherwise provided by these terms and conditions, all taxes (excluding GST) which may be payable as a consequence of receiving the Major Prize Package are the sole responsibility of the winner.

Changes to the Major Prize Package
(i) The Major Prize Package is valued in Australian dollars.
(ii) The Promoter accepts no responsibility for any variation in the value of the Major Prize Package.
(iii) The winner is advised that tax implications may arise from winning the Major Prize Package and they should seek independent financial and tax advice prior to acceptance of the Major Prize Package.
(iv) If any part of the Major Prize Package is unavailable, the Promoter, in its complete and absolute discretion, reserves the right to substitute the Major Prize Package with a prize to the equal value or specification.
(v) If for any reason whatsoever the winner does not take all components of the Major Package Prize then that component of the Major Package Prize not taken will be forfeited by the winner and cash will not be awarded in lieu of the forfeited component.

Entry into the Major Prize Package draw
(i) To enter the draw for the Major Prize Package, participants must be a member of the Witchery Loyalty Program.
(ii) To become a Witchery Loyalty Program member, participants must collect a Witchery Loyalty Program membership card from any Witchery store and activate it online at http://members.witchery.com.au.
(iii) New members can collect a Witchery Loyalty Program membership card in store at the time of redemption of the Boarding Pass Prize. The Witchery Loyalty Program membership card must be scanned with the purchase. If the Witchery Loyalty Program membership card is then activated within 5 working days of the transaction, the participant will be automatically entered into the competition.
(iv) If the Witchery Loyalty Program membership card is not activated within 5 working days, new Witchery Loyalty Program members will not be entered into the competition for the Major Prize Package.
(v) Witchery Loyalty Program members must present their Witchery Loyalty Program membership card at the POS together with valid photo identification and their redeemed Boarding Pass to enter draw for the Major Prize Package .

Major Prize Package Draw
(i) The Major Prize Package draw will take place at Infodial Australia Pty Ltd Level 3, 554 Church Street Richmond, Victoria 3121 on Wednesday 6 October 2010 at 11am AEST.
(ii) All valid entries received within the Promotional Period will be entered into the draw for the Major Prize Package.
(iii) The Major Prize Package winner will be notified in writing by email within 2 working days of the draw and their name will be published in The Australian on 10 October 2010 and on www.witchery.com.au.
(iv) By agreeing to the terms and conditions, participants consent to their first name, surname, suburb and state being published in The Australian newspaper on 10 October 2010 as well as on the Promoter's website, Facebook page and Twitter account.

Additional draw
(i) The Promoter may conduct further draws at the same place and time as the original Major Prize Package draw on or about 6 January 2011 (being at least 3 months after the date of the last prize draw) to distribute the Major Prize Package if unclaimed by that date.
(ii) All entries received during the Promotional Period will be entered in the Unclaimed Prize Draw. The winner of the Unclaimed Prize Draw will be notified in writing by email within 2 working days of the Unclaimed Prize Draw and their name will be published in The Australian and on the Promoter’s website on or about 10 January 2011.

Total prize pool
The total prize pool value for the Competition including the Boarding Pass Prize and the Major Package Prize is $14,431,180.00.

Promoter's rights
(i) At the Promoter's absolute discretion, the Promoter reserves the right, at any time, to verify the validity of entries and participants (including an entrant's identity, age, and place of residence) and to disqualify any participant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Any decision made by the Promoter will be final and binding.
(ii) Despite anything to the contrary contained in these terms and conditions, errors and omissions may be accepted at the Promoter's absolute discretion.
(iii) Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Responsible drinking
The Promoter encourages responsible drinking. Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines. These are:
(i) males: up to 6 standard drinks on any one day, no more than 3 days a week; and
(ii) females: up to 4 standard drinks on any one day, no more than 3 days a week.

Entry to any licensed premise is subject to the licensee's liquor serving policy, license obligations.

Release
It is a condition of acceptance of the Major Prize Package that the winner may be required to sign a legal release document or other documents of consent in respect of the Major Prize Package. These documents will be provided in a form to be determined by the Promoter.

Promoter not responsible
(i) The Promoter cannot be held responsible for any technological fault in their POS system resulting in participants being unable to redeem the Boarding Pass Prizes at the POS.
(ii) Where the Boarding Pass Prize or Major Package Prize is awarded in the form of, or comprises of, a ticket, pass, voucher or letter, the Promoter will not be liable for any ticket, pass, voucher or letter, that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the ticket, pass, voucher or letter, is subject to the terms and conditions specified on the ticket, pass, voucher or letter. In the event that the winner is requested to provide proof of age or any other form of consent, redemption of the ticket, pass, voucher or letter, will be subject to presentation of such proof. What constitutes identification and/or proof of consent is at the complete discretion of the Promoter or any other service providers.
(iii) If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion and to the fullest extent permitted by law to:
(i) disqualify any participant; or
(ii) modify, suspend, terminate or cancel the Competition, as appropriate in the circumstances.

Promoter not liable
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and related parties (as that term is defined in the Corporations Act 2001 in relation to a 'public company' and as extended to bodies corporate generally)) is not liable for, and each participant must not bring any claim for, any personal injury, or any loss or damage whatsoever (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to:
(i) any negligence of the Promoter (including its officers, employees, agents and related parties);
(ii) technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(iii) any theft, unauthorised access or third party interference;
(iv) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(v) any variation in the Boarding Pass Prize or Major Package Prize value to that stated in these terms and conditions;
(vi) any tax liability incurred by the winner; and
(vii) the redemption or taking of the Boarding Pass Prize or Major Package Prize.

Ownership of entries
(i) All entries submitted (including any rights to the intellectual property contained in such entries) are assigned to, and become the property of, the Promoter. Entries will not be returned to any participant. By entering this Competition each participant warrants to the Promoter that each entry submitted does not contain any material which would infringe the rights of any third party, including any copyright, trademark or other third party intellectual property rights.
(ii) The participant agrees to indemnify the Promoter, and keep the Promoter indemnified, against all claims and costs by third parties arising from a breach of the warranty set out in this clause.
(iii) The Promoter is entitled to use any of the entries submitted for any purpose at its sole and absolute discretion, including (but not limited to) for any future promotion, marketing and publicity purposes.

Communications
By entering the Competition, the participant consents to receipt of any email regarding the Competition and other emails which inform the participant of other promotions or publications of the Promoter and it's related parties or associated third parties.

Privacy
The collection, use and disclosure of personal information provided in connection with this Competition is governed by the Witchery Privacy Policy which is available at www.witchery.com.au.

Jurisdiction
These terms and conditions are governed by, and are to be construed in accordance with, the laws enforceable in Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia and any court hearing appeals from those courts.

Whole agreement
These terms and conditions embody the entire agreement between the Promoter and each participant with respect to this Competition.

Validity
Any provision in these terms and conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these terms and conditions or affecting the validity or enforceability of that provision in any other jurisdiction.

(ii) 5 nights' accommodation, all meals and soft drinks during meal times and all non-motorised activities together with daily laundry service (valued at AUD$5,710.00);
(iii) all airport transfers, including return transfers to and from Vomo island (valued at AUD$500.00);
(iv) AUD$500.00 spending money; and
(v) two Witchery wardrobes valued at AUD$2,000.00)

Value of Major Prize Package
The total value of the Major Prize Package is AUD$11,710.00 (including taxes) and is subject to change based on the point of departure and date of travel.

Date of Travel
Travel is valid from 31 October 2010 to 1 August 2011. Block out periods include Australian and New Zealand public holidays, long weekends and school holidays, special event periods together with the period between 10 December 2009 and 15 January 2010 inclusive.

Spending money
The winner is responsible for additional spending money and other ancillary costs not specifically included as part of the Major Prize Package which includes, but is not limited to, insurance and any applicable insurance excesses.

Travel
(i) All travel arrangements are to be made at least 30 days prior to travel.
(ii) Travel arrangements are subject to the terms and conditions of the Promoter or its assigned representatives.
(iii) All travel is subject to availability and may be dependent on select seat classes with airlines or specific room category availability with the accommodation partner.
(iv) Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by the Promoter and the airline carriers in accordance with normal travel practices. Airline and hotel terms and conditions apply to all airline travel and accommodation provided as part of the prize.

Redemption and transfer of the Major Prize Package
(i) No portion of the Major Prize Package is redeemable for cash.
(ii) The Major Prize Package is not refundable or transferable.
(iii) The Major Prize Package must be taken as stated and no compensation will be paid if a winner is unable to use the Major Prize Package as stated.

Taxes
Except as otherwise provided by these terms and conditions, all taxes (excluding GST) which may be payable as a consequence of receiving the Major Prize Package are the sole responsibility of the winner.

Changes to the Major Prize Package
(i) The Major Prize Package is valued in Australian dollars.
(ii) The Promoter accepts no responsibility for any variation in the value of the Major Prize Package.
(iii) The winner is advised that tax implications may arise from winning the Major Prize Package and they should seek independent financial and tax advice prior to acceptance of the Major Prize Package.
(iv) If any part of the Major Prize Package is unavailable, the Promoter, in its complete and absolute discretion, reserves the right to substitute the Major Prize Package with a prize to the equal value or specification.
(v) If for any reason whatsoever the winner does not take all components of the Major Package Prize then that component of the Major Package Prize not taken will be forfeited by the winner and cash will not be awarded in lieu of the forfeited component.


Entry into the Major Prize Package draw
(i) To enter the draw for the Major Prize Package, participants must be a member of the Witchery Loyalty Program.
(ii) To become a Witchery Loyalty Program member, participants must collect a Witchery Loyalty Program membership card from any Witchery store and activate it online at http://members.witchery.com.au.
(iii) New members can collect a Witchery Loyalty Program membership card in store at the time of redemption of the Boarding Pass Prize. The Witchery Loyalty Program membership card must be scanned with the purchase. If the Witchery Loyalty Program membership card is then activated within 5 working days of the transaction, the participant will be automatically entered into the competition.
(iv) If the Witchery Loyalty Program membership card is not activated within 5 working days, new Witchery Loyalty Program members will not be entered into the competition for the Major Prize Package.
(v) Witchery Loyalty Program members must present their Witchery Loyalty Program membership card at the POS together with valid photo identification and their redeemed Boarding Pass to enter draw for the Major Prize Package .

Major Prize Package Draw
(i) The Major Prize Package draw will take place at Infodial Australia Pty Ltd Level 3, 554 Church Street Richmond, Victoria 3121 on Wednesday 6 October 2010 at 11am AEST.
(ii) All valid entries received within the Promotional Period will be entered into the draw for the Major Prize Package.
(iii) The Major Prize Package winner will be notified in writing by email within 2 working days of the draw and their name will be published in The Australian on 10 October 2010 and on www.witchery.com.au.
(iv) By agreeing to the terms and conditions, participants consent to their first name, surname, suburb and state being published in The Australian newspaper on 10 October 2010 as well as on the Promoter's website, Facebook page and Twitter account.

Additional draw
(i) The Promoter may conduct further draws at the same place and time as the original Major Prize Package draw on or about 6 January 2011 (being at least 3 months after the date of the last prize draw) to distribute the Major Prize Package if unclaimed by that date.
(ii) All entries received during the Promotional Period will be entered in the Unclaimed Prize Draw. The winner of the Unclaimed Prize Draw will be notified in writing by email within 2 working days of the Unclaimed Prize Draw and their name will be published in The Australian and on the Promoter’s website on or about 10 January 2011.


Total prize pool
The total prize pool value for the Competition including the Boarding Pass Prize and the Major Package Prize is $14,431,180.00.


Promoter's rights
(i) At the Promoter's absolute discretion, the Promoter reserves the right, at any time, to verify the validity of entries and participants (including an entrant's identity, age, and place of residence) and to disqualify any participant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Any decision made by the Promoter will be final and binding.
(ii) Despite anything to the contrary contained in these terms and conditions, errors and omissions may be accepted at the Promoter's absolute discretion.
(iii) Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


Responsible drinking
The Promoter encourages responsible drinking. Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines. These are:
(i) males: up to 6 standard drinks on any one day, no more than 3 days a week; and
(ii) females: up to 4 standard drinks on any one day, no more than 3 days a week.

Entry to any licensed premise is subject to the licensee's liquor serving policy, license obligations.


Release
It is a condition of acceptance of the Major Prize Package that the winner may be required to sign a legal release document or other documents of consent in respect of the Major Prize Package. These documents will be provided in a form to be determined by the Promoter.

Promoter not responsible
(i) The Promoter cannot be held responsible for any technological fault in their POS system resulting in participants being unable to redeem the Boarding Pass Prizes at the POS.
(ii) Where the Boarding Pass Prize or Major Package Prize is awarded in the form of, or comprises of, a ticket, pass, voucher or letter, the Promoter will not be liable for any ticket, pass, voucher or letter, that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the ticket, pass, voucher or letter, is subject to the terms and conditions specified on the ticket, pass, voucher or letter. In the event that the winner is requested to provide proof of age or any other form of consent, redemption of the ticket, pass, voucher or letter, will be subject to presentation of such proof. What constitutes identification and/or proof of consent is at the complete discretion of the Promoter or any other service providers.
(iii) If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion and to the fullest extent permitted by law to:
(i) disqualify any participant; or
(ii) modify, suspend, terminate or cancel the Competition, as appropriate in the circumstances.

Promoter not liable
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and related parties (as that term is defined in the Corporations Act 2001 in relation to a 'public company' and as extended to bodies corporate generally)) is not liable for, and each participant must not bring any claim for, any personal injury, or any loss or damage whatsoever (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to:
(i) any negligence of the Promoter (including its officers, employees, agents and related parties);
(ii) technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(iii) any theft, unauthorised access or third party interference;
(iv) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(v) any variation in the Boarding Pass Prize or Major Package Prize value to that stated in these terms and conditions;
(vi) any tax liability incurred by the winner; and
(vii) the redemption or taking of the Boarding Pass Prize or Major Package Prize.

Ownership of entries
(i) All entries submitted (including any rights to the intellectual property contained in such entries) are assigned to, and become the property of, the Promoter. Entries will not be returned to any participant. By entering this Competition each participant warrants to the Promoter that each entry submitted does not contain any material which would infringe the rights of any third party, including any copyright, trademark or other third party intellectual property rights.
(ii) The participant agrees to indemnify the Promoter, and keep the Promoter indemnified, against all claims and costs by third parties arising from a breach of the warranty set out in this clause.
(iii) The Promoter is entitled to use any of the entries submitted for any purpose at its sole and absolute discretion, including (but not limited to) for any future promotion, marketing and publicity purposes.

Communications
By entering the Competition, the participant consents to receipt of any email regarding the Competition and other emails which inform the participant of other promotions or publications of the Promoter and it's related parties or associated third parties.

Privacy
The collection, use and disclosure of personal information provided in connection with this Competition is governed by the Witchery Privacy Policy which is available at www.witchery.com.au.

Jurisdiction
These terms and conditions are governed by, and are to be construed in accordance with, the laws enforceable in Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia and any court hearing appeals from those courts.

Whole agreement
These terms and conditions embody the entire agreement between the Promoter and each participant with respect to this Competition.

Validity
Any provision in these terms and conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these terms and conditions or affecting the validity or enforceability of that provision in any other jurisdiction.
