Channel [V], [V] HITS and MAX are proudly presenting John Butler Trio’s national tour through August and Sept.

The John Butler Trio have spent the past few months on a gruelling schedule to release their new ‘APRIL UPRISING’ album simultaneously in eleven markets around the world, the JBT’s fifth studio release has garnered incredible global respect and success. With much anticipation for a live experience from JBT at home, their cherished Australian fans need wait no more as the band is pleased to announce their national APRIL UPRISING TOUR of Australia taking place in August and September with tickets on sale on NOW .

The APRIL UPRISING TOUR will see John and his new band mates Nicky Bomba (drums and percussion) and Byron Luiters (bass) visit all capital cities and a host of major regional centres around the country. It will be their largest Australian tour since the release of the multiple platinum selling album ‘Sunrise Over Sea’ in 2004. (NB: Townsville and Queensland press please note details below regarding your show which will be a special Union Of Soul show!)

To celebrate the tour [V] and Max are giving a very lucky JBT fan the opportunity of a lifetime to travel to Brisbane and get up close, personal and behind the scenes with JBT. TERMS AND CONDITIONS


ENTRY INTO THE COMPETITION

1. Entry into the Channel [V] and MAX “JBT” competition (the “Competition”) is open to all residents of Australia. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.

2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter.

3. Competition begins at 9.00am (AEST) on Monday 16th August 2010 and closes at 11.59pm (AEST) on Sunday 29th August 2010 (the “Competition Period”).

4. To enter the Competition and be eligible to win, entrants must:

(a) register for membership online at www.vmusic.com.au or www.maxtv.com.au ;
(b) complete the online entry form
(c) in 25 words or less answer the following question “Why does John Butler Trio’s music strike a chord with you? (the “Competition Question”)

5. All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth to be eligible for entry. Incomplete entries or those with defamatory, copyrighted, pre-used or offensive content will be ineligible. It is the entrant’s responsibility to inform the Promoter if their residential address, email address or phone number changes during the Competition Period.

6. Only 1 entry per membership per day will be permitted. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.

PRIZE

7. There is 1 x Major Prize in total.

The Major Prize consists of:

• 2 x return domestic economy airfares from the Major Prize winner’s nearest capital city to Brisbane (“Flight”), valued at a maximum of $1500;
• 2 x nights accommodation for two people in Brisbane in a minimum 3 star apartment to coincide with the concert on Thursday 23rd September, valued at a minimum of $350;
• Opportunity to meet John Butler Trio, this a money can’t buy prize;
• Opportunity to watch John Butler Trio’s gig side of stage, this is a money cant buy prize;
• 2 x tickets to John Butler Trio’s concert in Brisbane on Thursday 23rd September, valued at $140;
• 1 x Maton 12 string acoustic guitar signed by John Butler Trio, valued at $1500;
• John Butler Trio merchandise pack valued at $300
(the “Major Prize”)


Please note that if the Major Prize Winner is under 18 years of age, they must be accompanied at all times throughout the conduct of the Major/Minor Prize by their parent or legal guardian over the age of 25 years. All aspects of the Major Prize must be used at one time.

8. The total maximum Prize pool value is $3790 .
The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.

9. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes. The dates and venues selected by entrants cannot be changed at a later date.

10. Only one Prize per person will be awarded.

11. The Major are only valid for the Event in Brisbane as listed in clause 7. Entrants from locations outside of Brisbane are eligible to enter the Competition.


JUDGING AND AWARD OF PRIZE

12. The Competition will be judged on the basis of creativity at Channel [V] and MAX, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 30th August 2010 at 10.00am (AEST). Chance plays no part in the selection of the Prize winner. The Prize winner will be notified via email or phone on Tuesday 31st August 2010 and their name published on the Channel [V] and MAX website from Wednesday 1st September 2010. The Prizes must be claimed within 5 days of the publication of the Prize winner’s name.

13. If the Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.

AGE
14. In the event that a Prize winner is under the age of 18 years, they must be accompanied by their parent or legal guardian over the age of 25 years at all times throughout the conduct of the Major and Minor Prizes.

TRAVEL

15. It is a condition of entry that the Major Prize winner and their guest must be available to travel to and stay in Brisbane on the dates specified by the Promoter in Clause 7 to coincide with the Event detailed in Clause 7.

16. In the event that the Major Prize winner is a resident of Brisbane (which shall be determined at the absolute discretion of the Promoter), the flight component of the Major Prize will be forfeited in full and no substitute will be offered. The Major Prize winner’s nearest capital city will be determined at the discretion of the Promoter.

17. All ancillary costs incurred in taking and using the Major Prize (including but not limited to meals, mini bar, spending money, insurance and taxes) are the responsibility of the Major Prize winner and their guest. All ancillary costs incurred in taking and using the Minor Prizes (including but not limited to transport, spending money and accommodation costs) are the responsibility of the Minor Prize winners and their guests. Unless expressly stated as being part of the Prizes, all other expenses are the sole responsibility of the Prize winners and their guests.

18. The Prize winner is advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.

19. It is a condition of accepting the Prize that the Prize winner and their guest may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

20. The Promoter reserves the right to refuse to allow the Prize winner or his or her guest to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Prize.

GENERAL

21. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.

22. By entering the Competition, each entrant warrants that their entry, is their own original work and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false.

23. No responsibility will be taken by the Promoter, Channel [V], MAX, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.

24. The Promoter reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition.

25. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel the Competition or to vary or cancel the terms of the Competition or the award of the Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):

(a) a Prize winner does not satisfy the Competition entry requirements; or
(b) the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control.

26. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prize it shall not:

(a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and
(b) be required to conduct the Competition at any other time.

27. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter will accept no responsibility for any delays to entry caused by technical disruptions or malfunctions. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
28. The Promoter accepts no responsibility for any Prizes that are damaged, delayed or lost in transit.

29. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

30. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.

31. All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which is available at www.vmusic.com.au and www.maxtv.com.au . By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agrees that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.

The APRIL UPRISING TOUR will see John and his new band mates Nicky Bomba (drums and percussion) and Byron Luiters (bass) visit all capital cities and a host of major regional centres around the country. It will be their largest Australian tour since the release of the multiple platinum selling album ‘Sunrise Over Sea’ in 2004. CHANNEL [V] AND MAX “JBT” COMPETITION TERMS AND CONDITIONS ENTRY INTO THE COMPETITION 1. Entry into the Channel [V] and MAX “JBT” competition (the “Competition”) is open to all residents of Australia. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions. 2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter. 3. Competition begins at 9.00am (AEST) on Monday 16th August 2010 and closes at 11.59pm (AEST) on Sunday 29th August 2010 (the “Competition Period”). 4. To enter the Competition and be eligible to win, entrants must: (a) register for membership online at www.vmusic.com.au or www.maxtv.com.au ; (b) complete the online entry form (c) in 25 words or less answer the following question “Why does John Butler Trio’s music strike a chord with you? (the “Competition Question”) 5. All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth to be eligible for entry. Incomplete entries or those with defamatory, copyrighted, pre-used or offensive content will be ineligible. It is the entrant’s responsibility to inform the Promoter if their residential address, email address or phone number changes during the Competition Period. 6. Only 1 entry per membership per day will be permitted. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice. PRIZE 7. There is 1 x Major Prize in total. The Major Prize consists of: • 2 x return domestic economy airfares from the Major Prize winner’s nearest capital city to Brisbane (“Flight”), valued at a maximum of $1500; • 2 x nights accommodation for two people in Brisbane in a minimum 3 star apartment to coincide with the concert on Thursday 23rd September, valued at a minimum of $350; • Opportunity to meet John Butler Trio, this a money can’t buy prize; • Opportunity to watch John Butler Trio’s gig side of stage, this is a money cant buy prize; • 2 x tickets to John Butler Trio’s concert in Brisbane on Thursday 23rd September, valued at $140; • 1 x Maton 12 string acoustic guitar signed by John Butler Trio, valued at $1500; • John Butler Trio merchandise pack valued at $300 (the “Major Prize”) Please note that if the Major Prize Winner is under 18 years of age, they must be accompanied at all times throughout the conduct of the Major/Minor Prize by their parent or legal guardian over the age of 25 years. All aspects of the Major Prize must be used at one time. 8. The total maximum Prize pool value is $3790 .The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars. 9. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes. The dates and venues selected by entrants cannot be changed at a later date. 10. Only one Prize per person will be awarded. 11. The Major are only valid for the Event in Brisbane as listed in clause 7. Entrants from locations outside of Brisbane are eligible to enter the Competition. JUDGING AND AWARD OF PRIZE 12. The Competition will be judged on the basis of creativity at Channel [V] and MAX, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 30th August 2010 at 10.00am (AEST). Chance plays no part in the selection of the Prize winner. The Prize winner will be notified via email or phone on Tuesday 31st August 2010 and their name published on the Channel [V] and MAX website from Wednesday 1st September 2010. The Prizes must be claimed within 5 days of the publication of the Prize winner’s name. 13. If the Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize. AGE 14. In the event that a Prize winner is under the age of 18 years, they must be accompanied by their parent or legal guardian over the age of 25 years at all times throughout the conduct of the Major and Minor Prizes. TRAVEL 15. It is a condition of entry that the Major Prize winner and their guest must be available to travel to and stay in Brisbane on the dates specified by the Promoter in Clause 7 to coincide with the Event detailed in Clause 7. 16. In the event that the Major Prize winner is a resident of Brisbane (which shall be determined at the absolute discretion of the Promoter), the flight component of the Major Prize will be forfeited in full and no substitute will be offered. The Major Prize winner’s nearest capital city will be determined at the discretion of the Promoter. 17. All ancillary costs incurred in taking and using the Major Prize (including but not limited to meals, mini bar, spending money, insurance and taxes) are the responsibility of the Major Prize winner and their guest. All ancillary costs incurred in taking and using the Minor Prizes (including but not limited to transport, spending money and accommodation costs) are the responsibility of the Minor Prize winners and their guests. Unless expressly stated as being part of the Prizes, all other expenses are the sole responsibility of the Prize winners and their guests. 18. The Prize winner is advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize. 19. It is a condition of accepting the Prize that the Prize winner and their guest may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 20. The Promoter reserves the right to refuse to allow the Prize winner or his or her guest to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or his or her guest are not in the mental or physical condition necessary to be able safely to participate in the Prize. GENERAL 21. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered. 22. By entering the Competition, each entrant warrants that their entry, is their own original work and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false. 23. No responsibility will be taken by the Promoter, Channel [V], MAX, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize. 24. The Promoter reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition. 25. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel the Competition or to vary or cancel the terms of the Competition or the award of the Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion): (a) a Prize winner does not satisfy the Competition entry requirements; or (b) the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control. 26. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prize it shall not: (a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and (b) be required to conduct the Competition at any other time. 27. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter will accept no responsibility for any delays to entry caused by technical disruptions or malfunctions. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates. 28. The Promoter accepts no responsibility for any Prizes that are damaged, delayed or lost in transit. 29. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into. 30. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition. 31. All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which is available at www.vmusic.com.au and www.maxtv.com.au . By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agrees that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.
