TERMS AND CONDITIONS:

‘Singha Bar’ Competition – July 2010
The ‘Singha Bar’ Competition aims to help Singha better understand its customers by offering them the chance to win a free SinghaBar visit to their workplace. To enter, you must fill in the details required at www.singhabar.com.au and in 25 words or less tell us a time when you have been transported from work. Set out below are the terms and conditions applicable to the Competition.

This Competition is for over 18s only. You must read and agree to these Terms and Conditions before entering the Competition.

   1. Agreement:

These terms and conditions (Terms) and our Privacy Policy at www.singhabeer.com constitute the agreement (the ‘Agreement’) between you (Participant) and Boonrawd Trading International Co. Ltd (Singha) in relation to your use of this website at www.singhabar.com.au  (Website) and your participation in the ‘Singha Bar’’ competition (Competition).

   1. Acceptance of Terms:
   2. By entering into the Competition, each Participant fully and unconditionally agrees to and accepts these Terms, the provisions of the Agreement, and the decisions of Singha.
   3. Singha’s decision is final and binding and no correspondence will be entered into.
   4. Eligibility:
   5. Entry is open to all residents of Australia over the age of 18 years. However, employees (and their immediate family members) of Singha, their advertising agencies or website designers associated with this Competition and/or this Website, other relevant agencies, and their related entities are not eligible to enter.
   6. Participants under the age of 18 years are not entitled to enter the Competition or participate in the Prize.
   7. Entries:
   8. To enter the Competition, Participants must:
         1. Be over the age of 18 as of the first date of the Competition;
         2. Register online by fully completing and submitting the entry form available at www.singhabar.com.au;  and
         3. Answer in 25 words or less the following question “namea time when you have been ‘transported’ from work.” (the “Competition Question”).
   9. There is a limit of one entry per person in the Competition. Use of any automated software or other electronic devices to repeatedly enter the Competition is prohibited and will deem the entry invalid.

  10. False, incorrect or incomplete registration information or the inclusion of any offensive, defamatory or unlawful material in an entry will deem the entry invalid, making that person ineligible to enter the Competition and to win any prizes.
  11. Personal Information:
  12. As part of the Competition, Singha or Singha’s agent will be collecting and storing the Participant’s personal information (Personal Information);
  13. By entering the Competition each Participant agrees that Singha’s public relations agency, Stellar Concepts Australia of  Suite 508, Level 5, 410 Elizabeth St, Surry Hills NSW 2010, may collect and store, on behalf of Singha, the Participant’s Personal Information;
  14. The Participant also agrees that Singha may use his/her Personal Information for future similar promotional, marketing and publicity purposes and provide his/her Personal Information to organisations that assist Singha with those activities unless such consent is expressly withdrawn by the Participant;
  15. To access, update or correct your Personal Information, please consult Singha’s Privacy Policy at www.singhabeer.com.au
  16. Promoter:

The promoter is of Boonrawd Trading Limited of 83 Amnuay-Somgkram Road, Kwaeng Thanon Nakornchaisri, Dusit, Bangkok 10300 Thailand (contact c/ Stellar Concepts Australia of  Suite 508, Level 5, 410 Elizabeth St, Surry Hills NSW 2010 Australia)

   1. Competition Period:
               1. The Competition Period commences on 12 July 2010 at 10am (local NSW time) and concludes on 10 September 2010 at 10am (local NSW time) (the “Competition Period”). 
               2. Entries will be deemed to be received at the time they are recorded as being received and fully registered in Singha’s system, not at the time they were sent by the Participant.
   2. Prize Details:
   3. Total prize pool is valued at up to $4,000 AUD. The following prizes (“Prizes”) will be awarded during this Promotion:
   4. Nine Major Prizes: being a catered “SinghaBar Experience” at the winner’s nominated workplace (being $240 of Singha beverages provided by Singha (“Major Prize”)

   5. Participants (including their guests and any companies that the Participant may be representing in the Competition) are only eligible to win and/or participate in one prize.
   6. All prize values are the recommended retail price in Australian dollars, are inclusive of GST and are correct at the time of printing. The contents of the prize shall remain entirely at the discretion of Singha.
   7. Singha accepts no responsibility for any variation in the value of prizes.
   8. Singha reserves the right to change any details of Competition prizes, or substitute alternative prizes to an equivalent value if necessary, subject to State Regulation.
   9. Prizes, or any unused portion thereof, are not transferable, exchangeable and cannot be taken as cash.
  10. Prize Draw:
               1. Each valid entrant who has entered the Competition over the duration of the Competition Period will be entered into the Competition.
               2. Each week’s entries to the Competition shall be judged on the basis of creativity exhibited in the Competition Questions at Sydney on 11am every Wednesday from Wednesday the 14th July to Wednesday the 8th of September (individually the “Dates of Judgement”).
               3. The Competition is a game of skill and chance plays no part in determining the winners of the Prizes.
               4. Singha’s decision in relation to all matters pertaining to the Competition is final and no correspondence will be entered into.
               5. Singha reserves the right to request that winners and their guests provide proof of identity and/or proof of residency at the nominated prize delivery address in order to claim a prize. Proof of identification, age residency and entry considered suitable for verification is at the discretion of Singha. In the event that a winner cannot provide suitable proof, the winner will surrender the prize in whole and no substitute will be offered.
               6. Winners of each prize will be contact by phone on the relevant Wednesday after judgment has occurred during the Dates of Judgement.
  11. Notification:
  12. Prize winners will be notified by phone and email within 7 days of the draw.
  13. Singha will not advise Participants of failure to win a prize.
  14. Should the Participant’s contact details change during the Competition Period, it is the Participant’s responsibility to notify Singha. A request to access or modify any information provided in an entry should be directed to Singha on 02 9281 8000
  15. Singha is not responsible for contacting winners by any other method or for winners not receiving notification (including, but not limited to, a change to, or incorrect supply of personal details).
  16. If a winning Participant cannot be contacted or does not claim their Prize by the date stipulated by Singha, then the Prize will be forfeited by the Participant. No substitute or replacement prize will be offered to the Participant in this situation.
  17. Participants, including prize winners and their guests, must at Singha’s request, participate in any marketing and promotional activity in relation to winning the prize, free of charge.
  18. It is a condition of entry that the Participant agrees to their image, and/or voice, as recorded, photographed or filmed during the Competition (including but not limited to as part of the Competition), may be broadcast or published by Singha (together with its representatives and affiliates) worldwide in any media, including but not limited to, television, radio, internet, newspapers, magazines, or any other advertising or marketing in connection with this Competition and/or any future event, and the Participants will not be entitled to any fee for such use. Participants’ consent to any use of the above created materials in a way which may otherwise infringe their moral rights pursuant to The Copyright Act 1968 (Cth)
  19. The Participant agrees that its guests shall only be able to participate in the Prize upon their consent to the terms and conditions of this Agreement, together with any other reasonable terms and consents required by Singha (and/ or its representatives).

   1. Prize Collection and Delivery:
               1. Singha will make arrangements for the prizes to be delivered to and collected from each Winner. Prizes shall be accompanied by a SIngha representative who will pack up and remove the prize once the allocated time limit for the Prize is reached. However, whilst prizes are at the winning Participant’s (or their representatives) premises, Singha takes no responsibility for prizes that are damaged, delayed or lost.
               2. In certain circumstances, Singha’s property (including the bar) may need to be left at the relevant premises over the weekend or several days. Should this be necessary, the Participant agrees to procure all necessary consents and measures to ensure that this is possible and that the property shall be secure during this time period.

   1. Lost Entries:
   2. No responsibility is accepted by Singha for late, lost or misdirected entries via the internet.
   3. Any costs associated with accessing this Website are the Participant's responsibility and are dependent on the internet service provider used. It is recommended that Participants check with their internet service provider in this regard.
   4. Technical Problems:

To the extent permitted by law, Singha excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website; or any unauthorised intervention, or any combination thereof – including any injury or damage to any Participant’s or any other person's computer related to, or resulting from, participation in this Competition or downloading any materials in this Competition. Singha accepts no responsibility for entries not received or included for any reason, including due to technical or other failure or for any periods that the website or entry mechanism is unavailable for any reason during the Competition period.

   1. Cancellation:
               1. If for any reason this Competition is not capable of running as planned in any respect due to any cause beyond the reasonable control of Singha, Singha reserves the right to cancel, postpone or amend the Competition without compensation to any Participant.
               2. In the event that the Competition is cancelled by Singha, or where the Prizes are varied, modified or withdrawn in any manner, Singha (together with its representatives and affiliates) shall not be:
   2. liable to any person or entity for any loss or damage arising out of, or in connection, with such acts; or
   3. required to conduct or commence the Competition again at any time.
   4. Disqualification:
   5. Any breach of these Terms disentitles a Participant (together with their guests) from participating in the Competition and winning any prizes.
   6. Singha reserves the right in its sole discretion to disqualify any Participant who Singha has reason to believe has failed to comply with the entry process, breached any of these Terms or any instructions or directions on the Website, or engaged in any unlawful or other improper misconduct (including but not limited to tampering or interfering with the entry mechanism in any way).
   7. Singha's legal rights to recover damages or other compensation from such an offender are reserved.
   8. Responsible Consumption of Alcohol:
               1. Singha and its representatives are committed to the responsible consumption of alcohol and encourage their consumers to drink Singha responsibly and always in moderation.
               2. All consumers, Participants and their guests are advised to refer to the safe drinking levels recommended in the National Health & Medical Research Council’s guidelines and policy “Australian Guidelines to Reduce Health Risks from Drinking Alcohol” which are available at http://www.nhmrc.gov.au/publications/synopses/ds10syn.htm
               3. Entry and continued involvement in this Competition and participation in the Prize is entirely subject to compliance with Singha’s (and its designated representatives and licensee’s) liquor serving policy.
               4. Singha reserves the right to refuse service, entry or continued participation to in the Prize to anyone at any time.
               5. The Participant acknowledges that their (and their guests) participation in the Prize is entirely contingent upon their compliance with Singha’s (and Singha’s representatives) directions regarding the responsible consumption of alcohol.
   9. Limitation of Liability:
  10. All Participants enter the Competition at their own risk. Singha shall not be liable for any loss or damages (including but not limited to indirect or consequential loss), or for personal injury or death or loss of, or damage to property, which is suffered or sustained in connection with the Competition or any prize, except to the extent that liability cannot be excluded by law.
  11. Singha shall not be responsible for any tax liability arising as a result of the Participant’s participation in the Competition or a winner’s acceptance of the Prize.
  12. Singha will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Competition if the deficiency is occasioned by any cause outside the reasonable control of Singha, including without limitation technical malfunctions or failures.
  13. It is a condition of accepting a prize that the winner (together with their guests and companions) may be required to sign a legal release in a form determined by Singha in its absolute discretion.
  14. Interpretation:
  15. This Agreement will be governed by and construed according to the laws of New South Wales and references to times are references to the time in Sydney, Australia.
  16. Headings are for ease of reference and do not affect interpretation.
  17. The word ‘including’ is not a term of limitation.
  18. General:
  19. The brand names, logos and related taglines appearing on this Website, whether or not appearing in large print or with the trade mark symbol, are trade marks of Singha, Singha Corporation or their related bodies corporate.
  20. The use or misuse of these trade marks or any other materials, except as permitted in these Terms, is expressly prohibited.
  21. Singha reserves the right to change these Terms at any time.
