“THE DAILY TELEGRAPH MONOPOLY 2010” PROMOTION - TERMS & CONDITIONS

1. Information on how to enter, how to claim, how to play, and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. There will be a maximum total prize pool of up to $434,155. There will be a maximum of 700,000 promotional game boards printed for this promotion (which will be distributed on 15/08/10) and 6,662,000 promotional game cards printed for this promotion (which will be distributed throughout the Promotional Period). The game boards distributed on 15/08/10 will have the promotional game card for that day attached. Printing and other quality control errors will not be used as the sole reason to invalidate an otherwise valid prize claim. Unless an entry is invalid, all prize claims in excess of the advertised prize pool will be honoured.

2. Entry is only open to residents of New South Wales and ACT, who purchase a copy of The Daily Telegraph, or the Sunday Telegraph between 15/08/10 and 29/08/10 (inclusive). This promotion is not open to residents of Victoria, Queensland, Northern Territory, Western Australia, Tasmania or South Australia and is not being conducted in these States/Territories.  Employees and the immediate families of Nationwide News Pty Ltd, its affiliates/joint promotional partners, participating newsagents, subagents, and any agencies associated with this promotion are ineligible. Entrants under the age of 18 years must seek permission from a parent or guardian prior to entering the promotion.

3. Promotion commences at 12.01am (AEST) on 15/08/10 and closes at 11.59pm (AEST) on 29/08/10 (Promotional Period). Collect and Win Prize claims and Instant Win Prize claims must be registered on the Monopoly hotline on 1300 721 123 no later than 12 noon on 30/08/10. Hotline is open between 9.00am (AEST) and 5.00pm (AEST)  daily, until 29/08/10 and until 12.00pm (AEST)  on 30/08/10.  Claims must then be received by last mail on 06/09/10.  Entries for the Second Chance Draw close at 12.00pm (AEST) on 06/09/10. All times are local time in New South Wales.

4.On each day during the Promotional Period (Sunday 15/08/10 to Sunday 29/08/10), a promotional game card will be inserted in The Daily Telegraph (Mon – Sat), and The Sunday Telegraph.

5. Collect and Win Prizes: For the chance to win a Collect and Win Prize, consumers must cut out the four (4) Monopoly Property Tokens (available each day during the promotion period) in the “Collect and Win” section of the promotional game card and attach each Monopoly Property Token to the corresponding property printed on the promotional game board. Collect all of the Monopoly Property Tokens required to complete a “property set” on the promotional game board to win the corresponding Collect and Win Prize for that property set (as specified on the token in each case). For example, to win the Collect and Win Prize corresponding with the “Green” property set, you must collect the Monopoly Property Tokens for “Bond Street”, “Oxford Street”, and “Regent Street” during the Promotional Period.

To claim a Collect and Win Prize, you must first register your claim on the hotline by calling 1300 721 123 no later than 12 noon on 30/08/10.  The hotline is open between 9am and 5pm daily, until 29/08/10 and until 12 noon on 30/08/10. Claimants must have their promotional game board with them when they call.

For verification purposes, Collect and Win Prize winners may be required to send in:

(a) their original winning promotional game board with the original corresponding Monopoly Property Tokens for the relevant property set attached; and
(b) their name, address and telephone number written on a separate sheet of paper;

To reply paid address, PO Box 9199, South Yarra VIC 3141 so that it is received by last mail on 06/09/10.  Collect and Win Prize winners must also retain a photocopy of their promotional game board (with the Monopoly Property Tokens attached).

6. Instant Win Prizes: Entrants must scratch the Instant Win panel on the game card to see whether they have won an Instant Win Prize. Instant Win Prizes must be redeemed by 12.00pm (AEST) the day following the date of insertion in the newspaper. Instant Win Prizes can be redeemed for the prize specified on the Instant Win panel by calling the promotional hotline on 1300 721 123 (excluding Music Download winners).

For verification purposes, winners of Instant Win Prizes (excluding Music Download winners) may be required to send in:

(a) The original Instant Win Prize section of the game card, with the scratched panel clearly visible; and
(b) Their name, address and telephone number written on a separate sheet of paper;

To the address supplied by the Promoter, so that it is received by last mail on 06/09/10.  Instant Win Prize winners must also retain a photocopy of their game card (with the Instant Win Prize section clearly visible).

7. Second Chance Draw: Every game card that does not contain an Instant Win Prize is printed with a unique code. To enter the second chance draw for unclaimed prizes, log on to dailytelegraph.com.au/monopoly and enter your code and details, as requested, or SMS your name, address, daytime phone number and code (in that order, with a space between each detail) to 199 977 11 or call 1900 991 015 and follow the instructions. Entries for the Second Chance Draw close at 12.00pm (AEST) on 06/09/10. Limit of one entry into the Second Chance Draw per game card.  Entrants must retain their original promotional game cards with the unique code used to enter. SMS entries and 1900 calls charged at 55c incl GST. 1900 calls from mobile phones or pay phones may attract a higher rate. SMS entry mechanic is only open to consumers with an SMS compatible mobile phone connected to a service provider and plan which permits text messaging to the promotional SMS number. SMS entrants under 18 years old must obtain account holder’s consent. SMS helpline: 1300 737 728.

8. The Second Chance Draw for unclaimed prizes will take place at 3.00pm (AEST)  on 14/09/10 at Suite 5/15 Grosvenor Street, Neutral Bay NSW 2089. The Promoter reserves the right, at any time, during the Promotional Period, to conduct additional unclaimed prize draws in order to distribute any prizes that are not claimed in accordance with these Terms and Conditions. All prizes advertised will be awarded.

An Unclaimed Prize Draw will take place for all remaining prizes that are unclaimed by 5.00pm (AEST) on 10/12/10. The draw will take place at 3.00pm (AEST)  on 17/12/10 at Suite 5/15 Grosvenor Street, Neutral Bay NSW 2089. The Promoter reserves the right, at any time, during the Promotional Period, to conduct additional unclaimed prize draws in order to distribute any prizes that are not claimed in accordance with these Terms and Conditions. All prizes advertised will be awarded. Any winners in the Unclaimed Prize Draw will be notified by mail, and any winners of prizes over $500 will be published in The Daily Telegraph on 24/12/10.

9. Prizes will only be awarded where the entrant has fulfilled all of the requirements of the Promoter’s verification tests and procedures. The Promoter reserves the right, at any time, to verify the validity of all claims/entries and claimants/entrants (including a claimant’s/entrant’s identity, age and place of residence) and to disqualify any claimant/entrant who tampers with the claim/entry process or who submits a claim/entry that is not in accordance with these Terms and Conditions. The verification tests and procedures shall be determined by the Promoter in its absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

10. The Promoter’s decision in relation to all aspects of this promotion is final and no correspondence will be entered into.

11. No responsibility will be accepted for late, lost or misdirected mail/entries/claims.

Prize Conditions
COLLECT & WIN PRIZES:

• Hyundai vehicle prize is a 2010 Hyundai i30 2.0L (excluding side airbags) manual with metallic paint, and registration, compulsory insurance and on-road costs. Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The colour of the vehicle prize will be white. The prize must be collected from  McCarroll’s Hyundai, 395 Pacific Highway, Artamon NSW 2064. Total maximum retail value of the prize is $22,500.

• Toyota vehicle prize is a 2010 Toyota Corolla 1.8L Manual Hatch without metallic paint, and registration, compulsory insurance and on-road costs. Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The colour of the vehicle prize will be at the discretion of the Promoter. The prize must be collected from Phil McCarroll Toyota, 42 Pacific Highway, Waitara NSW 2077. Total maximum retail value of the prize is $24,000.

• $5,000 Cash prize is $5,000 paid into the winner’s nominated bank account by EFT by the promoter, or by cheque, depending on the winner’s preference. Total maximum retail value of each prize is $5,000.

• Sharp prize is a SHARP LC52LE820X (52”LED TV – RRP $3,999) Total maximum retail value of each prize is $3,999.

• Jayco prize is a 2010 Expanda Caravan 18.57-6 with air conditioning, rollout awning, ensuite and includes registration, compulsory insurance and on-road costs. Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. Exterior and Interior colours will be at the discretion of the Promoter. Prize must be collected from the winner’s nearest authorised Jayco dealership. Total maximum retail value of the prize is a maximum $49,500.

• Specialist Holiday Collect and Win prize  consist of a Fiji Holiday Voucher valued at $3,500 comprising of return economy airfares for two adults flying Air Pacific from Sydney to Nadi, incl departure taxes, airport transfers in Fiji plus 7 night twin share accommodation in a superior room at Outrigger on the Lagoon – Fiji. Valid for travel 1 November to 18 December 2010 and 01 February – 31 March 2011. Dates are subject to availability. .  The winners will be contacted by mail and will be contacted by a Specialist Holiday Travel representative. Specialist Holiday Travel Prizes are not redeemable for cash or travellers cheques. The winner must comply with the standard terms of use as specified by Specialist Holiday Travel. Where the cost of purchase exceeds the available prize balance, the winner will be required to make up the difference between the purchase price and the balance. Specialist Holidays disclaims responsibility for any lost or stolen vouchers. Defaced, mutilated, altered, lost or stolen vouchers will not be replaced or redeemed. Total maximum retail value of each prize is $3,500.

• IGA Gift Vouchers can be used at any participating IGA store around Australia for, or towards, the gift of your choice. Please treat this voucher as cash. It cannot be replaced if lost or stolen. Once activated, this voucher can only be used in participating IGA stores in Australia. This voucher cannot be exchanged for cash or used to settle IGA accounts. No change will be given. Voucher is valid for six months from date of issue and may be redeemed at participating IGA stores only – see in store for details. These Terms of Use may be changed at any time – please check www.iga.net.au for updates. Total maximum retail value of each prize is $50.

• Hoyts Double Movie Pass prizes are subject to Hoyts Terms and Conditions as specified on the Pass. Pass cannot be used Saturday after 5pm, for No Free or Discount Offers, Special Events, IMAX, thehalfpipe, La Premiere or Directors Suite cinemas. Pass is valid until the expiry date indicated and is not transferable or redeemable for cash. Total maximum retail value of each prize is $35.

• Redspot Car Rentals prize consists of a 1 day car rental voucher, for a Nissan Tiida or similar. The prize includes basic insurance but excludes fuel and Loss or Damage Liabilities and Reduction, which is optional. A Liability and Reduction package may be purchased at a fee per day reducing the liability fee to zero from $495.00. A surcharge applies to drivers between 21 and 24 years of age ($22.00 per day). This voucher becomes ‘Null and Void’ for prize winners under the age of 21 years. The voucher is not transferable for cash and early returns do not qualify for a refund. The voucher is valid to 03 February 2011 and is not available during blockout periods such as long weekends, public holidays or between 22 December 2010 and 4 January 2011. • Music Download winners will need to go to www.theinsong.com/monopoly and enter a unique code from the winning panel during the Promotional Period to redeem their prize.  Music Downloads must be redeemed by 12.00pm (AEST) on 30/08/2010. Winners will be able to select one song to download onto their computer from the list of available tracks. Total maximum retail value of each prize is $5.10.

13. The Nationwide News Pty Ltd accept no responsibility for any variation in the prize values. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash (unless expressly specified as a cash prize).

14. In the event that a prize(s) is/are not available, the Promoter reserves the right to substitute prize(s) in its discretion to the same and equal recommended retail value and/or specification, subject to any written directions from the New South Wales Office of Liquor, Gaming and Racing.

15. Collect and Win Prize winners will be notified by mail.  Instant Win prize winners will be notified immediately in writing.  All winners of prizes over the value of $500 will be published in The Daily Telegraph on 12/09/10 and at www.dailytelegraph.com.au/monopoly.   

16. Winners in the Second Chance Draw will be notified by mail, and any winners of prizes over $500 will be published in The Daily Telegraph on 17/09/10. The Promoter’s decision is final and no correspondence will be entered into.

17. Except for any liability that cannot be excluded by law, the Promoter and the various prize suppliers (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry/prize claim that is late, lost, altered, damaged or misdirected (either prior to their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; or (e) use of any prize. It is a condition of accepting certain prizes (as determined by the Promoter in its absolute discretion) that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

18. Premium SMS entries and 1900 calls will be charged at 55c including GST. SMS entrants must have premium service access. It is recommended that entrants check with their individual service provider in this regard. SMS entrants under 18 years old must obtain account holder’s consent. SMS helpline: 1300 737 728. 1900 calls from mobile and pay phones may attract a higher rate. 1300 calls to the official Claims Hotline number charged at local call costs including GST.

19. Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.  Any contact details entered incorrectly on the website or on any required promotional material shall be deemed invalid.

20. SMS entries for the Second Chance Draw via the internet are not valid and will not be accepted. All entries are deemed to be received at the time of receipt into the ‘The Daily Telegraph Monopoly Competition’ database and NOT at the time of transmission by the entrant.

21. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by applicable State Regulatory bodies, to cancel, terminate, modify or suspend the competition. 

22. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and promotional partners.

23. The Promoter collects entrants’/claimants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant/claimant may not participate in the promotion. By participating in the promotion, unless otherwise advised, each entrant/claimant also agrees that the Promoter may use this information, for an indefinite period, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant/claimant, including sending the entrant/claimant electronic messages and/or telephoning the entrant/claimant. We get 10 Daily Telegraph's at work each day and I've just gone through and scratched all the cards for the last couple of days, no luck on the tokens yet
