1. The Promoter is Expedia Australia Pty Limited ACN 101 694 946 of Suite 1, Level 2, 77 King Street, Sydney NSW 2000. The website is owned and operated by Expedia, Inc, a Washington corporation.
2. The Promotion commences at 00:00:01 AEST on 23/08/2010 and ends at 23:59:59 AEST on 26/09/ 2010 (“Promotion Period”).
3. Entry is open to residents of Australia aged 18 years or older who meet the criteria set out in the Promotion Terms & Conditions.
4. Persons who make an eligible booking on Expedia.com.au during the Promotion Period will be entered in the Promotion.
5. Draws will take place Monday – Friday at Insured Creativity, 89 Wellington Street, St Kilda, Victoria 3182, in accordance with the Promotion Terms & Conditions
6. Each prize awarded will consist of a reimbursement to the draw winner for the value of the relevant booking made on Expedia.com.au. The travel associated with the relevant booking must be completed before 26 September 2011 in order to redeem (or, in relation to residents of Victoria and Queensland, retain) the prize.

8. Victoria and Queensland Residents: If you do not complete all travel associated with the relevant booking, the value of the prize must be returned to the Promoter and will become a debt owed by you until returned.

Terms and ConditionsInformation on how to enter, the prizes and rules for redeeming the prizes form part of the terms and conditions of entry for the Promotion. Participation in the Promotion is deemed acceptance of these terms and conditions (Terms) and any other notices referenced herein.
The Terms include:
1. the Promotion Specific Terms & Conditions set out in Part A below; and
2. the General Terms & Conditions set out in Part B below.
In these Terms, the term "you" refers to the person making a booking through the website located at
www.expedia.com.au ("Website") and/or with the assistance of the Expedia.com.au travel experts.
Part A - Promotion Specific Terms & Conditions

A.2 Promotion Period The Promotion Period:
1. commences at 00:00:01 AEST on Monday, 23 August 2010; and
2. closes at 23:59:59 AEST on Sunday, 26 September 2010,
unless the Promotion ends earlier in accordance with these Terms.
A.3 Who may enter
1. Entry to the Promotion is open to residents of Australia only who are aged 18 years or older at the date of entry and who otherwise meet the criteria set out in these Terms.
2. Employees and officers of the Promoter, the agencies associated with this Promotion (including, without limitation, Insured Creativity Australia Pty Limited ACN 127 591 324), and their immediate family members are not eligible to enter the Promotion or to be awarded any prizes in connection with the Promotion.
A.4 How to enter
1. For each day of the Promotion Period there will be a "Daily Entry Cycle" commencing at 00:00:01 AEST and closing at 23:59:59 AEST on each day. As the Promotion Period runs for 35 days, there will be 35 Daily Entry Cycles.
2. Subject to paragraph (c) below and all other Terms, all persons who make a booking on the Website in relation to travel before 26 September 2011(and receive confirmation of the booking (including an Itinerary Number)) during a Daily Entry Cycle will be entered into the draw to be conducted in relation to that Daily Entry Cycle.
3. If you do not wish to participate in the Promotion, you must contact Expedia.com.au Customer Support on 13 38 10 on the day your booking is made or by 10 am on the day immediately following your booking date to request that your Itinerary Number not be included in draw for the relevant Daily Entry Cycle.
A.5 Number of entries
1. Each unique Itinerary Number booked in accordance with these Terms will be eligible to be entered in the Promotion. If you make more than one booking on the Website and receive more than one unique Itinerary Number, each unique Itinerary Number will be included in the draw for the relevant Daily Entry Cycle.
2. If the Promoter becomes aware, or has reason to suspect (in its reasonable opinion), that you have:
1. cancelled and re-booked bookings made on the Website in an effort to obtain re-entry into the Promotion during another Daily Entry Cycle; or
2. made multiple bookings on the Website for similar items in order to increase the entries made during a Daily Entry Cycle; or
3. otherwise engaged in conduct which impacts on the fairness, integrity or proper conduct of this Promotion,
the Promoter may, in its absolute discretion, disqualify the relevant Itinerary Number(s) from the Promotion and/or disqualify your participation in the Promotion.
A.6 Prizes and Winners
1. During the Promotion Period, a total of 175 prize winners will be drawn. To redeem their prize (or, in relation to residents of Victoria and Queensland, to retain their prize), each prize winner must comply with the applicable Redemption Conditions set out below
2. In relation to each Daily Entry Cycle (of which there are 35), 5 prizes will be awarded at the draw described below. This means that each Itinerary Number has 5 chances of winning a prize. Each prize awarded will only be granted to the prize winner subject to the Redemption Conditions, at the time described, in paragraph A.7 below.
3. Subject to the prize winner complying with the Redemption Conditions set out below, each prize awarded will consist of a reimbursement to the prize winner for the value of the booking made under the Itinerary Number at the time the Itinerary Number is entered in the Promotion ("Reimbursement Prize"). This means that if a prize winner increases the value of the booking made under the winning Itinerary Number (and complies with the Redemption Conditions), the prize winner will receive the Reimbursement Prize but will not be entitled to receive a reimbursement or any other amounts for the additional cost of the booking under that Itinerary Number.
4. Except in relation to residents of the ACT, if the prize winner does not comply with the Redemption Conditions, the Reimbursement Prize will be forfeited and the prize awarded to the prize winner will be a $50 Coupon for use on the Website ("Coupon Prize"). Coupon Prizes are subject to the terms and conditions of the coupon, including expiry period. If the relevant prize winner is a resident of the ACT and he or she does not comply with the Redemption Conditions, the Reimbursement Prize will be forfeited and no substitute prize will be given.
A.7 Reimbursement Prize Conditions and Redemption of Prizes (Redemption Conditions)
1. To redeem (or, in relation to residents of Victoria and Queensland, to retain) the Reimbursement Prize, the prize winner must complete all travel booked under the winning Itinerary Number before 26 September 2011. No extension on the redemption period for the Reimbursement Prize will be permitted.
2. Except in relation to residents of Victoria and Queensland, the Reimbursement Prize may only be redeemed after the date on which this condition is fulfilled and will be awarded by way of reimbursement to the credit card used to make the booking the subject of the winning Itinerary Number.
3. In relation to residents of Victoria and Queensland only, the Reimbursement Prize will be awarded by way of reimbursement to the credit card used to make the booking the subject of the winning Itinerary Number within 28 days of the date of the relevant draw, subject to the following conditions:
1. the prize winner acknowledges and agrees that he or she is only entitled to retain the Reimbursement Prize if he or she completes all travel booked under the winning Itinerary Number before 26 September 2011;
2. if the prize winner does not complete all travel booked under the winning Itinerary Number before 26 September 2011 or cancels, or otherwise seeks a refund of any portion of, the booking made under the winning Itinerary Number, the prize winner must immediately return or reimburse the value of the Reimbursement Prize to the Promoter and the prize winner will have no further claim against the Promoter;
3. upon receipt of the returned or reimbursed Reimbursement Prize by the Promoter, the relevant prize winner will be awarded the Coupon Prize as a substitute prize; and
4. if the prize winner fails to comply with the Redemption Conditions set out in paragraphs (i) and (ii) of this clause, the prize winner irrevocably authorises the Promoter to charge to the credit card used to make the booking the subject of the winning Itinerary Number the amount of the outstanding Reimbursement Prize that is to be returned to the Promoter.
4. If the Promoter is not able to contact you, within 3 months of completing the relevant travel, the Reimbursement Prize awarded to you will be forfeited.
5. If the prize winner:
1. does not complete all travel booked under the winning Itinerary Number before 26 September 2011; or
2. cancels, or otherwise seeks a refund of any portion of, the booking made under the winning Itinerary Number,
the prize winner will be deemed to have not complied with the Redemption Conditions.
A.8 Prize Value
In relation to the total prize pool value (for lottery permit application purposes only):
1. as the Promoter cannot determine the value of all Itinerary Numbers that will be drawn during the Promotion Period, the Promoter cannot provide an exact value of the total value of all Reimbursement Prizes that may be awarded. Accordingly, for lottery permit application purposes only, the Promoter estimates that the maximum total value of all Reimbursement Prizes will be $115,000.
2. in the event that all Reimbursement Prizes are forfeited, the maximum total value of all Coupon Prizes will be $8,750.
The Promoter takes no responsibility for any variations in prize values.
A.9 Method to Determine Winners
1. All prize winners will be determined by random draws. The draws will be conducted by Insured Creativity Australia Pty Limited ACN 127 591 324.
2. All entries (i.e. Itinerary Numbers) received during a Daily Entry Cycle will be allocated to the draw for that period. Itinerary Numbers allocated to one draw will not carry forward into any subsequent draw.
3. As 5 prizes are awarded at each draw, each Itinerary Number has 5 chances of being selected in the relevant draw.
A.10 Time and Place of Draws
1. There are a total of 35 draws to be held in this Promotion. In relation to Daily Entry Cycles occurring on a:
Monday:
the prize draw will occur at 11 am on the immediately following Tuesday;
Tuesday:
the prize draw will occur at 11 am on the immediately following Wednesday;
Wednesday:
the prize draw will occur at 11 am on the immediately following Thursday;
Thursday
the prize draw will occur at 11 am on the immediately following Friday; and
Friday, Saturday or Sunday:
the prize draw for each day will occur at 11 am on the immediately following Monday (i.e. 3 prize draws will take place on the Monday).
2. Each of the 35 draws will take place at Insured Creativity, 89 Wellington Street, St Kilda, Victoria 3182.
A.11 Prize Winner Notification
All prize winners will be notified by e-mail and SMS within 2 business days of each draw, using the contact details provided in connection with the relevant Itinerary Number.
A.12 Prize Winner Publication
The details of prize winners will be published in The Australian as follows:
1. in relation to the draws to take place from 24 August 2010 to 10 September 2010, details of prize winners will be published on 20 September 2010; and
2. in relation to the draws to take place from 13 September 2010 to 27 September 2010, details of prize winners will be published on 4 October 2010.

Part B - General Terms & Conditions
B.1
The Promoter reserves the right, at any time, to verify the validity of entries and participants in the Promotion (including an entrant’s identity, age and place of residence).
B.2
The Promoter may, at its absolute discretion, declare any or all entries made by you to be invalid if you:
1. fail to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or
2. submit an entry which is not in accordance with these Terms.
B.3
If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or who may benefit from such tampering and, subject to the approval of those authorities that have issued permits for the conduct of this Promotion, to cancel, terminate, modify or suspend the Promotion.
B.4
In the case of any act, agent or event which prevents or hinders the Promoter's ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, the Promoter may, in its absolute discretion but subject to the approval of those authorities that have issued permits for the conduct of this Promotion, to cancel, terminate, modify or suspend the Promotion cancel the Promotion.
B.5
All prizes awarded, and travel undertaken, in connection with the Promotion are subject to the standard terms and conditions applicable to such prizes and/or travel, as notified to you at the time of booking or at the time of redeeming the prize.
B.6
The prize winners consent to the use of their name, place of residence, travel destination, the travel-related item booked, likeness, image and/or voice (including photograph, film and/or recording of the same) for promotional and marketing purposes in any media for an unlimited period without remuneration. Prize winners agree to participate in reasonable promotional activities as requested by the Promoter.
B.7
Except with the written consent of the Promoter, prizes are not transferable or exchangeable and non-cash prizes cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
B.8
In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.
B.9
To the maximum extent permitted by law, the Promoter excludes all liability (including negligence) arising out of or in connection with:
1. inaccurate / incorrect transcription of entry information;
2. purported entries that are not received for any reason, including because or any transmission errors or if they are misdirected or stolen;
3. any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
4. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website (including, without limitation, the Website);
5. any variation in the Terms;
6. any theft, unauthorised access or third party interference in any part of the Promotion;
7. electronic or human error which may occur in the administration of the Promotion;
8. any loss or damage (including loss of opportunity) suffered or sustained, to person or property and including, but not limited to, direct, indirect, special or consequential loss (including economic loss) by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a prize winner;
9. any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this Promotion.
A prize winner, and his or her guests (if any), must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded.
B.10
The Promoter's decisions are final and the Promoter will not enter into any correspondence.
B.11
Any taxes which may be payable as a consequence of a prize winner receiving a prize are the sole responsibility of the prize winner.
B.12
The Promoter collects personal information in order both to conduct the Promotion. The Promoter may disclose such information to third parties, including, but not limited to, prize suppliers, agencies associated with the Promotion, and to Australian regulatory authorities. Participation is conditional on providing this information. The Promoter and third parties to whom the Promoter provides this information may, for an indefinite period unless otherwise advised, use the information for announcing prize winners (name and suburb/postcode only) and for direct marketing, research and debt collection purposes. Participants in the Promotion should direct any request to access, update or correct information to the Promoter. By participating in the Promotion, you agree to use of your information in accordance with the Privacy Policy accessible at

All entrants in the Promotion acknowledge that:
1. the Promoter does not own or operate the Website; and
