Competition Terms & Conditions
1. Information on how to enter and prizes forms part of these Conditions of Entry. Entry into this competition is deemed to be acceptance of these Conditions of Entry.
2. Entry is only to Australian permanent residents (“Eligible Entrants”). Directors, managers and employees of the Promoter, their associates companies, advertising agencies and other agencies associated with this Promotion and their immediate family members are ineligible to enter or win. “Immediate Family” means spouse, ex-spouse, de-facto, parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin.
3. The promoter reserves the right at any time to verify the validity of the entries and entrants (including an entrants identity, age and place of residence) and to disqualify any entrant who the promoter believes either has (a) tampered with the entry process; (b) or submitted an entry which is not in accordance with these Conditions of Entry or acts in a disruptive manner; (c) or acts with the intent to annoy, abuse, threaten or harass any other person; (d) or breaches any of these Conditions of entry; or (e) engages in improper or unlawful conduct calculated to jeopardise the fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
4. No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed or misdirected entries.
5. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion to determine the identity of the entrant.
6. To enter and be an Eligible Entrant (during the Promotion Period as defined in clause 10):
* When uploading a photo, all contact details must be filled out.
* Entrants must abide by the photo criteria conditions as stated in clause 7 and these Conditions of Entry.
7. Eligible entrants must abide by the photo criteria conditions which include:
* Must be an Australian Resident.
* Must be the parent/guardian of the child in the photo or acting with permission of the parent/guardian
* The photo must show a child 12 months of age or older.
* The photo contains no nudity or nipples.
* The photo is not obscene or offensive
8. The Promoter reserves the right to permanently block any entrant who makes unsuccessful or an incomplete entry.
9. Voters will be required to confirm their email address the first time they vote.
10. Voters are eligible to vote multiple times but only once per photo.
11. The Promotion commences at 9am (AEST) 17/08/10 and closes 11:59pm on 11/10/10. Winners will be notified by email by the 22nd October 2010.
12. The Eligible Entrants who have the largest number of votes by the end of the promotional period will each win 1x Panasonic model SDRS50 digital video camera valued at $449RRP each (5 in total).
13. All Eligible Entrants or any eligible voters will receive a PixiFotos discount voucher which entitles them to a $5 photographic sitting and 10”x13” gift portrait (value $112) PLUS $25 off collection purchases voucher. This voucher can be redeemed at any PixiFoto franchise throughout Australia. Standard PixiFotos Terms and Conditions apply. 14. The PixiFoto discount voucher is valid for 1 year from the date the voucher is received via email.
15. There is a limit of one prize per household.
16. The total prize pool value at RRP is AUD$2,245 (including GST).
17. The prizes are not transferable or exchangeable and cannot be taken as cash, either in the whole amount, or in any unused portion.
18. Eligible Entrants consent to the Promoter using the entrants name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording for the same) in any media for an unlimited period without remuneration of the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
19. If for any reason this competition is not capable of running as planned in any respect due to any cause beyond the reasonable control of the promoter, the Promoter reserves the right, subject to the written directions of any relevant authority, in it’s sole discretion to cancel, postpone or amend the competition as appropriate.
20. Except for any liability that cannot be excluded by law, the promoter (including it’s officers, employees and agents) accepts no liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following:
* any technical difficulties to equipment malfunction (whether or not under the Promoter control)
* any theft, unauthorised access or third party interference;
* any entry, vote or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond he reasonable control of the Promoter)
* any tax liability incurred by a winner or entrant; or use of a prize.
21. In the event of a prize not being accepted or claimed within 3 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to award the prize to the Eligible Entrant that submitted the photo that had the next highest number of votes.
22. The Promoter is not responsible for any content, included but not limited to, comments, images which are transmitted or posted to the site (user generated content). Users shall be wholly responsible and liable for any user generated content they post, including any infringement of the copyright, trademark or other proprietary rights of any third party. Not withstanding the above, the Promoter reserves the right but assumes no obligation, to remove edit or modify any user generated content for any reason whatsoever in its sole absolute discretion.
23. The Promoter may require the winner to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
24. The Promoter, through its agent, is collecting personal information for the purpose of conducting this Promotion and notifying the winners. Entrants should direct any request to access, update or correct information to the Promoter.
25. All entries become the property of the Promoter and may be used by the Promoter for Promotional purposes for an indefinite time and with no further consultation and/or payment with the Entrants
