TERMS & CONDITIONS OF ENTRY
OMO Have a go at home competition

1. Instructions on how to enter and prizes form part of these Terms & Conditions of Entry.
2. The Promotion is open to all residents of Australia who are 5 to 12 years-old only. The entrants must be between the ages of 5 to 12 at the commencement of the promotion.
3. Employees of the Promoter, agencies or companies associated with this Promotion and their immediate families are ineligible to enter.
4. To enter, Participants are required with the supervision and assistance of a parent/legal guardian to cook or bake a dish of their choice. This can be anything and not limited to a; main, dessert or entrée. A photograph of the dish with the child 5 to 12 years-old must be uploaded to the masterchef.com.au/omohaveago website page. Photograph entries must incorporate the child and dish which may include any design elements that the entrant deems to be entertaining, creative, and original. The photograph must be submitted in a jpg, pdf or gif file format.
5. Participants must visit masterchef.com.au/omohaveago to upload their photograph in a compatible file format and enter the child’s name and date of birth. Participants may enter once a day as long as each entry comprises a different photograph and dish.
6. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
7. The Promotion will be advertised on masterchef.com.au, ten.com.au and on Network Ten during broadcasts of the program Junior MasterChef Australia. Online entry is exclusive to Ten website members only (existing and new during the Promotion Period). It is free to become a member.
8. A limit of one (1) weekly prize per person per household applies. A weekly winner can still be in the running for the major prize.
9. To register, entrants will be required to provide the Promoter with various personal details which may include full name, phone number, email address, geographic location, date of birth, gender as well as the name and date of birth of their child. Any contact details entered incorrectly shall invalidate the entry. Any incomplete or incomprehensible entries will also be deemed invalid and as such disregarded.
10. Prizes will only be provided once parental/guardian approval has been confirmed and the child’s age validated. Weekly prizes will be mailed to the attention of the parent’s of the winner. In the event that the parent/legal guardian cannot provide suitable proof of the winner’s age, name and address the prize in whole will be forfeited and no substitute will be offered.
11. Entrants acknowledge that their entry will be uploaded to the OMO Have a go competition photo gallery section of the masterchef.com.au website.

12. Entries that are or include obscene, offensive, defamatory, inappropriate, unsuitable, or infringing content as determined by the Promoter at its sole discretion will be deemed invalid, are not acceptable and not eligible to win.
13. Entries must be the entrant’s original picture with the child 5 to 12 years-old and not wholly graphically created. The Promoter reserves the right to verify the validity of entries. Entries not fully complying with these conditions of entry will be deemed invalid and are not acceptable and not eligible to win.
14. In the case where there are multiple people featured in a photograph the entrant who has submitted the photo acknowledges that he/she has received permission from all peoples in the photo to use their likeness for the purpose of this promotion and waive all rights in accordance with their terms and conditions. Only 1 child within the image can be nominated as the prize winner.
15. If the online registered member is 5 to 12 years-old and does not fill in or nominate a child then the parent’s contact details will be required when validating the prize. The prize will be delivered to the confirmed address in the parent’s name.
16. The entry period where photograph submissions will be accepted online will be between Sunday 26th September 2010 at 19:30 (EST) and Wednesday 3rd November 3rd 2010 at 23:59 (EDT).
17. All judging of eligible entrants will be undertaken by the Promoter and representatives of the OMO brand at the premises of Network Ten, 1 Saunders Street, Pyrmont, NSW 2009. All photo entries chosen by the Promoter will be displayed in the OMO Have a go competition photo gallery. The judge’s decision is final and no correspondence will be entered into.
18. This is a game of skill and chance plays no part in determining the winners.
19. All valid entries received will be eligible for the major prize. Judging for the major prize will be undertaken on Thursday 4th November 2010 at 10:00 (EDT).
20. All entrants will be judged on their creativity, originality, entertainment value, visual integration of the food and ingredients.
21. Weekly winners will be judged on the dates in TABLE A. All entries roll over to be eligible for each weekly prize and weekly winners are still eligible to be selected as a finalist for the major prize.

Thursday 4th November
22. All the winners will be confirmed by Thursday 4th November 2010.
23. Five (5) winners per week for four (4) weeks will receive:
1 x Junior MasterChef pancake kit
2 x Apron and Chef Hat Sets
Winning image to appear on air and online
Each individual prize valued at $80
Total weekly prizes valued at $1,600
24. One (1) major winner will receive:
$5,000 cash
2 x return economy flights to Sydney from nearest capital city for the recipe shoot to take place before 10 November 2010.
1 x night hotel share accommodation including breakfast
Return hotel to filming transfers
1 x year supply of liquid or powder OMO (1 case x 12 packs to be delivered at once)
Winning recipe footage filmed in Sydney to appear in a pre-recorded segment during the Junior MasterChef grand final.
Total prize valued at up to $7,000
25. Total prize pool is valued at up to $8,600
26. The cash prize is to be paid in the form of a cheque made out to the parents/legal guardian of the winner or direct deposited into their chosen bank account in the form of an electronic fund transfer (EFT).
27. All prizes are not transferable or exchangeable. Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
28. If any element of the prize becomes unavailable for any reason, which is out of the Promoters control then a similar prize to equal value, will be awarded in lieu at the discretion of the Promoter.
29. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
30. If the major winner and parent/legal guardian cannot attend the filming of their winning recipe in Sydney then they must forfeit the entire prize and a new winner will be judged at the discretion of the Promoter on a date required by the Promoter.
31. The winners will be notified by phone and in writing.
32. The major winner and their parent/legal guardian are responsible for all other expenses including spending money, meals, drinks, transfers (unless

specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, visas, travel insurance and all other ancillary costs.
33. The winner and travelling parent/legal guardian must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Melbourne, Brisbane, Adelaide or Perth). If the winner’s nearest capital city is Sydney then flights do not form part of the prize.
34. Government and airport taxes can be an additional cost to the winner and their travelling parent/legal guardian and are required to be paid at the time of booking.
35. The prize must be taken on the date stipulated by the Promoter for the filming of the recipe in Sydney before 10 November 2010 and is subject to hotel and flight availability. The prize cannot be changed once the booking has been made. Any alterations to confirmed flights and/or accommodation details will be at the expense of the winner and their parent/legal guardian.
36. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline
37. A credit card imprint or cash deposit may be required from the winner’s parent/legal guardian at check-in to the hotel, for all incidental charges.
38. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travelers.
39. The Promoter reserves the right to refuse to allow a winner and parent/legal guardian to take part in any or all aspects of the major prize, if the Promoter determines, in their absolute discretion, that a winner or parent/legal guardian is not in the mental or physical condition necessary to be able to accept the prize. It is a condition of accepting the prize that the winner and parent/legal guardian may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
40. The Promoter and their associated agencies and companies associated with this promotion will take no responsibility for prizes lost or damaged in transit.
41. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

42. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any direction given under relevant Lottery and Gaming Regulations, and relevant state permit regulations.
43. The Promoter and associates agencies accept no responsibility for any breach of contract or any infringement or other violation of copyright or any other intellectual property rights or proprietary rights through the acceptance of entries into this contest and each entrant takes full responsibility for any such claims made in relation to their entry.
44. By submitting an entry, each entrant agrees to assign all rights in the entry and any other material submitted as part of or in connection with an entry (“Material”) to the Promoter and consents to the Promoter using the entry and Material in any manner the Promoter wishes (including modifying, adapting or publishing the Entry and Material in whole or in part or not at all), by way of all media, including, without limitation, posting their entry and Material (whether in original form or a modified or adapted by the Promoter as permitted under this paragraph) on the Promoter’s website without payment to the entrant (of royalties, compensation or otherwise).
45. All entries become the property of the Promoter. The entrant hereby assigns irrevocably to the Promoter all right, title and interest (including without limitation the entire copyright, including but not only a present assignment of future copyright) to the results and proceeds of the entrant’s contribution to the Promotion including but not limited to any copyright in the entry sent to the Promoter and including but not limited to any literary, dramatic, musical or artistic work (within the meaning of the Copyright Act 1968 (Cth)) incorporated therein in which the entrant owns copyright.
46. By submitting an entry the winner and parent/guardian agrees to participate in the filming of the winning recipe in Sydney and publicity activities that may be requested by the Promoter, its associated agencies and companies, and the agencies and companies associated with this Promotion. The winner and parent/legal guardian has no right to seek any royalty, payment or other compensation from the Promoter, and the agencies and companies associated with this Promotion using their name, age and image in promotional material. Should the winning entry be from that of a minor, permission will be sought from the child's parent or legal guardian who will not unreasonably withhold consent for their child to participate in such publicity as required by the Promoter. By accepting the prize, the winner and parent/legal guardian agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

47. The Promoter and the agencies and companies associated with this Promotion will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
48. The Promoter reserves the right to request winners and parents/legal guardians to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
49. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
50. In the case of the intervention of any outside agent or event which naturally changes the result of the Promotion or prevents or hinders the planned operation of the Promotion, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, the Promoter may in its absolute discretion cancel the event and recommence the Promotion, vary or suspend the Promotion and, if determined by the Promoter at its sole discretion, from the start on the same conditions subject to the approval of the relevant State regulations.
51. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
