TERMS AND CONDITIONS OF ENTRY COVERGIRL AUSTRALIA LASHBLASTFUSION ‘WANT IT ALL? HAVE IT ALL’ COMPETITION
1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acknowledgement and acceptance of these conditions of entry. Entry is via email.
2. Entry is open to residents of Australia only. Employees of the promoter and third parties associated with this competition, and their immediate families are not eligible to enter.
3. The promotion commences on 10th September 2010 at 9.00am (AEST) and concludes on 30st October 2010 at 11.59pm (AEST).
4. Eligible participants can enter by visiting the Covergirl Australia lashblasLusion Facebook application at www.facebook.com/CovergirlAU, clicking on the “WIN IT ALL” tab, entering their personal details in the form, clicking “submit”, clicking on the “like” button in the box that says “show us some love”, clicking “submit”, entering their thoughts on wanting and having it all and clicking “submit”. 5. Entry is strictly limited to one entry per person. 6. Any costs associated with access to the entry website are the entrants responsibility and will be dependent on the internet service provider used by the entrant.
7. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.
8. This competition is a game of skill. Chance plays no part in determining the winners. All entries will be made available for public viewing and members of the public may vote for their favourite entry using the “like” button within the application. Members of the public may vote for multiple entries but may only vote for each entry once. The entry that receives the most votes or “like”s will receive the major prize.
9. In the event that there is a tie, the Promoter will judge and decide the winner in its absolute discretion.
10. Votes will be counted within 7 days after the closure of the Competition Period.
11. There are a total of forty nine (49) daily prizes. Winners will be selected by the promoter within 7 days after the closure of the Competition Period: one in respect of each day of the Competition Period, from all of the entries received from 9.00am 12/09/2010 until 11.59pm 30/10/2010 (AEST) on each relevant day of the Competition Period. The most creative valid entry submitted: one in respect of each day of the Competition Period, will win one (1) lashblasLusion mascara. Entries and prizes will not be carried over to the next day. 12. The Promoters decision is final and no correspondence will be entered into.
13. The Promoter is not responsible or liable in any manner for any content or materials posted on Facebook in relation to this competition.
14. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has tampered with the entry process, breached any of these conditions, or in the opinion of the promoter engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion or damaging to the goodwill or reputation of the promoter. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
15. All winners will be notified by telephone or email address provided within 7 days of the competition closing.
16. One (1) eligible entry that receives the highest number of votes will win the major prize, a prepaid VISA gift card valued at $5,000. The Visa Gift Card will not have the winners’ name printed on the card and the winner has no account association with Visa. The Visa Gift Card is valid for 12 months from the promoters’ date of purchase and is displayed on the card. The winners will not be able to cash out the $5,000 pre-¬‐paid Visa Gift Card, physical and virtual merchants for purchase of goods and services only. Visa Gift card is subject to ANZ Visa Gift Card terms and conditions located at http://www.prepaidshop.com.au/.
17. There are 49 daily prizes consisting of one (1) lashblasLusion mascara valued at $18.95RRP per prize to be won.
18. The total prize pool is valued at up to $5928.55. 19. If the prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute any of the prizes for a prize of equal or greater value.
20. The prizes must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of publishing these terms and conditions. The Promoter accepts no responsibility for any variation in prize value.
21. The Promoter accepts no responsibility for any tax implications that may arise from winning a prize. Independent advice should be sought.
22. The prize (and any unused portion of the prize) is not transferable, negotiable or exchangeable and cannot be taken as cash.
23. The Promoter is not liable for the cancellation or duration of all or any part of the prize for any reason. Prizes are subject to availability. The Promoter reserves the right to change a prize or any part of a prize at any time if a prize becomes unavailable.
24. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
25. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
26. Upon submijng your entry: You warrant and represent that nothing in the entry is defamatory, harassing, threatening or offensive; or encourages conduct that would amount to a criminal offence or give rise to a civil liability; and/or is otherwise an infringement of any applicable law;
27. You warrant and represent that the entry is your own original work;
24. You agree to the permanent assignment to the Promoter of all your intellectual property rights in the entry, including ‘without limitation' copyright.
28. All entrants consent that the promoter may use the entrants first name and entry submitted in any media for an unlimited period of time without remuneration for the purposes of promoting this competition (including any outcome) and promoting any products manufactured, distributed or supplied by the promoter and Covergirl.

30. Personal information is collected to enable an entrant to participate in this competition. The promoter may use or disclose an entrant’s personal information, such as name, address and other information for the conduct of the competition, marketing, and consumer research purposes. A request to update or correct any personal information should be directed to the promoter at the address shown in clause 36 below.
31. The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
32. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, to cancel, terminate, modify or suspend the promotion.
33. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
34. The promoter reserves the right to request a winner to provide proof of identity and/or residency at the nominated prize delivery address in order to claim a prize. Identification considered suitable for verification is at the discretion of the promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute or cash will be offered in lieu.
35. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
