Brumbyâs âWin Free Bread for a Yearâ Promotion
TERMS AND CONDITIONS OF ENTRY
1. Information on how to enter and prizes form part of these Conditions of Entry.
Participation in this promotion is deemed acceptance of these Conditions of
Entry.
2. Entry is only open to Australian and New Zealand residents with a current and
valid email address.
3. Employees and their immediate families of the Promoter and their agencies
associated with this promotion are ineligible to enter. Immediate family
means any of the following: spouse, ex-spouse, de-facto spouse, child or
step-child (whether natural or by adoption), parent, step-parent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister,
step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right to verify the validity of entries and entrants
(including an entrantâs identity, age and place of residence) and reserves
the right to disqualify any entrant for tampering with the entry process or for
submitting an entry, which is not in accordance with these Conditions of
Entry. Failure by the Promoter to enforce any of its rights at any stage does
not constitute a waiver of those rights.
5. To enter, consumers are required to join Brumbyâs Upper Crust Club via
www.brumbys.com.au and tell us in 60 words or less âProvide your best handy
tip that relates to breadâ through the online entry form, during the
promotional period, to be eligible. Only one (1) entry per valid email address
will be accepted.
6. Incomplete, indecipherable or illegible entries will be deemed invalid.
7. If there is a dispute as to the identity of an entrant, the entrant will be
deemed to be the person in whose name the internet account is held.
8. Promotion commences 14/10/10. Entries close at 11.59pm EDST on 22/11/10.
The winner will be drawn 26/11/10. The prize will commence from the date
the winner is notified and will end 12 months following that date. This is a
game of skill and chance plays no part in determining the winner. Each entry
will be individually judged based on literary and creative merit. The judgesâ
decision is final and no correspondence will be entered into.
9. The best entry, as determined by the judges, will receive a voucher for Free
Bread for a Year. The value is based on one standard sandwich loaf or 6 rolls
every day â total value $3.60 per day (however the winner can âmake upâ
the difference in cost of a more expensive bread i.e. a loaf that is valued at
$4.50 minus the $3.60 a day allowance would mean the winner would âmake
upâ $0.90). The competition is valid on bread products only. Total estimated
value for the year is $1,324. The bread can not be accumulated i.e. if the
winner only visits once a week they can not get 7 loaves, just one. The prize
can only be claimed from the winnerâs nominated store over the duration of
the competition.
10. In the event that the winner does not claim their prize within 3 months of the
relevant closing date then the original winner will forfeit their prize. A reserve
winner will be awarded the prize in their place in the order in which their entry
is recorded as being judged best.
11. The Winner will be notified by email and will need to confirm their delivery
address details to receive voucher to their chosen store.
12. Prizes, including any unused portion of the prizes, are not transferable or
exchangeable and cannot be taken as cash. No responsibility is accepted
for any variation in the value of the prize. No responsibility is accepted for lost
or misdirected entries.
13. If for any reason a winner does not redeem an element of the prize by the
time stipulated by the Promoter, then the prize or that element of the prize will
be forfeited.
14. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion,
reserves the right to substitute the prize (or that part of the prize) with a prize
to the equal value and/or specification.
15. In the event of war, terrorism, state of emergency or disaster, the Promoter
reserves the right to cancel, terminate, modify or suspend the promotion.
16. Except for any liability that cannot be excluded by law, the Promoter
(including its officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any
way out of the promotion, including, but not limited to, where arising out of
the following: (a) any technical difficulties or equipment malfunction
(whether or not under the Promoterâs control); (b) any theft, unauthorised
access or third party interference; (c) any entry or prize claim that is late, lost,
altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or (f) taking any of the
prizes.
17. If the winner of a prize is under the age of 18 years, the prize will be awarded
to the winner's nominated parent or guardian.
18. All literary pieces become the property of the Promoter. Entries will not be
returned to any entrant. As a condition of entering into this promotion, each
entrant licences the Promotor to use their entry in any media for an unlimited
period for any reason including but not limited to publishing the literary piece
on the Brumbyâs website and for future promotional, marketing or publicity
purposes. Each entrant warrants to the Promoter that each entry submitted is
an original literary work of the entrant that does not infringe the rights of any
third party. The entrant agrees to indemnify the Promoter against all costs
and claims by third parties arising from a breach of this warranty. Entrants
consent to any use of their entry which may otherwise infringe their moral
rights pursuant to the Copyright Act 1968 (Cth).
19. Entrants consent to the Promoter using the entrant's name, likeness, image
and/or voice in the event they are a winner (including photograph, film
and/or recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this competition (including any
outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter.
20. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law (a) to disqualify any entrant;
or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Any cost associated with accessing the promotional website is the entrantâs
responsibility and is dependent on the Internet service provider used.
22. The Promoter collects entrantsâ personal information in order to conduct the
promotion. If the information requested is not provided, the entrant may not
participate in the promotion. By entering the promotion, unless otherwise
advised, each entrant also agrees that the Promoter may use this
information, or disclose it to other organisations that may use it, in any media
for future promotional, marketing and publicity purposes, including sending
electronic messages or telephoning the entrant, for an indefinite period,
without any further reference, payment or other compensation to the
entrant. Entrantsâ personal information may be published by the Promoter. A
request to access, update or correct any information should be directed to
