Conditions of entry for APN Online audience survey to win $1,000 cash.
1. Information on how to enter and the prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of the terms and conditions.
2. Entry is only open to Queensland and New South Wales residents of Australia aged 18 years or over who fulfil the entry requirements.
3. Employees of APN Online and their respective advertising agencies, newsagents and subagents and their immediate families are ineligible to enter.
4. The promotion commences 12:01am (AEST) Monday 1st November 2010 and closes 11.59 pm (AEST) on Sunday 21st November 2010 (promotional period).
5. To enter, participants must answer the questions in the online audience survey.
6. Any form of automated electronic entry that does not meet the entry requirements will be deemed invalid and not counted as a valid entry.
7. All entry times are considered as the time the entry is received by the database at APN Online.
8. There is one prize of $1,000 cash to be won. The draw will take place at APN Online, (Australia) Pty Limited, at Milton, Queensland. The winner will be drawn at 12:00pm AEST on the Wednesday 24th November 2010.
9. The winner will be contacted by phone and email by Friday 26th November 2010.
10. All prize values are in Australian dollars. Winners must take the prize as offered.
11. The Promoter reserves the right to substitute the prize with a prize of equal or greater value if the prize is for some reason unavailable subject to gaming authority approval.
12. It is the entrant’s responsibility to advise the Promoter of any change of personal details.
13. If a prize is unclaimed, a second draw will be held at 12:00pm (AEDT) on Monday 6th December 2010 at the same place as the original draw subject to any written directions given by the relevant state lottery and gaming regulators.
14. We are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in thecompetition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
15. We are not responsible for lost, late, incomprehensible or incorrect entries in the competition. We also accept no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek Independent financial advice about such matters.
16. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event, we are entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).
17. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the competition.
18. Except for any liability that cannot be excluded by law, the Promoter and its related bodies corporate (including each of their officers, employees and agents) (the “Promoter Group”) excludes all liability (including negligence), for any personal injury or damage to property including but not limited to any loss or damage (including loss of opportunity or economic loss); whether direct, indirect, special or consequential, arising in any way out of or in connection with a Promotion or any matter contemplated by these Terms and Conditions or by reason of any act or omission, deliberate or negligent by any member of the Promoter Group, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any tax liability incurred by a winner or entrant; or (e) use of any prize; (e) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the internet or at any website; (f) unauthorised human intervention in any part of a Promotion; and (g) any electronic or human error which may occur in the administration of a Promotion.

For the avoidance of doubt the Promoter Group will not be liable for personal injury suffered due to or in connection with the receipt of or utilisation of a Prize offered or provided under a Promotion. The winning entrant, and his or her guests (if any), must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner. In the event of a promoter other than APN Online cancelling any event related to this prize, APN Online cannot be held responsible.
