News Limited Emirates & APT Escape Promotion From: The Sunday Mail

1.STANDARD TERMS

1.1Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

2.WHO CAN ENTER?

2.1Subject to clause 2.2, entry is open to all residents of NSW/ACT, VIC, QLD, SA & WA.

2.2Employees and their immediate families of News Limited, Emirates, APT and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.


2.3Entrants must be aged 18 years and over.

3.HOW TO ENTER

3.1The competition commences on Sunday October 31 at 00.01am (AEDST) and concludes on Sunday November 7 2010 at 23:59pm (AEDST) ("the Competition Period").

3.2To enter the competition, readers must send an SMS message to the competition phone number 199 88 700, as it appears in the Escape section of either; The Sunday Telegraph (NSW/ACT), the Sunday Herald Sun (VIC), The Sunday Mail (QLD), the Sunday Mail (SA) or The Sunday Times (WA) on Sunday October 31 2010 & Sunday November 7 2010. Entrants must supply their name and state.

3.3The SMS entry mechanic is only open to readers with an SMS compatible mobile phone, connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

3.4 Entrants (including winners) in the competition may enter as many times as they like, however only one prize per person will be awarded. SMS entries via internet or computer generation are invalid and will not be accepted.

3.5 Each SMS entry will be charged at a premium rate, namely $0.55 (including GST), which covers the entry and reply message.

3.6 The time of entry will, in each case, be the time that the SMS is received by Salmat Interactive.

3.7 The Promoter, its agents, affiliates or representatives will not be liable for any late, lost or misdirected entries.

4HOW TO WIN

4.1Entrants who have registered all details in accordance with clauses 2 and 3 will be entered into the prize draw. The draw will take place at Salmat Interactive, Level 1, , 116 Miller Street, North Sydney NSW 2060 on Monday November 8 2010 at 10:00 (AESDT).

4.2ONE (1) major prize winners PER STATE will be randomly selected from all valid entries (per state) received during the competition period. Total of FIVE (5) winners nationally.

4.3The prize winners will be notified by phone call and writing within two (2) days of the draw and their names published in the Public Notices Section of their corresponding News Limited state masthead: The Sunday Telegraph (NSW/ACT), the Sunday Herald Sun (VIC), the Sunday Mail (SA) or The Sunday Times (WA) and at www.thesundaymail.com.au/competitions for The Sunday Mail (QLD) on Wednesday November 17 2010.

4.4The Promoter's decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.

4.5It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

4.6Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.

4.7The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

4.8The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.

4.9An unclaimed prize draw will take place at Salmat Interactive Level 1, 116 Miller Street,, North Sydney NSW 2060 on Thursday November 18 2010 at 10:00 (AEDT) and the winners will be notified in writing and by phone and will be published on the News Limited's state masthead: The Sunday Telegraph (NSW/ACT), the Sunday Herald Sun (VIC), The Sunday Mail (QLD), the Sunday Mail (SA) or The Sunday Times (WA) on Wednesday November 24 2010.

5.PRIZE

One (1) x prize winner will be selected from each participating entries received (NSW/ACT, VIC, QLD, SA & WA - total of five (5) winners nationally):

The prize winner will receive the following:

"Two (2) Return economy flights to either Amsterdam or Prague (winner to select destination), departing from the winner's nearest capital city airport

"Three (3) 3 nights' accommodation in a twin share (or double basis) in the prize-winners choice of - Amsterdam or Prague. First class standard hotel, including return airport/hotel/airport transfers and breakfast daily.

"SA winners only will receive a domestic flight at the discretion of Emirates from their local domestic airport to Melbourne or Sydney. This flight will be booked on the same day as their major prize flight to either Amsterdam or Prague as there are no direct flights available from SA to Amsterdam or Prague for major prize fulfilment.

Two (2) return economy flights valued at $6,000.00 per winner, per participating state.

Accommodation for two (2) people - three (3) nights in either Amsterdam or Prague: $2580.00 per winner

Total prize value per winner$8,580.00

Total prize pool nationally (5 states)$42,900.00


5.2Other than as specified above the prize does not include any other transfer costs, insurance, spending money, meals, transfers to and from departure point, taxes or any other ancillary costs or use of any facilities requiring the payment of any fee unless expressly stated above.

5.3The winner must be available to travel prior to November 2011 (at the direction of the winner, but subject to flight and accommodation availabilities) and are responsible for ensuring that they have all appropriate travel documentations, including but not limited to a valid passport. No changes are permitted to travel arrangements once tickets are issued.

5.4Prizes cannot be transferred, exchanged or redeemed for cash. In the event that a winner does not take the prize as offered at the time stipulated, then the prize will be forfeited and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. Flights and accommodation must be used together and to the same destination. Hotel and flight details at the discretion of the promoters.

5.5The winner must, on request by the Promoters, be able to provide evidence which, to the reasonable satisfaction of the Promoters, demonstrates that the winner is an eligible entrant (as per clauses 2.1 and 2.2) and has complied with these terms and conditions.

5.6Any taxes (other than GST, if any) which may be payable as a consequence of the winner receiving this prize are the sole responsibility of the winner.

5.7In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winners grant the Promoters a perpetual and non-exclusive licence to use such footage and photographs and the content of the entry in all media world wide and the winners (and their companions) will not be entitled to any fee for such use.

5.8The entrant consents to any act or omission of the Promoters regarding the use of the entry which might otherwise constitute an infringement of the entrant's moral rights granted by the Copyright Act 1968.

5.9The winners agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

6.NO LIABILITY

6.1The Promoters shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with this promotion and any prize/s except for any liability which cannot be excluded by law. Neither are the Promoters responsible for any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries.

6.2If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoters which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoters reserve the right, in their sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.

6.3Except for any liability that cannot be excluded by law, the Promoters (including its officers, employees and agents) exclude all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:

a) any technical difficulties or equipment malfunction (whether or not under the Promoters' control);

b) any theft, unauthorised access or third party interference;

c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters;

d) any variation in prize value to that stated in these conditions of entry;

e) any tax liability incurred by a winner or entrant;

f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or

g) participation in the prize.

6.4 The prize winner indemnifies the Promoters in respect of any infringement or alleged infringement of the intellectual property rights (including copyright ) of any person, arising out of the Promoters use of the entry.

6.5The Promoters reserve the right, in their sole discretion, to disqualify any individual who the Promoters have reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoters' legal rights to recover damages or other compensation from such an offender are reserved.

7.PRIVACY CONSENT

7.1The Promoters of this competition collect your personal information to conduct the promotion and to assist us in providing the goods or services you have requested, to process your competition entries and to improve our products and services. We or any of our Australian related companies may be in touch by any means (including email or SMS) at any time to let you know about goods, services or promotions which may be of interest to you. We may also share your information with other persons or entities who assist us in providing our services, running competitions (including administering the competition or distributing prizes) or with other companies who provide prizes for competitions or reader offers. We may also disclose your personal information in accordance with these terms and conditions if you are a prize winner or finalist.
