General conditions for the competition “Best of Community“

1. Terms and conditions
1.1 This document sets out the terms and conditions of participation (Terms) in the Best of Community competition (Competition).
1.2 The promoter of the Competition is Thermomix in Australia Pty Ltd ACN 069 944 930 of Suite 3, 5 Stretton Place, Balcatta, Western Australia (Thermomix in Australia or we or our).
1.3 All relevant instructions on Thermomix in Australia’s website at www.recipecommunity.com.au form part of these Terms.
1.4 Each entry must be entered in accordance with these Terms.
1.5 By entering the Competition, each entrant agrees to be bound by these Terms.
1.6 Thermomix in Australia may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms.

2. Organising and Object of the competition
The competition is organised by Vorwerk International Mittelsten Scheid & Co (Vorwerk) and the object of the Competition is to select the best recipes of the recipe community (www.recipecommunity.com.au) for the creation of an international cookbook, edited by Vorwerk.

3. Duration of the Competition
The Competition will take place from 3.00pm AWST on 15th December 2010 and closes at 5.00pm AWST on 15th January 2011 (Competition Period). Any entry received after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries. Prize winners will be notified in April 2011.

4. Participating in the competition
4.1 Entry into the Competition is free and is limited to residents of Australia and New Zealand only. Employees and immediate family of Thermomix in Australia and New Zealand and their agencies associated with this promotion are ineligible to enter the Competition.
4.2 An entrant must be:
(a) a Registered User;
(b) an individual;
(c) older than 18 years;
(d) resident in Australia or New Zealand; and
(e) willing to provide that person’s name, email address, telephone number, profile picture, and profile name (Profile Information).
4.3 The required Profile Information must be truthful.
4.4 We reserve the right to eliminate a participant which we reasonably consider has not provided us with truthful Profile Information.

5. Mechanics of participation
5.1 To enter the Competition you must submit a Valid Recipe in accordance with clause 7 of these Terms accompanied by your name, address, email address and telephone number to Thermomix in Australia via the Website (Submission).
5.2 While you may enter the Competition more than once, you cannot win more than one prize.
5.3 Submissions not completed in accordance with these Terms or received after the closing date will not be considered valid and will not be included in the judging.
5.4 Upon receipt of Submissions, they become the property of Thermomix in Australia and will not be returned to the entrants.

6. Submissions
6.1 All Submissions become the property of Thermomix in Australia.
6.2 The collection, use and disclosure of personal information provided in connection with this Competition are governed by the Privacy Policy. A copy of the Privacy Policy is available at www.recipecommunity.com.au.
6.3 For each Submission, you grant Vorwerk and Thermomix in Australia and its licensees and assignees a royalty-free, non-exclusive licence to exercise all rights in perpetuity throughout the world in your Submission and all other material provided by you to Thermomix in Australia pursuant to this Competition at any time.
6.4 Without limiting the rights granted to Vorwerk and Thermomix in Australia under clause 6.3, you acknowledge that we may exercise any of the following non-exclusive rights throughout the world:
(a) the right to publish your Submission in whole or in part in any electronic or print format; and
(b) the right to provide a free download of your Submission from the Website.
6.5 You acknowledge that we may allow users to view, reproduce, download and otherwise deal in the copyright rights attached to and embodied in your Submission. We aim to ensure that any use of your Submission not authorised by Thermomix in Australia will not occur, however you acknowledge that we are not equipped with mechanisms to prevent unauthorised use of your Submission, and you accept that, to the extent allowable under the law, we have no liability to you for how the end user elects to use your Submission, and as such it may be permanently stored, reproduced, copied, distributed or the like, without recourse or remedy against Thermomix in Australia.
6.6 We reserve the right to edit or adapt your Submission including without limitation to change the recipe title, wording, process or ingredients of a Submission for publishing the cookbook (or any other media).
6.7 You agree that we may use any part or all of your Submission for any promotional, marketing and publicity purposes of Thermomix in Australia in any media without notice and without any fee being paid to you.
6.8 You warrant that:
(a) all details provided with your Submission are true and accurate;
(b) you have all necessary rights and licenses to grant the rights set out in these Terms;
(c) your Submission (and any photographs provided) is your original work and you are the copyright owner or authorised licensor of all copyright works and subject matter comprising your Submission;
(d) your Submission has not been previously published or communicated to the public
(e) the exercise of the rights granted to Vorwerk and Thermomix in Australia in these Terms will not infringe the rights of any third parties; and
(f) you indemnify Vorwerk and Thermomix in Australia against any loss or damage resulting from any breach of these warranties.

7. Requirements of a Valid Recipe To be a Valid Recipe, the Submission must:
(a) have been tested with the Thermomix TM31(Thermomix);
(b) ensure that the Thermomix is a necessary appliance for the success of the recipe. Submission requiring complementary methods to the Thermomix such as an oven, plate, frying pan etc are also acceptable provided that the Thermomix is necessary for performing the recipe;
(c) include a photograph of the recipe’s completed product;
(d) be original;
(e) not have previously been published by Thermomix in Australia or its affiliates in any media including but not limited to a cookbook, a magazine or the Website.
(f) be well written and include as a minimum, the name of the recipe, the measured ingredients listed in order of use, step-by-step preparation and cooking directions (with specific references to features and settings used by the Thermomix) and the number of servings created by the recipe.
(g) Recipes and photos cannot be changed after the initial entry into the competition. Only the original recipe and photo will be eligible for entry.
(h) Thermomix and Vorwerk reserve the right to change the recipe title, wording, process or ingredients for the publication of the cookbook (or other media)

8. Selection of Valid Recipes
8.1 Valid Recipes will be placed in a variety of categories depending on the type of dish (Category).
8.2 Registered Users will vote on Valid Recipes.
8.3 The 30 Valid Recipes with the highest number of votes (Voted Recipes) will be tested by the food development department of Thermomix in Australia . Recipes must receive a minimum ranking of 3 stars to be eligible to proceed to the next round. In the case of a tie, the following criteria will be used by Thermomix to select the recipe to go forward:
• Number of total ratings per recipe
• Number of downloads and views per recipe
• Number of send outs to Facebook and Twitter.
8.4 The Food development department will select 20 of the top performing Voted Recipes and present them to an international jury (Jury) for consideration (Selected Recipes). The jury is entrusted with the final selection of the 10 winners.
8.5 The Jury will select the winners of each Category from the Ranked Recipes according to the below table (Winning Recipes).

Side dishes, sauces, dips and spreads    2
Desserts, sweet baked goods and drinks    3
8.6 The Winning Recipes will be determined solely by the Jury and chance plays no part in this Competition.
8.7 Decisions of Thermomix in Australia and the Jury are final and will be binding on each person who enters the Competition and no correspondence will be entered into nor is there a right of appeal.

9. Prizes
9.1 There are 10 prize packs consisting of a Thermomix Tm 31 Carry Bag (blue), three international Thermomix cookbooks (‘Full Steam Ahead’, ‘My Way of Cooking’, and ‘Travelling with Thermomix’) and 10 ‘Best of Community’ cookbooks.
The entrants whose recipes were determined by the Jury as Winning Recipes will win the Prizes (Prize Winners).
9.2 If there is any event that prevents or hinders Thermomix in Australia’s conduct of the Competition or its ability to deliver any or all of the Prizes to any or all of the Prize Winners, Thermomix in Australia may, in its absolute discretion, cancel the Competition and may, in its absolute discretion, recommence it at another time under the same conditions or select alternative finalists and winners.
9.3 No component of the Prizes can be transferred or redeemed for cash. In the event that any of the Prizes become unavailable, we reserve the right to provide a similar product to a similar or greater value as the original Prizes, subject to any applicable laws or written directions made under applicable legislation.

10. Description, communication and handing out of the prize
10.1 Each Prize Winner will be contacted in April 2011 via that person’s email address.
10.2 Once a Prize Winner has received notice of being a Prize Winner, that Prize Winner has 7 working days in which to accept the Prize. Before the relevant Prize will be delivered to the Prize Winner, the Prize Winner must deliver a high resolution profile picture to Thermomix in Australia with the right to assign full property rights to Thermomix in Australia and Vorwerk.
10.3 We reserve the right to publish the Prize Winner’s name in the cookbook “Best of community”, a magazine, the Website or other web pages or other online and offline media.

11. Limitation of liability
11.1 We are not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical or human error that may occur in the course of the administration of this Competition.
11.2 We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of Submissions.
11.3 To the full extent permitted by the law, we will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the Competition or accepting or using any Prize, including without limitation non-receipt of any Prize or damage to any Prize in transit.
