2.Promotion commences at 12.01 am (AEST) on 01 October 2010 and entries close at 11.59 pm (AEDST) on 31 December 2010 (Promotion Period).
3.Entry is open to Australian residents only. Employees (and their immediate families) of the Promoter, or agencies or companies associated with this Promotion, are ineligible to enter. Entrants under 18 years of age must have parental/guardian approval to enter and the parent/guardian of the entrant must read and consent to all of the Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of their consent to their minor entering this Promotion.
How to enter
4.To enter the Promotion, you must during the Promotion Period:

There is a limit of five entries per household per day and only one entry may be made per Promotion Product purchased. There is a limit of one Minor Prize per entrant. Unrecognised Product Barcodes and original purchase receipts will not be accepted. Errors and omissions may be accepted at the Promoter's absolute discretion.6.Entrants are responsible for the costs associated with accessing the website via an Internet Service Provider. 7.Each valid SMS entry into the Promotion must be contained in a single SMS from a mobile telephone connected to an Australian based mobile network with premium SMS (being any one of the Telstra, Vodafone, Virgin or Optus mobile digital networks or a participating service provider which has SMS compatible mobile digital phones). 8.Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant.
9.The mobile phone number from which the entrant sends the SMS entry must be owned by the entrant. The Promoter may require a winner to validate their entry by showing proof of ownership of the mobile telephone number. The only acceptable proof of ownership will be an original invoice in the name of the entrant or an original letter on the service provider's letterhead confirming the entrant's ownership. If an entrant is unable to provide proof of ownership of the mobile telephone number within 14 days of request by the Promoter, the entry will be treated as void and the Prize will be treated as an unclaimed Prize.
10.Original purchase receipts and/or original product barcodes must be kept for all entries as proof of purchase, and will be required to validate any entries made (see clause 21 below).Prizes
11.There is one (1) Major Prize to be won. The Major Prize (Major Prize)is a trip for the winner and one nominated companion to Carnivale in Brazil consisting of:
•Return business class airfares for two (2) people with an airline of the Promoter's choice, departing from the winner's nearest Australian capital city to Rio de Janeiro (return trip via Iguazu Falls);
•Nine (9) nights standard double accommodation for two (2) people at the Windsor Excelsior Hotel (including daily breakfast);
•A half day tour for two (2) people to the Sambadromo Parade (plus return transfers for two (2) people to and from the hotel);
•Grand Stand tickets for two (2) people to the Sambadromo Parade (plus return transfers for two (2) people to and from the hotel);
•Tickets for two (2) people to a local soccer match;
•One (1) night's superior double accommodation for two (2) people at the Hotel das Cataratas (including daily breakfast);
•A half day tour for two (2) people to the Brazilian side of Iguazu Falls;
•Private return transfers for two (2) people for all trips between airports and hotels;
•AUD $10,000 spending money;
•14 days of travel insurance cover for two (2) people with a travel insurance provider of the Promoter's choice at an insurance coverage level of the Promoter's choice;
•All visa processing fees charged by the Embassy of Brazil in relation to visa applications for the winner and their nominated companion.
12.The Major Prize is valued at up to $40,000 (incl GST), depending upon the winners point of departure and the currency exchange rates at the time of booking the Major Prize. The prize is subject to booking and availability of flights, accommodation and activities awarded as part of the Major Prize. The Major Prize must be taken on 1 March 2011 – 10 March 2011 or 13 February 2012 – 23 February 2012. All persons taking the trip must depart and return together. No extensions will be permitted. Any alterations to confirmed flight details will be at the expense of the winner. 13.All other costs associated with the Major Prize that are not specified, including but not limited to any meals, additional transfer costs, taxes, additional spending money, additional insurance and other ancillary costs are the responsibility of the winner and his or her nominated companion (including any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed). The winner and their nominated companion are responsible for ensuring that they have all necessary documents to travel to Brazil, including a current passport and any visas (excluding visa processing fees) that may be required. Any person taking the Major Prize that is aged under 18 years at the date of taking the prize must be accompanied by their parent or guardian.
14.There will be 50 minor prizes to be won instantly. Each minor prize is $1,000 cash, to be awarded in the form of a cheque made out to the winner (Minor Prize). Total Minor Prize pool is $50,000.
15.Total Prize pool is valued at up to $90,000 (incl. GST). 16.The value of the Prizes is accurate at the date of commencement of the Promotion Period. The Promoter accepts no responsibility for any variation in the value of the Prize after that date. The Prizes cannot be transferred or exchanged or, in the case of the Major Prize, redeemed for cash. Where a Prize is unavailable, the Promoter retains the right to substitute the Prize with a Prize of equal or greater value, subject to the directions of any relevant gaming authorities.
How winners are determined
17.The Major Prize draw will be conducted on 7 January 2011 at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne, Victoria 3207, at 12:00 midday (AEDST). The first valid entry randomly drawn will win the Major Prize.
18.For Minor Prizes, the Promoter will randomly determine 50 winning times during the Promotion Period (Winning Time). A Minor Prize will be awarded to the first valid entry received at or after a particular Winning Time.
19.Winners of Minor Prizes remain eligible to win the Major Prize.
Notification of winners
20.The provisional winner of the Major Prize will be notified by telephone and mail. If the winner of the Major Prize entered the Promotion via SMS Entry, the winner must provide the Promoter with the winner's address when contacted via telephone by the Promoter to enable the Promoter to notify the winner in writing.
21.All provisional winners of a Minor Prize will be notified immediately by return SMS (for SMS Entries) or via a website Pop Up (for Online Entries). Provisional winners of a Minor Prize will be subsequently notified by telephone and mail. If the winner of a Minor Prize entered the Promotion via SMS Entry, they must provide the Promoter with their address when contacted via telephone to enable the Promoter to notify the winner in writing.
22.Provisional winners will be required to validate their entry by sending the Promoter their original purchase receipts and /or original Product Barcodes for their winning entries as proof of purchase within 7 days of request to a reply paid address. If a provisional winner does not provide their Original Purchase Receipts and/or Original Product Barcodes upon request within 7 days, their entry will be deemed invalid.
23.The names of all winners will be published in The Australian Newspaper on 14 January 2011.
Unclaimed Prize Draw
24.The Promoter may conduct an unclaimed Prize draw at 12.00 pm (AEDST) on 7 April 2011 at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne, Victoria 3207 if the provisional winner of a Prize cannot be contacted or if the entry has been deemed invalid pursuant to clause 5, 22 and/or 29 (Unclaimed Prize), subject to any directions given by any of the relevant gaming authority. All valid entries received during the Promotion Period (other than those relating to a winner whose entry or entries are deemed invalid by National Foods in accordance with these Conditions, including without limitation, a winner who is not entitled to a Prize as a result of clauses 5, 21 and 28) will be eligible to win any Unclaimed Prize. The first valid entry randomly drawn for each Unclaimed Prize will win that Prize.
25.All winners of an Unclaimed Prize will be notified by telephone and mail. If the winner of the Unclaimed Prize entered the Promotion via SMS Entry, the winner of the Unclaimed Prize draw must provide the Promoter with the winner's address when contacted via telephone to enable the Promoter to notify the winner in writing.
26.The winner/s of any Unclaimed Prize will be published in The Australian on 14 April 2011.
General Conditions
27.The Promoter's decision is final, and no correspondence will be entered into.
28.All entries are deemed to be received by the Promoter at the time of receipt into the Promoter's database and not at the time of transmission by the entrant. SMS entries from a mobile telephone not connected to an Australian based network with premium SMS are not valid and will not be accepted.
29.The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, including but not limited to, by using techniques designed to avoid payment of call costs or by using techniques designed to avoid purchasing the Promotion Products by making a Prize claim with stolen, forged, mutilated or tampered with Promotion Products or Product Barcodes, or who submits an entry that is not in accordance with these Conditions. Any such entrant will have all their entries deemed invalid.
30.Unless otherwise due to fraud or ineligibility under these Conditions, all Prize claims in excess of the advertised total Prize pool will be honoured. Printing errors or other quality control matters outside of the control of individual entrants shall not be used as the sole basis for refusing to award the Prize.
31.The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
32.If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its absolute discretion to modify the terms of the Promotion including the Prizes and these Conditions, subject to approval of any relevant gaming authority.
33.If a Prize is won by a person under the age of 18, the Prize will be awarded to the winner's parent or guardian on their behalf.
34.Any tax liability arising as a result of accepting any Prize is the responsibility of the winner.
35.Except for any liability which cannot be excluded by law the Promoter:
1.is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person's property related to or resulting from participation in this Promotion;
2.accepts no responsibility for any incorrect or inaccurate information, either caused by users or by any of the equipment or programming associated with or utilised in connection with this Promotion, or by any technical error that may occur in the course of this Promotion, including (but not limited to) any failure of the computer system or other equipment to determine winners in accordance with these Conditions; and
3.accepts no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries or entrants details.
36.The Promoter and its associated companies and agencies will not be liable for, and by receiving, taking or using any Prize each winning entrant is deemed to release the Promoter and its associated companies and agencies from, any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or any personal injury suffered or sustained as a result of receiving, taking or using any Prize except for any liability which cannot be excluded by law. The Promoter holds the benefit of this clause on its own behalf and as trustee for its associated companies and agencies.
37.All claims and entries become the property of the Promoter.
38.By entering this Promotion, each entrant consents to the Promoter using the entrant's personal information to administer the Promotion and announce the winner and disclosing the entrant's personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). By entering into this Promotion, each entrant also consents to their personal information being used by the Promoter for future marketing and promotional purposes (other than marketing or promoting via email). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). Entrants can access and correct the personal information the Promoter holds about them by contacting the Promoter on 1800 677 852. The Promoter's full privacy policy is available on request.
