HOW TO ENTER
To enter, visit the Moxie Facebook page, ‘Like’ the page and click on the ‘Win!’ tab which will redirect you through to
www.beautifuldayinhell.com.au. Then upload your photo that best depicts your idea of a ‘beautiful day in hell’. This may be a photo you have taken in the past or a photo taken specifically for the competition. Your idea must be original and must not infringe any copyrights or the rights of any third parties nationally or internationally. Each entry must feature only one (1) entrant’s name who is eligible to win. Website viewers then vote on images to determine which ones they like most. A minimum of 5 votes is required to be eligible for the Major Prize (The Judges Pick). The photo entry that gains the most votes from the public will win the Minor prize (The Peoples Pick). In the event of more than one entrant attaining an equal number of votes, the Judges will cast votes to decide the final winner.
CONDITIONS OF ENTRY
1.Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.This is a game of skill and chance plays no part in the outcome of the winning entry.
3.Entry is open to all Australian residents, male and female, aged 18 years and over as at 27th October 2010. Employees of the Promoter, the Promoter’s agencies associated with this promotion and their immediate families are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4.The winners friend chosen to share the prize must be aged 18 years or over as at 21st November 2010.
5.All entrants must ensure there are no corporate logos or references of any kind in their entries with the exception of the Moxie logo. This includes the wearing or displaying of corporate logos.
6.By entering the competition, entrants warrant and confirm that they grant (or waive as applicable) and have obtained all necessary rights, licenses, consents and permissions from all persons whose images are reproduced in the photo(s). If any such consents, permissions or any clearances have not been properly and legally obtained, then the entrant, upon submitting the photo(s) agrees to indemnify and keep Millie & More Pty Ltd, its agents and contractors fully indemnified against any claim, damage, loss (whether foreseeable or not), liability or cost including reasonable legal fees arising out of any failure to obtain such consents.
7.Entrants guarantee on submission that the contents of the photo(s) will not be obscene or defamatory.
8.In the event of entries being similar or the same in concept, the first entry received will be the one considered eligible.
9.Multiple entries will be accepted as long as each entry is original and different in concept.
10.By entering, the entrant or entrants agree that entry materials may be used by Millie & More Pty Ltd for any promotional purposes. This may include but is not exclusive to placing your entry on the

11.By entering you take full responsibility of the originality of your entry and absolve Millie & More Pty Ltd from any claim, dispute or legal action by any third parties.
12.Promotion commences at 9am (AEDT) on Wednesday 27th October 2010 and last entries must be received before 11.59pm (AEDT) on Sunday 21st November 2010. The winner will be decided no later than 12 noon (AEDT) on Wednesday 24th November 2010 and the winner announced at 12 noon (AEDT) on Friday 26th November 2010.
13.The Promoter’s decision on the winners is final and no correspondence will be entered into. The prize winners will be notified by email and telephone within 2 days of the decision and their names published on the
www.beautifuldayinhell.com.au and
www.moxie.com.au website.
14.Total Prize pool is valued up to $8020
15.Prize value is inclusive of GST and is in Australian dollars.
16.Total number of prizes to be won is two (2). (The major prize or known as the ‘Judges Pick’ and the minor prize or known as the ‘Peoples Pick’).

The Major Prize (Judges Pick) – Value up to: $6520 consists of: One night’s accommodation in the winners nearest capital city. Accommodation will have a 4 or 5 star rating with breakfast included (Value $500). A personal session with a stylist and shopping trip (Value $700). Driver pick up to and from the hotel to shopping centre as part of the private session with stylist, to and from the day spa treatment and to and from the restaurant for dinner as part of the package. $1000 spending money each for you and your guest (Value $2000). One (1) Panasonic digital camera (Value $250). Two (2) years supply of Moxie product (Value $1000). One (1) dinner with set menus at an established restaurant (Value $300). Two (2) Moxie Sleepover packs (Value $250). A day spa treatment for both the winner and guest (Value $500). Two (2) pairs of Karen Neilsen Vintage Collection bathers (Value $520).
18.The Minor Prize (People Pick) – Value up to: $1500 and will be awarded to the entry that receives the most votes from viewers of the www.beautifuldayinhell.com.au website. Prize consists of a $1000 in the form of a gift card (Value $1000). One (1) years supply of Moxie products (Value $500).
19.For the Minor Prize, in the event that more than one entry receives an equal amount of votes, the Judges will cast their votes to declare the final winner. 20.The Judges decision is final and no correspondence will be entered into.
21.The Minor Prize must be claimed by 5pm (AEDT) Monday 6th December 2010.
22.Once claimed, a signed release must be received by 5pm (AEDT) Friday 24th December 2010.
23.The Minor Prize must be accepted/delivered by 5pm (AEDT) Monday 10th January 2011.
24.The Major Prize (Judges Pick) and the Minor Prize (Peoples Pick) are not transferable. In no circumstances are either prize’s exchangeable for cash.
25.Millie and More are not liable for any expenses incurred during their stay at the accommodation provider except the prize details included in Point 15. These include but are not exclusive to room service, mini bar contents, damages to the room or hotel.
26.The Major Prize must be claimed no later than 5pm (AEDT) Monday 6th December 2010 and must be redeemed between Monday 10th January 2011 and Monday 14th March 2011.
27.Once claimed, a separate participant signed release and signed copy of the terms and conditions from both you and your guest must be received no later than 5pm (AEDT) Friday 24th December 2010.
28.The Major Prize winner and guest will both need to provide Millie & More Pty Ltd with proof of ID and Millie & More Pty Ltd has sole discretion of what form of ID is accepted.
29.The Major Prize winner will need to provide Millie & More Pty Ltd with credit card details for the purpose of accommodation security and will be charged if any expenses such as outlined in point 22.
30.The Promoter reserves the right to verify the validity of entries, at any time during or after the promotion, and reserves the right to disqualify any entrant (and ALL entries submitted by that entrant) for submitting an entry which is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
31.Cost of accessing the Internet is the entrant’s responsibility. Any costs associated with accessing the promotional website are the entrant’s responsibility and are dependent on the internet service provider used. Any contact details entered incorrectly shall invalidate the entry. The Promoter is not responsible for receipt of incomplete or incomprehensible entries. All such inaccurate entries will be deemed invalid. No responsibility is accepted for late, lost or misdirected entries. Any entry that does not comply with these Terms and Conditions will be invalid.
32.Every effort will be made to contact the winner by telephone and email but the Promoter may nominate another winner if the first winner does not respond to telephone calls or emails by 5pm (AEDT) Monday 6th December 2010.
33.In this event, the runner up will be announced Wednesday 8th December at 12 noon (AEDT). The new winner will be contacted by telephone and email by 5pm (AEDT) Friday 10th December 2010.
34.The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the prize winnings. Independent financial advice should be sought.
35.In the event that a prize is not available despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute a prize of equal recommended retail value, subject to any written directions from a relevant Regulatory Authority.
36.In the event that any component of the prize is not able to be accepted by the Prize winner, the Promoter reserves the right to substitute the prize with the equivalent value in cash, subject to any written directions from a relevant Regulatory Authority and at the absolute discretion of the Promoter.
37.The Promoter accepts no responsibility for any variation in the prize value.
38.The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or any personal injury suffered or sustained in connection with taking the prize, except for any liability which cannot be excluded by law.
39.It is a condition of entry that the winner may be required to execute a Deed of Acknowledgement, Release and Indemnity in a form prescribed by the Promoter in its discretion.
40.In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from a relevant Regulatory Authority.
41.The Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s computer related to or resulting from participating in or downloading any materials in the promotion. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a relevant Regulatory Authority, to cancel, terminate, modify or suspend the promotion.
42.All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS Short Message Service), MMS (Multimedia Message Service), IM (Internet Messaging) and email or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
