1. Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the Sleeping Bags for Sleepovers Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
2. The Promotion commences 27 September 2010 at 10:00am AEST and closes 5 December 2010 at 11.59pm AEST (Promotion Period).

4. To enter (Entry) the entrant must:

3. complete all the information requested for Entry into the Promotion including personal contact information;

11. The names of all the winners of Sleeping Bag Sets will be published in the Australian on 14 December 2010.
The prizes (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The prizes must be taken as offered and cannot be varied by a winner. The Promoter retains the right to substitute the prizes with a prize or prizes of equal or greater value (including where a prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
12. The Promoter may conduct such further draws as are necessary for an unclaimed prize at Kimberly Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 on 8 March 2011 at 10.00am AEST, subject however to any directions given by any applicable gaming authorities. 13. The Promoter and its associated agencies or companies accept no responsibility for any lost, late, stolen, damaged or misdirected Entry.

15. All tax liability arising as a result of accepting any prize is the responsibility of the winner.
16. (3) Kimberly-Clark, its directors, employees and suppliers, do not warrant that your access to the Site or Forum will be uninterrupted or that the Site or the Forum will operate error free, that any defects will be corrected or that this Site or the Forum and their servers are free of computer viruses and other harmful data, code, components or other material;
(4) Kimberly-Clark, its directors, employees and suppliers, do not warrant that they will be able to prevent any illegal, harmful or inappropriate use, modification or alteration of the Site or the Forum, or that they will give notice of such use, modification or alteration;
(5) Kimberly-Clark, its directors, employees and suppliers, do not warrant or make any representations about the correctness, accuracy, timeliness, completeness, reliability, quality or otherwise of the Content. The use of the Site, the Forum and the Content is at your own risk. Changes are periodically made to the Site, the Forum and Content and may be made at any time without notice; and
(6) If your use of the Site, the Forum or the Content results in the need for servicing or replacing equipment or data, Kimberly-Clark, its directors, employees and distributors are not responsible for those costs.
25. If a jurisdiction does not allow the exclusion of implied warranties in accordance with clause 25 but allows limitations of a certain maximum extent then Kimberly-Clark limits its warranties to that extent.
Limitation of Liability
26. Except as provided by the Prescribed Terms, Kimberly-Clark shall not be liable for any indirect, incidental, special and/or consequential damages including but not limited to loss of profits arising out of your access to, or inability to access, this Site or your use of, or reliance upon, this Site or the Content (including the User-Generated Content) hereof. In addition, Kimberly-Clark has no duty to update this Site or the Content hereof and Kimberly-Clark shall not be liable for any failure to update such information.
27. To the maximum extent permitted by law Kimberly-Clark's liability for breach of any Prescribed Term is limited at the option of Kimberly-Clark to the following:
(1) in the case of services supplied or offered by Kimberly-Clark:
(a) the supply of the services again; or
(b) the payment of the cost of having services supplied again,
(2) in the case of goods supplied or offered by Kimberly-Clark:
(a) the replacement of the goods; or
(b) the supply of equivalent goods; or
(c) the payment of the cost of replacing the goods or acquiring equivalent goods.
28. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with paragraph 28 but allows a limitation of a certain maximum extent then liability is limited to that extent.

29. The Site may contain hyperlinks and other pointers to internet websites operated by third parties ("Linked Sites"). Any links are provided for convenience only. Kimberly-Clark is not responsible for and makes no representations concerning the condition and content of, or products offered at any Linked Site. A link does not indicate, expressly or impliedly, that Kimberly-Clark endorses the Linked Site or the products or services offered there. Your access to any Linked Site and use of any products and services offered there is at your own risk.
30. The Site may also contain third party advertisements (that may or may not contain embedded hyperlinks or referral buttons to Linked Sites). The display of such advertising does not in any way imply an endorsement or recommendation by Kimberly-Clark of the relevant advertiser, its products or services or any such Linked Site. You are referred to the relevant advertiser for all information regarding the advertiser and its products and/or services. To the extent permitted by law Kimberly Clark accepts no responsibility for any interaction between you and the relevant third party and is released from any liability arising out of or in any way connected with such interaction.
Breach and Termination
31. Kimberly-Clark may suspend your membership or restrict your access to the Site if you do not comply with these Terms and Conditions. If deemed necessary by Kimberly-Clark, you may be reported to the appropriate authorities.
32. Kimberly-Clark may terminate these Terms and Conditions and your access to the Site, Forum and Content at any time without notice. In the event of termination you must immediately cease accessing and using the Site, Forum and Content and (at Kimberly-Clark's option) return any hard copies of the Content or destroy any hard copies and any other electronic copies of the Content within your control or possession. All restrictions imposed on you, licences granted by you and all disclaimers, indemnities and limitations of liability set out in the Terms and Conditions will survive.
Privacy
33. Kimberly-Clark is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by using the Site, becoming a Member or participating in the Forum, you are taken to consent to Kimberly-Clark's "privacy policy":/privacy. You may access and correct any personal information held by Kimberly-Clark, upon request to Kimberly-Clark.
Other
34. If any term, condition, or provision of these Terms and Conditions is determined to be unlawful, invalid, void, or for any reason unenforceable, the validity and enforceability of the remaining terms, conditions and provisions shall not in any way be affected or impaired thereby. These Terms and Conditions constitute the entire agreement between you and Kimberly-Clark relating to the subject matter herein.
35. The Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

Terms and ConditionsSleeping Bags for Sleepovers Promotion – Conditions of Entry 1. Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the Sleeping Bags for Sleepovers Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
2. The Promotion commences 27 September 2010 at 10:00am AEST and closes 5 December 2010 at 11.59pm AEST (Promotion Period).
3. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
Entry
4. To enter (Entry) the entrant must:
1. log onto
www.kleenexmums.com.au (Kleenex Mums Website);
2. click on the competition link on the Kleenex Mums Website to complete the Promotion questions;
3. complete all the information requested for Entry into the Promotion including personal contact information;
4. follow the link in the email sent by the Promoter to confirm Entry into the Promotion prior to the end of the Promotion Period;
5. for an additional Entry, click on the ‘Share on Facebook’ button located on the Kleenex Mums Website to like the Promotion on the entrant’s Facebook page; and
6. for another additional Entry, click on the ‘Post on Twitter’ button located on the Kleenex Mums Website to share details of the Promotion on the entrant’s Twitter account.
5. Entries are deemed to be received by the Promoter at the time the entrant confirms the Entry by following the link in the email sent by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

A maximum of three (3) Entries may be submitted per household in each Entry Period with
only one (1) Entry allowed from each of the Entry methods detailed below: 1. completing the Promotion questions on the Kleenex Mums Website;
2. liking the Promotion by clicking on the ‘Share on Facebook’ button; and/or
3. sharing details of the Promotion by clicking on the ‘Post on Twitter’ button. Draws
7. All valid entries received during an Entry Period will be placed into the draw for that Entry Period, and will also be placed into all subsequent draws held during the Promotion Period. 8. The first ten valid entries drawn electronically at random will win two (2) Genesis 300 sleeping bags valued at $69.95 each (Sleeping Bag Set). Each Sleeping Bag Set is valued at $139.90. There are 100 Sleeping Bag Sets to be won (with 2 sleeping bags per set).
9. Total prize value is up to a maximum of $13,990.00. The value of the prize(s) is accurate and based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prize(s) after that date.
10. Each winner of a Sleeping Bag Set will be notified in writing by e-mail within two (2) days of the relevant draw. The names of the winners of the Sleeping Bag Sets will be published on the Kleenex Mums Website on the following dates:

11. The names of all the winners of Sleeping Bag Sets will be published in the Australian on 14 December 2010.
The prizes (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The prizes must be taken as offered and cannot be varied by a winner. The Promoter retains the right to substitute the prizes with a prize or prizes of equal or greater value (including where a prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
12. The Promoter may conduct such further draws as are necessary for an unclaimed prize at Kimberly Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 on 8 March 2011 at 10.00am AEST, subject however to any directions given by any applicable gaming authorities. The winners of any unclaimed prize will be notified in writing by e-mail within two (2) days of the relevant draw and details of the winner of any unclaimed prize will be published on the Kleenex Mums Website on 10 March 2011 and in The Australian on 10 March 2011.
13. The Promoter and its associated agencies or companies accept no responsibility for any lost, late, stolen, damaged or misdirected Entry.
14. The Promoter has no control over internet or mobile telephone communications, network lines, bugs/ viruses and server problems and accepts no responsibility for any problems associated with them, for whatever reason.
15. All tax liability arising as a result of accepting any prize is the responsibility of the winner.
16. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of the Promotion or receiving, taking or using the Sleeping Bag Set except for any liability which cannot be excluded by law.
17. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the Conditions of Entry.
18. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
19. The Promoter reserves the right to validate and check the authenticity of entries and to disqualify any entries which do not meet validation criteria or which are not submitted in accordance with these Conditions of Entry.
20. The winner agrees to participate in any news media activities surrounding the Promotion. The Promoter reserves the right to use the winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity without additional compensation.
21. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). By entering into this Promotion, each entrant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the entrant.
