Terms and Conditions 1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. 3. All publicly displayed venue advertising material for this competition will include a prominent message regarding responsible consumption of alcohol. Entry and continued participation in this promotion is subject to each venue's/outlet's liquor serving policy.
4. Entry is open only to Australian residents aged 18 or over excluding directors, officers, contractors, management and employees (and the immediate families of directors, officers, contractors, management and employees) of the Promoter, of any participating venues or outlets or of the agencies or companies associated with this competition.
5. There are two elements to this competition: an on-premise element conducted via selected liquor licensed venues (Venues) and an off-premise element conducted via selected liquor outlets (Outlets).
6. The competition in Venues begins on 25/11/10 and closes when the fifth Vodafone Ashes 2010/2011 test match ends (which will be no later than 6.30pm (AEDT) on 07/01/11) (Venue Competition Period). The competition in Outlets begins on 01/11/10 and closes when the fifth Vodafone Ashes 2010/2011 test match ends (which will be no later than 6.30pm (AEDT) on 07/01/11) (Outlet Competition Period). All claims for prizes must be received by 11.59pm (AEST) on 09/04/11 (for eligible online claims – see paragraph 13(a)) or last mail received on 11/04/11 (for eligible mail claims – see paragraph 13(b)).
7. To enter, consumers must, during the relevant Venue Competition Period or Outlet Competition Period:
(a) receive a unique code (Game Code) by:
(i) Venues: purchasing a glass, can or bottle of VB or VB Gold beer (Venue Eligible Purchase) from a participating Venue for on-premise consumption to receive a game card (Venue Game Card) (subject to stocks of Game Cards remaining in that Venue). Entrants will need to scratch the scratch panel on the Game Card to reveal their Game Code; OR(ii) Outlets: purchasing a specially marked case of VB or VB Gold stubbies/cans (Outlet Eligible Purchase) from a participating Outlet for off-premise consumption to locate their Game Code from within the case; and(b) submit their entry by one of the following methods:
(i) send an SMS (maximum cost 55 cents (inc GST)) from their mobile phone to 19772673 stating in one message, and in the following order, their Game Code, full name and postcode (errors and omissions excepted in the Promoter's discretion. Computer generated SMS entries will not be accepted); OR(ii) visit
www.vb.com.au (the Website), follow the links to the online entry form and fully complete the online entry form, including their full name, postcode, email address, the Game Code and any additional information as required by the Promoter. Consumers are responsible for their own costs associated with accessing the Internet.
8. All entries must be received during the relevant Competition Period. Any entries received outside of the relevant Competition Period will be deemed invalid. Consumers may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase and a separate unique entry code, except in NSW where Venue entrants are limited to 1 Venue Eligible Purchase per day, in QLD where Venue entrants are limited to Venue Eligible Purchases totalling 4 standard drinks per day and in ACT where Venue entrants are limited to 5 Venue Eligible Purchases per day. All entrants must retain their Game Code until after the relevant Venue/Outlet unclaimed prize draw (either on the Game Card for Venue entrants or on the inside of their Outlet Eligible Purchase case for Outlet entrants) (unless the Game Card or the inside of the Outlet Eligible Purchase case was required to be submitted in order to claim a prize valued at $50 or over as per paragraph 13(b)) and Outlet entrants must retain their original Outlet Eligible Purchase receipt(s) until after the Outlet unclaimed prize draw to verify each entry. Failure to provide any requested proof of purchase to the Promoter upon request may, at the Promoter's discretion, result in an invalid entry (and, at the Promoter's discretion, in all of the entrant's entries being invalid).
9. Each entrant will receive a return SMS (at no charge to the entrant) or email notification (depending on their entry method) confirming their successful entry into the competition and providing them with an Outcome. This Outcome will relate to a specific cricket player or team's result in a specific Vodafone Ashes 2010/2011 test match and will specify a dollar value to be won should the Outcome eventuate, e.g. an Outcome may state: "If Ricky Ponting's final score is 30-39 runs in the 1st innings of the Gabba Test, VB will shout you $50. Visit the Website with your Game Code to claim your prize". By entering this competition, entrants consent to receiving this electronic message and consent to the message not containing a functional unsubscribe facility.
10. If an entrant's Outcome eventuates (that is, using the example above, if Ricky Ponting's final score is between 30 and 39 runs in the 1st innings of the 2010/2011 Ashes test at the Gabba) in accordance with the final official match scorecard, the entrant has the opportunity to claim the dollar value stated in the Outcome (using this example, $50). The prize values available will vary between $5 and $1,000.
11. The result in each Outcome will be based on the final score obtained by the stated cricket player or team, or man of the match, in accordance with the official match scorecard of the stated Vodafone Ashes 2010/2011 test match. If there is any confusion or ambiguity regarding a final score, or man of the match, the Promoter will determine, in its absolute discretion, the final score or man of the match for the purposes of the affected Outcomes.
12. Entrants can check to see if their Outcome eventuated (and therefore whether they can claim the dollar value stated in their Outcome) by visiting the Website and following the links and instructions to enter their Game Code any time between the end of the relevant Vodafone Ashes 2010/2011 test match and 11.59pm (AEST) on 08/04/11.
13. To claim a prize:
(a) valued under $50, winning entrants must, before 11.59pm (AEST) on 09/04/11, visit the Website, follow the links to the relevant online claim form and fully complete and submit the online claim form, including by providing their Game Code from their winning Outcome; OR (b) valued at $50 or more, winning entrants must, before 11.59pm (AEST) on 09/04/11, visit the Website, follow the links to the relevant online claim form and fully complete, download and print the claim form. Winning entrants must then attach either their original Game Card showing their Game Code (for Venue entrants) or their original Game Code from the inside of their Outlet Eligible Purchase case and a copy of their original Outlet Eligible Purchase receipt (for Outlet entrants) and send to ‘VB Score Cash Promotion', PO Box 606, Eastern Suburbs Mail Centre, NSW 2004 to be received by last mail received on 11/04/11.
14. Winning entrants whose claim has been received and verified by the Promoter will receive their prize of the dollar value stated in their winning Outcome in the form of cheque or EFT to an Australian bank account (as nominated by the winner). Winners should allow up to 28 days to receive their prize.
15. The total prize pool is valued at up to $80,050,000. This figure is based on the total value of the potential winning Outcomes which are available for distribution to entrants, however it is mathematically unlikely that this entire prize pool will be awarded based on a random distribution of Outcomes amongst entrants.
16. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple mobile phone numbers/email addresses and/or aliases may be disqualified. In the event of a dispute regarding a prize awarded to an SMS entrant, the prize will be awarded to the owner of the relevant mobile phone. Entries and claims are deemed to be received at the time of receipt by the Promoter, not time of submission by the entrant.
17. SMS entry is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. Consumers should check with their network service provider to see if their mobile phone is compatible. SMS service provider is The Consortium Centre Pty. Ltd., SMS queries: 1800 855 941.
18. VIC winners will be notified personally in writing and all winners will be notified in writing via the Website in accordance with paragraph 12.
19. Winners of prizes valued over $250 will have their name and state/territory of residence published online at the Website sometime between the time of their Outcome eventuating and 11/01/11 and in The Australian newspaper on 11/01/11. By entering this competition, each entrant requests that his or her full address not be published.
20. The winners must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
21. If a winning entry is deemed not to comply with these conditions of entry, that entry will be discarded as if it had not been received. Entrants whose Outcome did not eventuate will not receive any prize.
22. The judges' decision is final and no correspondence will be entered into.
23. The Promoter may require entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter's discretion.
24. Prizes are not transferable or exchangeable.
25. If an Outcome becomes impossible due to any reason outside the control of the Promoter, the affected entrants' Outcomes will be void including (without limitation) if:
(a) any of the Vodafone Ashes 2010/2011 test matches to which Outcomes relate are abandoned, called off or postponed for any reason to the extent that it is not possible for an entrant's Outcome to eventuate (e.g. if the test match is called off or shortened due to rain); or(b) a Vodafone Ashes 2010/2011 test match finishes before an entrants' Outcome has the chance to eventuate (e.g. if a test match finishes on day 3 and an entrant's Outcome relates to day 5 of that test match); or(c) a player stated in an entrants' Outcome does not play in the stated Vodafone Ashes 2010/2011 test match for any reason whatsoever (e.g. using the example given in paragraph 9, if Ricky Ponting is not selected, or is injured, for the test match at the Gabba).
Entrants whose Outcomes are void based on the above situations will still be entered into the unclaimed prize draw, if conducted (in accordance with paragraph 26). Cricket Australia reserves the right in its absolute discretion to change or amend the International Cricket program without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation or delay of any day of any Test, One Day International or other match for any reason beyond the control of the Promoter or Cricket Australia.
26. Any prizes from Outcomes:
(a) that were sent to entrants in SA, QLD, NSW or ACT; and
(b) that, in fact, eventuated (as, for example, described in paragraph 10),
which remain unclaimed after either 11.59pm (AEST) on 09/04/11 (for eligible online claims – see paragraph 13(a)) or last mail received on 11/04/11 (for eligible mail claims – see paragraph 13(b)), as applicable (i.e. where a winning entrant from SA, QLD, NSW or ACT has not visited the Website and completed and submitted the claim form either online or via mail in accordance with paragraph 13) will be the subject of a random draw. There will be two draws conducted; one in respect of unclaimed prizes remaining from Outcomes that eventuated as sent to Outlet entrants; and one in respect of unclaimed prizes remaining from Outcomes that eventuated as sent to Venue entrants. Both draws will be conducted at 12pm (AEST) on 17/05/11 at The Consortium Centre, 87 Egerton Street, Silverwater NSW 2128. The unclaimed prize/s in the Outlet draw will be awarded in descending order of value to randomly selected Outlet entrants from all valid Outlet entries (from all states/territories) received in the competition. The unclaimed prize/s in the Venue draw will be awarded in descending order of value to randomly selected Venue entrants from all valid Venue entries (from all states/territories) received in the competition. Any winner/s in these draws will be notified in writing (SMS or email, depending on original entry method) and winners of prizes valued over $250 will be published in The Australian newspaper on 20/05/11 and at the Website. Winner/s in the Outlet draw will be requested to provide their original Outlet Eligible Purchase receipt(s) and their original Game Code from the inside of their Outlet Eligible Purchase case and winner/s in the Venue draw will be requested to provide their original Game Card containing their Game Code. Failure to provide this/these to the Promoter upon request may, at the Promoter's discretion, result in an invalid entry (and, at the Promoter's discretion, in all of the entrant's entries being invalid).
27. There will be a total of 6,660,000 Game Codes printed; 3,000,000 in respect of Venues and 3,660,000 in respect of Outlets.
28. Game Cards and Game Codes from any other competition are not valid for this competition.
29. Printing and other quality control errors outside the Promoter's control will not invalidate an otherwise valid prize claim. Every prize claim in excess of the advertised prize pool will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions. Game Cards are void if stolen, forged, mutilated or tampered with in any way.
30. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
31. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
32. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
33. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, if required.
34. The Promoter is not liable for any tax implications arising from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
35. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this promotion, entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
