Welcome to Australia’s new and fresh singing competition ‘Sing and Win’

Every day we’re uploading new videos of fantastic contestants with amazing vocal performances. See below to view contestants ranked from most viewed to least viewed.

Entries close on  Friday 10th December 5pm, up until then you can upload as many videos of yourself as you like. The more videos you upload the better your chance of booking a trip to our  final concert and even of winning one of our three incredible prizes.

TERMS AND CONDITIONS: SING & WIN
This document sets out the terms on which you are invited to participate in the Sing & Win competition (the Competition).  By entering the Competition, you agree to be bound by these Terms and Conditions and you enter into a binding agreement with Swim Communications Pty Ltd. (‘Swimco’).

•The Competition is promoted by Swim Communications Pty Ltd  (ACN 144 883 938), registered office Suite 1, Level 1, 330 Keilor Road, Niddrie,  Victoria 3042
•All communications in relation to the operation of the Competition should be addressed to:

Entry

•Sing & Win is a competition where you are invited to upload a video of your best singing performance to the website located at www.singandwin.com.au (the Website). 
•After your video is checked to ensure it complies with the Competition Rules (which are contained on the Website) (the Rules), it will be put live on the internet for the whole world to watch. 
Judges appointed by Swimco will select finalists who will be invited to perform at a concert to be held in Melbourne on Sunday 31st January 2011 (the Final Concert). 
At the Final Concert the judges will determine the prize winners. 
•To enter the Competition:
•Create a video clip of yourself performing excerpts from a song of your choice, which will be up to sixty seconds in length
•Upload your video clip to Youtube
•Log on to the Competition website (www.singandwin.com.au)
•Read both the Terms and Conditions and the Competition Rules to ensure that your clip complies with conditions of entry
•Pay the entry fee via the online payment process
•Follow the instructions to connect your video with the Sing and Win site.
Prior to going live on the Sing and Win site, your video clip will be reviewed to ensure it complies with the Rules and the Terms and Conditions.

•Entry to the Competition is open to persons who are current Australian residents at the time of the Competition. Any such person may enter the Competition except directors and employees of Swimco.
•Although anyone may enter the Competition, entrants are only eligible to win prizes if they attend and perform at the Final Concert.  You will be responsible for all costs relating to your attendance and performance at the Final Concert.
•Entrants under 18 years of age are welcomed, however if you are under 18:
◦Swimco may require your parent or guardian to advise that they accept these Terms and Conditions on your behalf prior to allowing you to perform at the Final Concert; and
◦Swimco reserves the right to contact your parent or guardian prior to uploading your entry to obtain their consent.
•You may enter the Competition as many times as you like, providing that each entry is a different performance.
Bound by the Terms and Conditions

•By entering the Competition, you agree to be bound by these Terms and Conditions.
•Swimco may decline to award any prize or upload any video (or may remove any video), if it determines in its absolute discretion that you have failed to comply with these Terms and Conditions.
•The Terms and Conditions of the Competition comprise:
◦the Terms and Conditions published on the Website;
◦the Rules; together with
◦any and all other instructions to entrants contained on the Website.
Entry fee 

•The fee payable to Swimco for entry to the Competition is $ 39 for one entry.
•Entry fees will not be refunded unless:
◦The refund is required by law; or
◦Swimco decides (in its absolute discretion) to grant a refund.
•The Rules set out the manner in which the entry fee is to be paid.  No entry will be valid unless the entry fee has been paid in accordance with the Rules.
•If Swimco decides in its absolute discretion to refund your entry fee, it may retain an amount sufficient to cover its costs of administering your entry and the payment of a refund.
Key dates

•The Competition opens at 9.00am on Tuesday September 28 th 2010 and closes at 6.00pm on Friday December 10th 2010 Eastern Standard Time.
•Unless Swimco decides in its absolute discretion to extend the closing date, entries received by Swimco after the closing date will be invalid and will not be eligible for prizes.  Late entries may, however, be uploaded to the Website and entry fees payable in respect of late entries will not be refunded.
•Swimco does not take any responsibility for late, lost, delayed or misdirected entries. 
Entries which breach the Rules

•The Rules will provide guidelines which will be taken into account by Swimco in determining whether to accept entries or upload them to the Website. 
•Before entering the Competition, we request you read the Rules, as they deal with important aspects of entering the Competition such as material which should not be contained in entries.
•If your entry contains material which Swimco determines in its absolute discretion breaches the Rules then:
◦your entry will not be made publicly available on the Website (or, if it has been made available on the Website, it will be removed);
◦your entry will not be eligible for consideration as a finalist;
◦your entry will not be eligible for prizes; and
◦your entry fee will not be refunded.
Warranty and indemnity

•You hereby warrant that:
◦All details provided by you to Swimco are true and accurate.
◦Your entry contains only material:
■which is not subject to copyright;
■in respect of which you hold the copyright; and/or
■in respect of which you have a valid, subsisting licence to use any copyright  material.
◦The exercise by Swimco of the rights granted to it in this document will not infringe the right of any third party.
•You hereby indemnify Swimco against any loss, damage or expense suffered or incurred by it as a result of a breach of these warranties.
•Swimco hereby excludes all and any liability to you or any other person (to the maximum extent permitted by law) in respect of any injury, damage, expense or loss (whether direct or consequential) to any person or property as a result of any entry into the Competition or any prize won in the Competition.  To the extent that such liability cannot be excluded, Swimco hereby limits its liability to the refund of any entry fee paid by a person for entry into the Competition.
Intellectual property and use of information

•By entering the Competition, you confirm that your entry:
◦Only includes video or audio of people who have consented to their inclusion in your entry.
◦Only includes material:
■which is not subject to copyright;
■in respect of which you hold the copyright; and/or
■in respect of which you have a valid, subsisting licence to use any copyright  material.
•Your entry will remain your property, however by submitting your entry you grant Swimco a transferable, irrevocable, non-exclusive licence to use your entry for:
◦The purposes of the Competition; and
◦Promotional or marketing purposes associated with the competition.
•You acknowledge that Swimco may (without breaching the copyright of yourself or any other person):
•Display your entry on any media platform, whether on the internet or otherwise.
•Allow others to view or listen to your entry.
•Allow others to download your entry as a video or music file.
•Edit or adapt your entry.
•Use your entry for promotional purposes or marketing (and also use material derived from your entry for promotional purposes).
•You acknowledge that once it is uploaded to the Internet Swimco cannot effectively control or limit the use made of your entry by others.  You hereby acknowledge that to the maximum extent permitted by law Swimco has no liability to you for the use made of your entry by others. 
•Swimco may use your entry and any personal details provided by you with your entry or in respect of your entry for any promotional, marketing or publicity purposes without notice to you and without paying any fee to you.  Swimco will not sell or rent your personal information but may allow St Vincent’s Hospital (Melbourne) Limited (ACN 052 110 755) to use it for fundraising activities
•Swimco will maintain the privacy of the personal information provided with your entry in accordance with our Privacy Policy, and will not use it for any purpose other than as set out in this document.
Chance and prizes

•Chance will play no part in determining the prize winners, and the prizes will be awarded to those entries regarded by the judges as being the best.
•The prize winners will be determined by the judges based on performances at the Final Concert.
•The prizes are as follows:
◦1st Prize            $5,000 cash award and the opportunity to perform at a Rotary                         District Conference in 2011 .
◦2nd Prize            $2,000 cash award and the opportunity to perform at a Rotary                         District Conference in 2011 .
◦ 3rd Prize            $1,000 cash award and the opportunity to perform at a Rotary                         District Conference in 2011.

◦            In addition, seven further prizes of merchandise vouchers                                     valued at up to $100 will be awarded by the judges.
Prize winners will be required to meet any rehearsal costs and travel, accommodation or other costs which relate to their performance at the Rotary District Conference. .
If a prize winner is a group performance (more than one person) then any prize awarded will be distributed to the entrant only and Swimco takes no responsibility for the fair division of that prize between the group members. Members will have to sign these Terms and Conditions if requested by Swimco at the Final Concert prior to performing.

•Non-monetary prizes cannot be redeemed for cash or “swapped” with any other prize or for any other thing.
•Swimco believes that it will be able to award the prizes as advertised.  Should this change then Swimco reserves the right to instead award other prizes which it regards as being of similar attractiveness. 
Discretion

•Swimco retains a complete, unfettered discretion as to the manner in which it deals with entries.  Swimco may refuse any entry, or accept an entry but decline to upload it to the Website, for any reason whatsoever or for no reason. 
•Swimco is not obliged to give reasons for any decision it makes (or the judges make) in relation to the Competition and will not give reasons or enter into correspondence in relation to any such decision.
•The judges will determine the winners based on performances at the Final Concert and must select those entries they regard as being the best (and which comply with the Rules) as the prize winners.
•Decisions of Swimco and the judges are final and binding on entrants.
•Swimco reserves the right to cancel the Competition at any time.  If it cancels the Competition it will return all entry fees and not use any entry or any personal details for any commercial or non-commercial use at any time after such cancellation.
The Final Concert

•Attendance at the Final Concert is at the cost of entrants selected as finalists.  In entering the Competition, entrants should take into account that:
◦selection for the Final Concert will be based on the video entries submitted;
◦they are only eligible for prizes if they perform at the Final Concert; and
◦prizes will be awarded based on performances at the Final Concert and not on video entries.
•Swimco reserves the right to require that a finalist (or member of a group performing, including musical backing to a finalist) who is under 18 be accompanied at the Final Concert by a parent or adult guardian.  You will be contacted prior to the Final Concert if this requirement applies to you.
•Entrants including group performers and members of backing groups performing at the Final Concert must:
◦sign a copy of the Terms and Conditions and Event Rules, acknowledging that they have read, understood and accepted them prior to the performance in the Final Concert;
◦provide proof of age, and if under the age of 18, have the Parent or Guardian accompanying them to sign the copies of the Terms and Conditions and Event Rules on their behalf;
◦attend rehearsal at the date and time advised by Swimco;
◦provide their own musical accompaniment;
◦obtain the prior approval of Swimco for the song they propose singing at the Final Concert; and
◦comply with any lawful direction issued by a representative or delegate of Swimco in relation to the final concert and their performance at the Final Concert, including directions as to dress code and the content of your performance.
•If selected to perform at the Final Concert you warrant that your performance only includes material:
■which is not subject to copyright;
■in respect of which you hold the copyright; and/or
■in respect of which you have a valid, subsisting licence to use any copyright  material.
•By performing at the Final Concert you grant Swimco a transferable, irrevocable, non-exclusive licence to record your performance and to use it for:
◦The purposes of the Competition; and
◦Promotional or marketing purposes, by itself or St Vincent’s Hospital (Melbourne) Limited.
•You acknowledge that Swimco may (without breaching the copyright of yourself or any other person):
•Display your performance on any media platform, whether on the internet or otherwise.
•Allow others to view or listen to your performance.
•Allow others to download your performance as a video or music file.
•Edit or adapt your performance.

•Swimco and/or its assignees may use your performance for any promotional, marketing or publicity purposes without notice to you and without paying any fee to you. 
•Prize winners will be announced at the Final Concert and will also be published on the Website.
