DELL XPS PRESENTS WASHINGTON COMPETITION TERMS AND CONDITIONS

1.     The promoter of the “Dell XPS Presents Washington” competition (Competition) is Dell Australia Pty Limited of Building 3, 14 Aquatic Drive, Frenchs Forest, NSW 2086, Australia (Promoter).

 
2.     Entry into the Competition constitutes acceptance of these terms and conditions and the Privacy Policy at www.dell.com.au. All entry instructions and prize information published by the Promoter also forms part of these terms and conditions.

Competition dates

3.     The Competition commences at 12:01 am (AEST) on Monday November the 15th 2010 and closes at 11:59pm (AEST) on Thursday 2nd December 2010 (Competition Period).

Qualifying Criteria

4.     Before you can enter the Competition, you must meet the following criteria (Eligibility Criteria):

5.               You must be an Australian resident;

b.               You must not be a director or employee of the Promoter or an immediate family member of a director or employee of the Promoter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin;

c.               You must have a valid email address; and

d.               You must be over 18 years of age.

5.     Entry in the Competition is free and all entries must be submitted to Promoter within the Competition Period.

6.     Information on how to enter and prizes form part of these conditions.  By participating, entrants agree to be bound by these conditions.  Entries must comply with these conditions to be valid. Entering the Competition

7.     You can submit one or more entries into the Competition.

8.     To enter the Competition visit the ‘Dell XPS’ tab on the Dell Australia Facebook Page at www.facebook.com/dellaustralia and during the Entry Period, follow the prompts to complete the entry form with all requested information entered using the process below


(Entry):

a. Enter your name

b. Enter your email address

c. Enter your mobile number

d. Seek out information to address the following questions;

 
1. The Dell XPS has? A) JBL Sound speakers B) A 20” screen or C) A built in toaster

2. Tell us in 25 words or less why you should be there?


e. Confirm ‘I am over 18 years of age and I agree to the competition terms & conditions’ by checking the box

f. Confirm ‘I would like to receive email updates from Dell’ by checking the box

9.  The Entry comprises all information provided by you

10.  Your Entry must not contain information that:

a.               Is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
b.               Harasses or advocates harassment of another person;
c.               Exploits people in a sexual or violent manner;
d.               References excessive violence, or offensive subject matter;
e.               Constitutes or promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
f.                Contains or constitutes or promotes an unauthorised copy of another person's copyright work or other form of intellectual property;
g.               Violates the privacy rights, publicity rights, copyright, trademark rights, contract rights or any other rights of any person.

 13.  Your Entry must not contain any virus, Trojan, worm, disabling code and/or bugs or platform features of any kind.

 14.  The Promoter may at any time in its absolute discretion remove, modify or not display any materials submitted for the Competition.
 

15.  The Promoter takes no responsibility for late or misdirected Competition entries or any delays or failures in any telecommunications services or equipment. Competition entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission. The Promoter accepts no responsibility for late, lost or misdirected Competition entries. Incomplete, inaccurate, erroneous, ineligible or incomprehensive Competition entries will be deemed invalid.

16.  All entries become the property of the Promoter. By taking part in the Competition, you irrevocably assign all rights, title and interest in your Entry to the Promoter and waive any moral rights in relation to the same.

Judging and prize draw

17.  Judging of the Competition will take place at Building 3/14 Aquatic Drive Frenchs Forest  Sydney NSW 2086 at 12:00pm AEST on Friday December 3 , 2010. The Promoter’s decisions are final and no correspondence will be entered into.

18.  The prizewinners will be notified in writing by the Promoter (or its agents) within 7 days of the judging of Competition entries using the contact details provided by the prize winner.  The name of the prizewinner will also be published on the Promoter’s website at www.dell.com.au.

 19.  All winners must, if requested by the Promoter, verify their compliance with these Competition terms and conditions prior to receiving a prize.  The required verification will be in a form determined by the Promoter in its absolute discretion.  If any winner does not comply with this clause they will forfeit their prize.

 

Prizes

20.  There will be 25 prizewinners who will be the entrants that create and submits the entries that are:

21.  Each prize consists of two tickets to a private party featuring a performance by Washingtonvalued at apx $70 ($35 per ticket) Australian Dollars at the commencement of the Competition.

22.  The Promoter accepts no responsibility for any tax implications that may arise from any winning of the prize and individuals entering the Competition should seek independent financial advice before entering the Competition. Promotional and other obligations

23.  By entering the Competition, you agree that, in the event that your entry is selected as a winner of any prize referred to in these Competition terms and conditions, you will be available for reasonable publicity purposes related to the Competition and that (without limiting its rights), the Promoter may conduct interviews and take photographs to be used for such publicity purposes and publication by the Promoter. Your Representations

 24.  By submitting an entry you represent that:

a. Your Entry is original;
b. You are the sole creator of your Entry;
c. Your Entry does not infringe the intellectual property rights of any third party;
d. Your Entry has not been previously entered into in any other contest or competition either in part or in full;
e. No part of your Entry has been previously published in any medium;
f. No part of your Entry violates any Australian laws;
g. Your participation in the Competition does not violate your employer’s policies; and
h. You waive all claims to any moral rights that you may have in the Entry and you consent to the Promoter’s use of the Entry in any manner it deems fit either in part or in full.
i. You agree that ownership of all intellectual property in the Entry or part thereof is assigned to the Promoter. You also agree to sign any further documentation required by the Promoter to effect the assignment.


Miscellaneous

25.  This Competition is a game of skill and chance plays no part in determining the winner.

 26.  If for any reason any element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize of equal or greater value will be awarded to the prizewinner in lieu, subject to any written directions made under State or Territory legislation.

 27.  The Promoter will not be liable for any loss or damage whatsoever which is suffered by you (including, without limitation, indirect or consequential loss), or for personal injury suffered or sustained, as a result of you taking part in, winning or using any of the prizes, except for any liability which cannot be excluded by law.

 28.  The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information relevant to entry into or participation in the Competition.  Verification is at the discretion of the Promoter, whose decision is final.

 29.  The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of the Competition.

 30.  The Promoter reserves the right to disqualify any individual who the Promoter considers to have used an automated system (like bots, software applications which create dummy entries or votes without any human involvement) or any unfair means to vote for their Entry or participate in the Competition. This consideration is at the sole discretion of the Promoter, whose decision is final.

 31.  If for any reason the Competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, prohibition by any relevant authority or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition as it sees fit.

 32.  These Competition terms and conditions are to be construed in accordance with the law in New South Wales and the parties submit to the exclusive jurisdiction of the courts of New South Wales.
