“How In Sync Are You with Home & Away” Promotion
Terms and ConditionsBy entering the “How In Sync Are You with Home & Away” game of skill competition
(the Competition), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter and prizes forms part of these conditions of entry.
2. WHO CAN ENTER?
2.1
Subject to clause 2.2, entry is open to all residents of Australia where the Channel
Seven signal is received.2.2 Employees and their immediate families of Seven Network (Operations) Limited,
Pacific Magazines, Yahoo!7, Nissan Motor Company (Australia) Pty. Ltd., and their
associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on Friday 26th November 2010 at 19:00 AEDT
and
concludes on Saturday 1st January 2011 at 23:59 AEDT (“Competition Period”).3.2 To enter, a person must log onto
www.homeandaway.com.au and state in 25 words
or less what they think will happen when Home and Away returns on 16 January
2011. Entrants must also provide their name, address (including postcode) and
daytime telephone number (including STD area code) which will not count towards
the maximum word limit. Entries will be judged on creativity.
3.3
Entrants in the Competition may enter as many times as they like but may not use
“scripting” for multiple entries (which will be deemed invalid).3.4 Entries must be received within the competition period.
3.5 The entry must be:
(a) the original independent creation of the entrant; and
(b) free from any potential claims, including copyright or trademark claims, by
other parties.
3.6 Entry details remain the property of the Promoter and will not be returned to
the entrant. The winners agree to granting the Promoter a perpetual and
non-exclusive licence to use their entries in all media worldwide and the
winners will not be entitled to any fee for such use.
4.
PRIZES
4.1 There will be one (1) major prize winner and four (4) minor prize winners. The prize
winners will receive the prize package as set out in clause 4.2 below.

Total prize value is up to $49,818.14 inc GST Prize value is correct as at 14th October
2010. The Promoter accepts no responsibility for change in prize value between
now and the ultimate date on which the prize is taken.
4.3 In relation to the major prize, travel insurance is strongly recommended. and any
ancillary costs related to travel to or from Sydney that are not otherwise detailed in
clause 4.2 above are also the responsibility of the winner. For clarity, the stipulated
prizes and prize components in clause 4.2 are exhaustive and, unless expressly stated in
these terms and conditions, all other expenses become the responsibility of the prize
winner.
4.4 Any additional options (including accessories) and all ancillary costs, including but not
limited to costs in relation to preferred detailing, paint colour, full comprehensive
insurance, etc. for the vehicle component of the major prize are the responsibility of
the Major Prize Winner.
4.5 If the Major Prize Winner is under 18 and/or does not hold a current Australian driver’s
licence as at the date of the delivery of the car, the car will be transferred into the
name of an adult or guardian nominated by the winner.
4.6 The Major Prize Winner or his or her parent or guardian (as the case may be) (“Deemed
Winner”) is responsible for arranging their attendance at the premises of the dealer
nominated by the Promoter and the Sponsor to collect the vehicle. The Deemed
Winner must provide all information and sign all documentation necessary to enable
the Promoter and the Sponsor to register the vehicle in the name of the Deemed
Winner prior to collection. To be eligible to claim the vehicle, the Deemed Winner must
be capable of obtaining registration of the vehicle in his or her name in accordance
with the applicable legislation in the State or Territory in which the vehicle is collected.
If the Deemed Winner is, through any legal incapacity or otherwise, unable to register
the vehicle in his or her name then he or she may, notwithstanding any condition set
out in these terms and conditions of entry to the contrary, assign the vehicle to another
person with legal capacity for the purpose of registration of the vehicle.
4.7 Vehicle colour can be selected by the Major Prize Winner or the Deemed Winner (as
the case may be) and is subject to availability in stock.
4.8 The vehicle will be delivered to the closest Nissan Dealership to the Major Prize Winner’s
home address.
4.9 At least one (1) traveller (the Deemed Winner or their companion) must be over 18
years of age.
4.10 Times and dates of travel are subject to availability.
4.11 No stopovers are permitted on travel associated with the major prize and flights
and accommodation are subject to availability.
4.12 Changes to the Major Prize Winner’s flight details once booked will incur a change
fee per guest and the payment of this will be the responsibility of the winner.
4.13 The Major Prize Winner and their companion must travel together on the same
flights and stay in their allocated accommodation.
4.14 The Major Prize Winner and their companion may not use Frequent Flier points from
any airline on the travel prize and cannot upgrade any travel prize using Frequent Flier
points.
4.15 The travel component of the major prize is a single event holiday and all elements
must be taken together.
4.16 The hotel accommodation prize element in the major prize is for two persons, twin
share, for three nights.
4.17 All other expenses such as car hire, meals, travel insurance, additional spending
money, transfers, government levies, transport to and from the winners departure
point, items of personal nature and in-room charges not stipulated as part of the major
prize will be the responsibility of the prize winner.
4.18 All accommodation and land components of the major prize are subject to Seven
Network (Operations) Limited and other suppliers booking conditions and availability.
4.19 In participating in the the winners agree to participate and co-operate as required
in all editorial activities relating to the Competition, including but not limited to being
interviewed and photographed. The winners (and their companions) agree to
granting the Promoter a perpetual and exclusive licence to use such footage and
photographs in all media worldwide and the winners (and their companions) will not
be entitled to any fee for such use.
4.20 The winners and their companions agree they will not sell or otherwise provide their
story and/or photographs to any media or other organisation.
4.21 If the Major Prize Winner is under the age of 18 as at the date of judging, an adult
must accompany the minor in the participation in the travel element of the prize.
4.22 Subject to clause 4.5 above, prizes cannot be transferred and cannot be
exchanged for cash. Winners should seek independent financial advice about any
tax implications that may arise from the prize winnings.
4.23 All minor prizes will be granted by way of [cheque in the winner’s name] / [bank

5. HOW TO WIN
5.1 All entries will be judged by a panel of judges appointed by the Promoter at the
Promoter’s offices at 160 Harbour Esplanade, Docklands, VIC 3006 on [Wednesday
12th January 2011 at 12:00 AEDT]. The winner will be the entrant whose entry is
judged to be the most creative from all entries received (Major Prize Winner). The
four (4) entries judged to be the next most creative will each win a minor prize. The
Competition is a game of skill and chance plays no part in determining the winner.
5.2 Winners will be notified by a promotional TVC airing during Home & Away (or any
replacement program in the Home & Away time slot) each weeknight from Monday
16th January 2011 – Friday 20th January 2011, as well as a phone call the day after
the promotional TVC airs and a letter advising winners of their prize will also be
posted.
5.3 The Promoter may in its absolute discretion deem entries invalid subsequently to a
Winner being notified or a Winner’s name being announced if it is discovered that
the winner did not enter the Competition in accordance with these terms and
conditions. In these circumstances, an additional draw will be conducted.
5.4 The judges’ decision (including any decisions as to prize distribution) is final and the
Promoter will not enter into correspondence regarding the result.
5.4 It is a condition of accepting the prize that the winner (and any companions) must
comply with all the conditions of use of the prize and prize supplier’s requirements.
5.5 It is a condition of accepting the prize that the winner may be required to sign a
legal release in a form determined by the Promoter in its absolute discretion.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or
significantly hinders the Promoter’s ability to proceed with the Competition on the
dates and in the manner described in these terms and conditions, including but not
limited to vandalism, power failures, tempests, natural disasters, acts of God, civil
unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion
cancel the Competition and recommence it from the start on the same conditions.
6.2 Seven Network (Operations) Limited & affiliates, Nissan Motor Company (Australia)
Pty. Ltd and their associated agencies and companies will take no responsibility for
prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Seven Network (Operations) Limited & affiliates, Nissan Motor Company (Australia)
Pty. Ltd and their associated agencies and companies will not be liable for any
misadventure, accident, injury, loss (including but not limited to consequential loss)
or claim that may occur:
a) during the judging;
b) whilst undertaking any travel won on or connected with their entry into the
Competition; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the Competition or the
publication of any material, including any statements made by any compere,
staff member, journalist, other entrants or any other person.
f) in relation to failure of an entry message to be received by the Promoter on
account of technical problems or traffic congestion; or
g) in relation to any damage or loss to Entrant's or any other person's computer
software, computer equipment or internet connection resulting from or related
to participation in this Promotion;
h) any variation in Prize value to that stated in these Terms and Conditions;
i) any technical difficulties, technical error or equipment malfunction (whether or
not under the Promoter’s control); or
j) any error, omission, interruption, deletion, delay, defect, theft, unauthorised
access or third party interference.
6.4 The Promoter reserves the right to reasonably amend or vary these terms and
conditions at its sole discretion, orally or in writing, for the purpose of Seven’s
programming, scheduling or production requirements.

7.2 The sponsor is Nissan Motor Company (Australia) Pty. Ltd, 260-284 Frankston-
Dandenong Road, Dandenong South, Victoria, 3175 (ABN 54 004 663 156).
7.3 Seven Network Limited (ACN 052 816 789) and its related entities (“Seven”), and
Nissan Motor Company (Australia) Pty. Ltd, are collecting the entrant's personal
information for the purpose of conducting and promoting this Competition
(including but not limited to determining and notifying winners). The entrant may
request access to his or her personal information by writing to Privacy Officer, c/-
