2) Information on how to enter and prizes form part of these Conditions of Entry. Participation in this
promotion is deemed acceptance of these Conditions of Entry.
3) Entry is only open to residents of Australia. Employees of the Promoter, 5th Finger Pty Limited and
their immediate families and all companies and agencies associated with this promotion are ineligible
to enter.

Promotion commences Saturday 4 December 2010 at 07:00 AEDST and closes on Sunday 12
December 2010 at 23:59 AEDST. The draw will take place at 5th Finger Pty Ltd, Level 7, 264 George
St, Sydney NSW 2000 on Monday 13 December 2010 at 10:00 AEDST. The winners will be notified
by phone and mail and published in The Australian newspaper on Thursday 16 December 2010.
5) There are two ways of entering the promotion:

and registering their full name, address and a daytime telephone number on 1902 554

b. SMS: Text their full name and address to 199 54 888 during the promotional period.
Maximum SMS entry cost per message is 55c including GST. The SMS entry mechanic
is only open to consumers with a SMS compatible mobile phone connected to a service

6) Multiple competition entries are permitted, subject to the following: (a) only one entry permitted per
SMS message or 190 call; and (b) each entry must be submitted separately and in accordance with

7) The promoter is neither responsible nor liable for late, lost, misdirected, incomplete or inaudible
entries.
Incomplete, inaudible or indecipherable entries will be deemed invalid.
9) If the winner entered via SMS they will be contacted by the Promoter via SMS and/or phone and the
Promoter will record their address details so that the prize may be awarded.
10) All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of

13) All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable
or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any
other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any
variation in the prize value. Prize winners are advised that tax implications may arise from their prize
winnings and they should seek independent financial advice prior to acceptance of their prize. In the
event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/
online, redemption of that portion of the prize will be subject to the terms and conditions stipulated on
the voucher / ticket / pass/ online. The Promoter will not be liable for any voucher / ticket / pass that

14) The prize does not include any installation or set-up of any of the products.

16) The nominated prize package will be delivered to the nominated address of the prize winner
anywhere in Australia. The prize will be delivered within 28 days of winner notification.
17) In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated
with the prize which are the entire responsibility of the winner.
18) It is a condition of accepting the prize that the winner may be required to sign a legal release in a form
to be determined by the Promoter in its discretion.
19) Prize is subject to the standard terms and conditions of individual prize and service providers.
20) In the event that for any reason whatsoever the winner does not take the prize at the time stipulated
by the Promoter, then the prize will be forfeited by the winner and cash will not be awarded in lieu of
the prize.

the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same

23) The prize is not exchangeable and cannot be taken as cash, unless specified otherwise.
24) The Promoter may conduct such further draws at the same place as the original draw as are
necessary on Monday 14 March 2011 at 10:00 AEDST in order to distribute the prize if unclaimed by
that date, subject however to all reference to any relevant state and territory regulations. In the event
of a winner, they will be notified in writing and their name will be published in The Australian on
Thursday 17 March 2011.
25) It is a condition of accepting a prize that the winner agrees to be interviewed, photographed and/or
filmed at any time during the acceptance of the prize by the Promoter or their agent. There is no
obligation upon the Promoter to use such images or footage but if the Promoter elects to do so, the
winner consents to the Promoter using their name, likeness, image and/or voice in any media for the
purpose of promoting this competition, (including any outcome) on any television Program or by the
Promoter itself, for an unlimited period of time without remuneration.
26) The Promoter is not responsible for any incorrect or inaccurate information, either caused by the
phone user or for any of the equipment or programming associated with or utilised in this competition,
or for any technical error, or any combination thereof that may occur in the course of the
administration of this competition including any omission, interruption, deletion, defect, delay in
operation or transmission, communications line or telephone, mobile or satellite network failure, theft
or destruction or unauthorised access to or alteration of entries.
27) If this competition is not capable of running as planned due to any reason whatsoever, including but
not limited to, programming changes, technical failures (either in the administration of the promotion
or the broadcast of the television program), unauthorised intervention, fraud or any causes beyond
the control of the Promoter which corrupt or affect the conduct, administration, security, fairness or
integrity of the promotion, the Promoter reserves the right, in its sole discretion, to the fullest extent
permitted by law and subject to any written directions given by a regulatory authority, to: (a) modify,
suspend, the terms and conditions terminate or cancel the promotion; and/or (b) disqualify any
entrant, as appropriate.
28) Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify
the statutory implied guarantees/warranties as provided under the Trade Practices Act, ASIC Act, or
the Competition and Consumer Act including the statutory consumer guarantees under the Australian
Consumer Law or similar laws in the State and Territories of Australia (“Non-Excludable
Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) excludes all
liability (including negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way out of

parties involved excludes all liability however so arising (including all liability arising from negligence
on the part of the Promoter or its officers, employees or agents) for any loss or damage whether
direct, indirect, special or consequential or for personal injury which is suffered or sustained, by
entrants or the winner, arising in any way of out of or in connection with the promotion. It is a
condition of accepting the prize that the winner (and companion) may be required to sign a legal
release in a form determined by the Promoter in their absolute discretion. Certain legislation may
imply warranties or conditions or impose obligations (collectively Provisions) in relation to the

30) By entering the Promotion via SMS, an entrant consents to the Promoter using the entrant's personal
details for the purposes of sending one (1) mobile terminated (MT) reply message per entry which
includes a confirmation of your entry in the Promotion AND may include details of a special offer
made by one of our partners.
31) All entries remain the property of the Promoter. The Promoter collects entrants’ personal information
in order to conduct the promotion. If the information requested is not provided, the entrant may not
participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also
agrees that the Promoter may use this information, including the entry itself, in any media for future
promotional, marketing and publicity purposes without any further reference, payment or other
compensation to the entrant, including sending the entrant electronic messages. Entrants’ personal
information may be disclosed to State and Territory lottery departments and winners’ names
