How to enter:

 
For your chance to win a new Apple iPad, purchase a bottle of Evans & Tate Classic Range between 5 December 2010 and 1 January 2011 and then either: SMS 0429 558 125 (cost is 55c including GST) with your full name, postcode and the last 4 digits of the product barcode or visit www.bottlemart.com.au or www.sipnsave.com.au and follow the prompts to the promotion entry page and input the requested details including your full name, postcode and the last 4 digits of the product barcode. The last 4 digits of the product barcode keyword can be found on the back label of the product. Entries close 11:59pm EDT on 1 January 2011. SMS entrants must have premium service access. Terms and Conditions of Entry

 
1. Information on how to enter and prize form part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions of Entry.

2. Entry is only open to Australian residents aged 18 years or over. By entering this promotion you are certifying that that you are over 18 years of age. Employees and their immediate families of the Promoter, participating retailers and their agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant for tampering with the entry process or for submitting an entry not in accordance with these Terms and Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements; (c) maximum one entries per person per day; and (d) unrecognised keywords will be deemed invalid.

5. Promotion commences at 12.01am, 5 December 2010, EDT and closes at 11.59pm on 1 January 2011, EDT (Promotional Period). There are a total of fifteen (15) Apple iPads to be won over the Promotional Period. A draw will take place at 68 Anzac Street, Chullora NSW 2190 on 4 January, 2011 at 12.00 noon EST.

6. Winners will be notified by mail and their name published in The Australian on Friday 14 January 2011. Promoter’s decision is final and no correspondence will be entered into.

7. The winners will win one (1) of fifteen (15) Apple iPads (includes dock connector to USB cable, 10W USB power adapter and documentation) valued at AUD$799 (16GB iPad with Wi-Fi + 3G). Total prize pool is AUD$11,985 RRP. Prize does not include data plan for the Apple iPad. Data plans and associated charges will be the responsibility of the winners.

8. The Promoter encourages consumers to enjoy responsible drinking. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines that can be found at www.nhmrc.gov.au.

9. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. The Promoter will request a copy of the proof of purchase prior to their entry being confirmed as a winning entry.

10. For entries via SMS premium carriers SMS costs apply to enter. The maximum SMS cost from most mobile services is 55 cents (including GST). Entrants must have premium service access. SMS Provider is SMS Global (telephone helpline 1300 733 504). The charges for all SMS entry services will appear on your next mobile phone bill. All queries relating to mobile bills should be directed to your mobile or telephone carrier.

11. Entries via SMS will only be accepted from mobile phones. SMS entries via the internet are ineligible. Any form of automated entry using any other devices or software is invalid. Entries will only be valid when the SMS messages are paid for. If the Promoter (or any of its Suppliers) considers that there has been excessive use/manipulation of the entry process then that will be deemed to constitute manipulation (which will entitle the Promoter and or the SMS Provider to exclude the relevant participant from the process).

12. For entries via the internet the cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.

13. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.

14. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions of Entry, all prize claims in excess of the advertised prize pool will be honoured. Any unclaimed prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.

15. All entries become the property of the Promoter. Entries not completed in accordance with the Terms and Conditions, or received after the closing date will be disregarded. Indecipherable or incomplete entries will be disregarded.

16. No portion of the prizes is redeemable for cash. The prizes are not refundable or transferable. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST).

17. If unforeseen circumstances, beyond the Promoter’s or its prize supplier’s control arise that prevent the prizes from being awarded, the winner will be provided with an alternate prize of equivalent value, subject to any written directions from a regulatory authority.

18. The Promoter may conduct such further draws as are necessary on 1 April 2011 at 12noon EDT at 68 Anzac St, Chullora NSW 2190 in order to distribute any prize unclaimed by the date subject however to any written directions given from a regulatory authority. In the event of any winner in the unclaimed prize draw, they will be notified in writing and their name will be published in The Australian on 15 April 2011.

19. If for any reason an act, agent or event beyond the reasonable control of the Promoter (including but not limited to vandalism, tampering, fraud, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism) prevents this promotion from proceeding in the manner described in these terms and conditions, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant and/or (b) cancel, terminate, modify or suspend the promotion subject to any direction or requirement from any regulatory authorities.

20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) Any tax liability incurred by a winner or entrant; and/or (f) use of a prize.

21. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

22. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received, any SMS reply message or for any delay in the delivery of the SMS message due to technical disruptions, network congestion, network failures or for any other reason.

23. The Promoter collects entrants’ personal information in order to conduct the promotion and may disclose such information to third parties including but not limited to prize suppliers. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion and opting in, as per the below, unless otherwise advised, each entrant also agrees that the Promoter may, subject to legislative requirements, use this information, or disclose it to other organisations, including its prize suppliers that may use it, in any media for future promotional, marketing and publicity purposes including sending electronic messages without any further reference, payment or other compensation to the entrant. If you want to receive further information on goods, services or promotions from the Promoter or its prize suppliers and you are entering on-line via the website then tick the opt-in box provided on the on-line entry form.

24. Entrants’ personal information may be disclosed to Australian regulatory authorities and winners’ names published as required under the relevant lottery legislation.
