2. To enter, individuals must then, during the Promotional Period, either:

(a)      send an SMS containing the following in this order: the eight (Cool digit unique code found on the promotional sticker and their full name to 1993 8783 (e.g. ABCD1234, John Smith). Premium SMS cost is 55c. Entrants must have premium service access. Premium SMS Service Provider: MessageMedia Interactive. Entrants requiring help with the premium SMS service may contact the Premium SMS Helpline on 1800 205 596;  OR

(b)         visit www.jacobscreek.com.au/tennis, follow the prompts to the competition entry page, complete the online entry form including the eight (Cool digit unique code found on the promotional sticker, their full name, address and mobile number submit the fully completed entry form.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to residents of Australia aged 18 years or over who are available to travel between 18/01/2011 – 19/01/2011 and 29/01/2011 – 31/01/2011. Persons under the age of 18 or residents outside Australia are ineligible to enter.

3. Employees (and their immediate families) of the Promoter, participating venues and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. Incomplete, indecipherable, or illegible entries and entries not in conformance with the entry requirements of will be deemed invalid.

6. Only one (1) entry permitted per person per day.

7. Entrants must retain their originalpurchase receipt(s) for all entriesas proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the venue of purchase and that the purchase was made during the promotional period but prior to entry.

8. If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person who can produce the original purchase receipt.  If the original purchase receipt cannot be produced (subject at all times to Clause 7 above) and the Promoter dispenses with the requirement to produce such receipt, in the case of an entry by SMS the entrant will be deemed to be the person in whose name the mobile phone account is held and in the case of an entry via the promotional website the entrant will be deemed to be the person named on the online entry form.

9. Premium SMS cost is 55c. Entrants must have premium service access. Winners will be contacted by phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.

10. Promotion commences at 12:01am AEDST on 8/11/10 and final entries close at 11:59pm AEDST on 23/1/11. There will be a total of ten (10) draws conducted for this promotion.  Entries for each draw close at 11.59pm AEDST on the dates specified in the table below. All draws will take place at MessageMedia Interactive, Level 22, 385 Bourke Street, Melbourne, VIC 3000 at 10.00am AEDST on the dates specified in the table below. The Promoter reserves the right to draw additional reserve entries in each draw and record them in order in case an invalid entry or ineligible entrant is drawn. Un-drawn entries in each draw will be entered into any subsequent draws. All winners will be notified by telephone and confirmed in writing. Winners ofMajor Ticket Prizes and Minor Ticket Prizes will have their name published on www.jacobscreek.com.au/tennis on the dates specified in the table below. Any winners ofMajor Ticket Prizes and Minor Ticket Prizes who reside within Victoria will have their name published in The Australian on the dates specified in the table below. The Promoter’s decision is final and no correspondence will be entered into.

11. Major Ticket Prizes: One (1) Major Ticket Prize will be awarded in each draw. A total of ten (10) Major Ticket Prizes will be awarded. The first valid entry drawn in each draw will win the Major Ticket Prize of a trip for two (2) adults to Melbourne, Australia valued at up to $3500 eachdepending on time and point of departure. Major Ticket Prize includes:

·         Two (2) adult tickets to the men’s singles final of the Australian Open 2011 tennis on 30/01/2011;
·         Return economy airfares from winner's nearest Australian capital city to Melbourne, Australia for two (2) adults;
·         Two (2) nights twin share 5 star accommodation at the Crown Metropol Hotel, Melbourne (or similar);
·         Transfers to and from the accommodation to Melbourne Olympic Park; and
·         Return private car transfers from the airport to accommodation.

Total value of Major Ticket Prizes is up to $35,000
.

Major Ticket Prizes must be taken to coincide with the men’s singles final of the Australian Open 2011 (arriving into Melbourne on 29/01/2011 and departing from Melbourne on 31/01/2011) and is subject to booking and flight availability. All bookings and documentation for Major Ticket Prizes must be made with CINQ on (03) 9558 0207 by 5.00pm AEDST on 26/01/2011. If for any reason a Major Ticket Prize winner does not book or take a Major Ticket Prize by the date stipulated, then the Major Ticket Prize will be forfeited. In the event that a Major Ticket Prize is not booked by the date stipulated for reasons beyond the reasonable control of the winner (including in the case where the Promoter is unable to contact the winner), the Promoter may, in its absolute discretion, award the winner a trip for two (2) adults to Melbourne, Australia including return economy airfares from winner's nearest Australian capital city to Melbourne, Australia for two (2) adults, two (2) nights twin share 5 star accommodation at the Crown Metropol Hotel,Melbourne (or similar), return private car transfers from the airport to accommodation and a Jacobs Creek Australian Open merchandise pack to the value of $1000. Alternative prize trip must be taken by 30/06/2011.

12. Minor Ticket Prizes: One (1) Minor Ticket Prize will be awarded in draws 1 – 5 (inclusive). A total of five (5) Minor Ticket Prizes will be awarded. The second valid entry drawn in draws 1 – 5 (inclusive) will each win the Minor Ticket Prize of a trip for two (2) adults to Melbourne, Australia valued at up to $3000 eachdepending on time and point of departure. Minor Ticket Prize includes:

·         Two (2) adult tickets to a men’s or women’s singles match in Rod Laver Arena on 18/01/2011;
·         Return economy airfares from winner's nearest Australian capital city to Melbourne, Australia for two (2) adults;
·         One (1) night twin share 5 star accommodation Crown Metropol Hotel Melbourne (or similar);
·         Transfers to and from the accommodation to Melbourne Olympic Park; and
·         Return private car transfers from the airport to accommodation.

Total value of Minor Ticket Prizes is up to $15,000
.

Minor Prize Ticket trips must be taken to coincide with the men’s or women’s singles match in Rod Laver Arena on 18/01/201 (arriving into Melbourne on 18/01/2011 and departing Melbourne on 19/01/2011) and is subject to booking and flight availability. All bookings and documentation for the Minor Ticket Prizes must be made with CINQ on (03) 9558 0207 by 5.00pm AEDST on 13/01/2011. If for any reason a Minor Ticket Prize winner does not book or take a Minor Ticket Prize by the date stipulated, then the Minor Ticket Prize will be forfeited. In the event that a Minor Ticket Prize is not booked by the date stipulated for reasons beyond the reasonable control of the winner (including in the case where the Promoter is unable to contact the winner), the Promoter may, in its absolute discretion, award the winner a trip for two (2) adults to Melbourne, Australia including return economy airfares from winner's nearest Australian capital city to Melbourne, Australia for two (2) adults, one (1) night twin share 5 star accommodation at the Crown Metropol Hotel Melbourne (or similar), return private car transfers from the airport to accommodation and a Jacobs Creek Australian Open merchandise pack to the value of $400. Alternative prize trip must be taken by 30/06/2011

13. Merchandise Prizes: following the draw of the Major Ticket Prize and Minor Ticket Prize winners (as applicable) the following prizes will be awarded in each draw:

·         The next ten (10) valid entries drawn in each draw will each win a tennis kit including a sports bag, a Wilson tennis racquet, a towel and a water bottle valued at $175 each. A total of 100 tennis kits will be awarded;

·         The next ten (10) valid entries drawn in each draw will each win an Australian Open branded gym towel valued at $55 each. A total of 100 Australian Open branded gym towels will be awarded;

·         The next twenty-five (25) valid entries drawn in each draw will each win a wine cooler bag valued at $15 each. A total of 250 wine cooler bags will be awarded;

·         The next seventy-five (75) valid entries drawn in each draw will each win an Australian Open branded cap valued at $15 each. A total of 750 Australian Open branded caps will be awarded.

Total value of Merchandise Prizes is $38,000
.

14. If a Major or Minor Ticket Prize winner resides within a 40km radius of the Melbourne CBD, Victoria, the airfare component of the Major or Minor Ticket Prize will be forfeited, not redeemable for cash and the winner will be responsible for their own travel and any associated costs. If a Major or Minor Ticket Prize winner resides outside a 40km radius of the Melbourne CDB but is still a resident of Victoria, the airfare component will be substituted for vehicle travel arrangements between the winner’s residence and accommodation.

15. Spending money, meals, taxes, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included in any Major and Minor Ticket Prizes.

16. All Major and Minor Ticket Prize travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partne

17. Major and Minor Ticket Prize winners (and their companion/s) are responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Major and Minor Ticket Prize winners (and their companion/s) are advised to have valid travel insurance for their period of travel.

18. Major and Minor Ticket Prize winners (and their companion/s) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of any Major and Minor Ticket Prize. Major and Minor Ticket Prize winners may be required to present a credit card at time of accommodation check-in.

19. Subject to the terms and conditions of the participating prize provider(s), if for any reason a Major or Minor Ticket Prize winner does not, once the Major or Minor Ticket Prize has been booked, take the Major or Minor Ticket Prize or an element of the Major or Minor Ticket Prize at the time stipulated, then the Major or Minor Ticket Prize or that element of the Major or Minor Ticket Prize will be forfeited and will not be redeemable for cash.

20.Redeeming a Major or Minor Ticket Prize is conditional on acceptance of the terms and conditions of travel as detailed by CINQ Pty Ltd and the airline carriers in accordance with normal travel practices.

21. The Australian Open 2011 ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Major or Minor Ticket Prize.

22. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

23. Total prize pool value is up to $88,000.00. Prizes, or any portion of a prize, are not transferable, exchangeable or redeemable for cash.

24. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy. The Promoter advocates the responsible service and consumption of alcohol.

25. A draw for any unclaimed or forfeited prizes will take place on 28/04/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. A prize of equivalent value will be awarded for any unclaimed or forfeited Major or Minor Ticket Prizes. The winner(s) of the unclaimed prize draw, if any, will be contacted by telephone and mail. Winners (of prizes valued at over $250) will have their name published on www.jacobscreek.com.au/tennis on 12/05/2011. Any winners (of prizes valued at over $250) who reside within Victoria will have their name published in The Australian on 12/05/2011.

26. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

28. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

29. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the any event forming part of the Australian Open 2011 is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.

 30. As a condition of accepting a Major or Minor Ticket Prize, the winner (and their companion/s) may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

31. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter at GPO Box 2246, Adelaide, SA 5001 or by fax on 08 8202 0502, all correspondence should be to the attention of the Corporate Lawyer.
