RUNNING TRAX SUMMER 2011 COMPETITION TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Competition is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian Residents aged 18 years or over. Employees (and their immediate families) of the Promoter, and agencies associated with this Competition are ineligible to enter. The Competition commences on 22/12/2010 and closes at 11:59pm AEDST on 14/01/2011 ("Competition Period").
3. Individuals must register the requested personal information to enter. Entry occurs through the "RUNNING TRAX SUMMER 2011 COMPETITION" page, located on the " RUNNING TRAX SUMMER 2011 COMPETITION " tab on the Ministry of Sound Australia page on Facebook (
www.facebook.com/MinistryofSoundAU). The page can be accessed directly at
http://www.facebook.com/MinistryOfSoundAU?v=app_10467688569. The entry must comply with the instructions highlighted format and resolution requirements as outlined in the "Instructions".
4. This competition is in no way sponsored, endorsed or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not Facebook. Any questions, comments or complaints should be directed to the Promoter and not Facebook.
5. Entrants agree to the following conditions:
1. The content of their Entry must be entirely created by the Entrant.
2. The Entrant must own all rights in the entry (copyright or otherwise), including, but not limited to, the right to adapt, distribute, reproduce, communicate, broadcast all content contained in the entry;
3. That their entry must not contain any content that may violate or infringe the rights (copyright or otherwise) of any third parties;
4. Upon submission of the Entry to the Promoter, any materials for the Competition, the Entrant, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees an exclusive, royalty-free, perpetual, worldwide, irrevocable, and licensable right to use, reproduce, modify, adapt, publish and display all or part of the Entry for any purpose in any media, without compensation, restriction on use, attribution or liability. The Entrant agrees not to assert any moral rights in relation to such use. The Entrant warrants that it has the full authority, and is under no restriction, to grant these rights.
6. The Entrant warrants and agrees that:
1. It will not submit any content included in the Entry that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
2. it will only submit an Entry which they have personally created;
3. their Entry, or content within such Entry shall not contain viruses or cause injury or harm to any person or entity;
4. it has and continues to comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computers or communication systems. Without limiting any other terms herein, they indemnify and hold the Promoter harmless, for any breach of the above terms of Clause 6.
7. This is a game of skill and chance plays no part in determining the winners.
8. There will be one winner of the competition. The winner will be determined by a Ministry of Sound Australia. The winner will be awarded a 12 Month Fitness First ‘Passport’ Membership, and a $100 Rebel Rebel Sport Gift Voucher.
9. All prizes are not transferable or exchangeable and cannot be taken as cash. In the event that any non-prize is unavailable, due to reasons beyond the control of the Promoter, the Promoter will offer an alternative prize of equivalent standard and specification.
10. In the event that the Promoter postpones or varies the Competition or Prize it shall not be liable to any person for any loss or damage (including loss or damage caused by the Promoter’s negligence) arising out of, or in connection with, the postponement or variation of the Competition or Prize. Nor will the Promoter be liable for any loss, damage (including but not limited to indirect or consequential loss) or personal injury suffered or sustained as a result of the judging, running or cancellation of the Competition or the Prize.
11. Any decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and will not be challenged on any grounds, including without limitation, the grounds that the Promoters failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles of procedural fairness. The Promoter’s decision will remain binding and conclusive notwithstanding that it can be demonstrated that the Promoter made a decision that was wrong or was based on a factual error or an irrelevant or irrational consideration. It is not the Promoter’s policy to enter into negotiations with competition entrants, prize winners who challenge a decision made by the Promoter.
12. The laws of Australia apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
13. The Promoter is Ministry of Sound Australia (ABN 106 918 601) of 3 Munn Reserve, Millers Point, NSW 2000.
14. In entering this competition, you grant MoS consent to use your personal information in accordance with these terms and conditions.
15. MoS will collect personal information about persons who enter this competition so that those persons can participate in the competition and MoS can administer the Competition. MoS will disclose that personal information to organizations associated with this competition. MoS may publish your name in connection with your Entry over its website, facebook, vimeo and over all other media and platforms. MoS shall also use your personal information to contact you in the event that you win this Competition. If you do not provide your personal information you cannot participate in the competition. The Promoter, may, for an indefinite period, unless otherwise advised, use the information provided for promotional and marketing purposes. Competitors can gain access to their personal information held by MoS by contacting Ministry of Sound at
info@ministryofsound.com.au. All personal information will be destroyed after the completion of the draw with the exception of personal information of winners which will be retained for the company’s future administration of the competition.
