Conditions of Entry
1. Entry is open to Australian residents over the age of 18.
2. Employees of Flight Centre Limited, Advance Traders (Australia) Pty Ltd, Subsidiary Organisations of these companies and immediate families of Flight Centre Limited, Advance Traders (Australia) Pty Ltd and Subsidiary Organisations of these companies are not permitted to enter.
How to Enter
3. To qualify for the draw, eligible persons must purchase a MERIDA Bike from any participating store, anywhere in Australia, visit
www.merida-winyourbike.com.au, follow the prompts to complete the online entry prize form and enter all the details requested. These details include full name, address, contact number, date of birth, the unique receipt number, purchase amount and date of purchase details from their receipt for their purchase made between 9:00am (AEST) Wednesday 1 December 2010 and 12:00 midnight (AEST) Monday 31 January 2011.
4. Only one entry is valid for each purchase.
5. All entry forms must be completed and submitted online before 12 midnight (AEST) Monday 31 January 2011.
6. Entrants must retain their receipt as proof of purchase. Winners may be asked to produce their receipt in order to claim their prize. Failure to produce the receipt which confirms their bike purchase may result in invalidation of the entry prize form and the forfeiture of any right to a prize. The imposition of this condition is at the full discretion of the promoter.
Details of Prizes
7. There will be one (1) automated prize draw, generating five (5) winners.
8. Each of the five (5) winners will receive up to a maximum of $5,000, dependant on the purchase value receipted and used for entry to the draw.
9. The sale value recorded on each of the five (5) winning receipts, up to a maximum of $5,000, will be paid by cheque to each of the five (5) winners.
10. The total available prize pool is valued at up to AUD$25,000.
11. All prizes are non-transferrable, non-refundable and non-redeemable for cash.
Duration of the Competition
12. The competition will commence at 9:00am (AEST) on Wednesday 1 December 2010.
13. The competition will close at 12:00 midnight (AEST) on Monday 31 January 2011.
Date, Time and Place of Draw
14. The competition will be drawn using an electronic drawing method supplied by randomizer.org.
15. There will be one (1) draw which generates the five (5) winners simultaneously.
16. The draw procedure will begin at 9:00am (AEST) at Advance Traders (Australia) Pty Ltd Head Office, 109c Links Avenue South, Eagle Farm, Queensland, on Wednesday 2 February 2011.
Notification of Winner
17. The winner will be notified by email within two (2) days of the draw.
18. Cheques for the refund amounts will be mailed directly to the prize winners by Friday 4 February 2011.
19. The winner consents to the use of their name, suburb of residence and image for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter.
20. The results of the promotion will be published in The Australian on Saturday 5 February 2011.
No Liability
21. To the extent permitted by law, the Promoter is not responsible or liable for:
i. inaccurate / incorrect transcription of entry information;
ii. purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions;
iii. any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
iv. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any Website;
v. unauthorised human intervention in any part of the competition;
vi. electronic or human error which may occur in the administration of the competition;
vii. any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or
viii. any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this competition.
22. The Promoter will not be liable for personal injury suffered during prize winnings. The winner, and his or her guests (if any), must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner.
23. This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
Unclaimed Prize Draw
24. If the prizes are not claimed within three (3) months of the draw, an unclaimed prize draw will be conducted on Wednesday 4 May 2011 at 9:00am (AEST) at Advance Traders (Australia) Pty Ltd Head Office, 109c Links Avenue South, Eagle Farm, Queensland.
25. Should an unclaimed prize draw be necessary, the winners of the unclaimed prize draw will be notified by telephone, and by a letter in writing.
26. Cheques for the refund amounts of any unclaimed prize draws will be mailed directly to the prize winners on Friday 6 May 2011.
27. The results of any unclaimed prize draw/s for this promotion will be published in The Australian on Saturday 7 May 2011.
Promotor's Details
28. The Promoter is Advance Traders (Australia) Pty Ltd ABN 21 130 664 194 located at 109c Links Avenue South, Eagle Farm. The personal information of entrants will be collected to enable the Promoters to administer and promote this competition and its winners and may be used to market its services to the entrant. The personal information of the entrants will be held and used in accordance with Advance Traders (Australia) Pty Ltd's privacy policy which is available at
www.merida-winyourbike.com.au. The personal information of winners may be provided to others assisting, including prize suppliers and deliverers, and to authorities that regulate this competition. If an entrant does not truthfully provide all requested personal information, the Promoter may determine that they are not eligible to win the prize.
