Terms & Conditions
This competition is a promotion run by Port Douglas Daintree Tourism Ltd of ABN 31 121 516916 of Shop 32a Meridien Marina Mirage, Port Douglas Qld 4877 (“Promoter”).
Information on how to enter and the prize forms part of these terms and conditions of entry (“Terms”). Entries not completed in accordance with these Terms are ineligible. Participation in this competition constitutes acceptance of these Terms.
Entry is open to residents from over the age of 18 years only. Employees of the Promoter and their immediate families are ineligible to enter.
Entry to the competition is available by registering for the Adventurous by Nature Holiday to Port Douglas campaign through social media, online and email communication. There is no limit to entry.
When entering the competition, entrants will be expected to provide their name and current email address. Entrants are also asked to join our (the Promoter’s) page on Facebook, which is optional. It is a condition of entry that entrants provide the email addresses of three (3) friends to whom an invitation to enter the competition.
The competition commences at 9.00am on 10 December 2010. Entry closes at midnight on 28 February 2011. The competition will be drawn at 10am on Tuesday 1st March 2011 at the Tourism Port Douglas Daintree office, Shop 32a Meridien Marina Mirage, Port Douglas Qld, 4877. The winner will be contacted by email. The winner will be announced on the Promoter’s social media channels including Facebook and Twitter and their website. Details of the winner will also be published in press releases.
In the event that a redraw is required it will be held at 10am on Wednesday 2nd March 2011 at the Tourism Port Douglas Daintree office, Shop 32a Meridien Marina Mirage, Port Douglas Qld, 4877
Incomplete entries will be ineligible.
All entries become the property of the Promoter. No responsibility is accepted for late, lost or misdirected entries.
The promoter takes no responsibility and assumes no liability for any content posted, stored or uploaded by an entrant or any third party for any loss or damage, mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, profanity or pornography encountered on the Adventurous by Nature Holiday to Port Douglas campaign website.
Any costs associated with accessing the Adventurous by Nature Holiday to Port Douglas website is the entrant’s responsibility and are dependent on the Internet service provider used.
The Promoter reserves the right to verify the validity of entries and reserve the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms. The Promoter reserves the right to reject any entry by automated process or by unreasonable means of any sort in its sole discretion and thereby reject any associated entry into the competition.
There will be one winner chosen at random from all eligible entries received. The Promoter’s decision is final and no correspondence will be entered into.
The winner and a friend will receive five (5) nights accommodation at Thala Beach Lodge for two (2) people; fifteen (15) minute scenic flight with Skysafari for two (2) people; Great Barrier Reef diving trip with Calypso Reef Cruises for two (2) people; Cape Tribulation and Daintree Tour with Daintree Discovery Tours for two (2) people; Kitesurfing lesson with Windswell Kitesurfing for two (2) people; two (2) nights accommodation at Ferntree Rainforest Lodge for two (2) people; Cape Tribulation Jungle Surfing Canopy adventure tour for two (2) people; Exotic Fruit tasting and farm tour at Cape Tribulation Exotic Fruit Farm for two (2) people; 4WD Bloomfield Track Waterfall Safari with Mason's Tours for two (2) people; Reef and Rainforest Horse riding tour with Ride the Beach Wonga Beach for two (2) people; Mossman Gorge guided rainforest walk with Kuku Yulanji Dreamtime for two (2) people.
Transfers and flights are not included as part of the Prize.
The total prize value is based on the recommended retail value of the Prizes as provided by the suppliers and is in Australian Dollars. The Prize is not transferable or exchangeable and may not be taken as cash or for any other consideration. The Promoter accepts no responsibility for any variation in the value of the Prize or any portion between the date of publication of these Conditions of Entry and the date the Prize is used by the winner. Prize components may alter at the discretion of the Promoter. The Promoter reserves the right to substitute with an alternative Prize or component of equal or greater value.
The Prize must be taken before 31 May 2011 and Prizes must be used within this timeframe. Prizes are ineligible for use after this timeframe. The Prizes are for the winner plus one person of their choice.
If for any reason this competition is not capable of running as planned for any reason including, but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of any of the Promoters, which corrupts or affects the administration security, fairness, integrity or proper conduct of this competition, the Promoters reserve the right in their sole discretion to take any action that may be available including cancellation, termination, modification or suspension of the competition.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or on any web site, or any combination thereof, including but not limited to any injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in or down-loading any materials relating to this competition.
The Promoter will not be liable for any loss or damage whatsoever which is suffered including, but not limited, to indirect or consequential loss or for personal injury which is suffered or sustained, as a result of taking or using the prize, except for any liability which cannot be excluded by law.
The information that entrants provide will be used by the Promoter for the purpose of conducting the competition, and of periodically providing entrants with marketing information about the Promoter products and services. By entering this competition entrants consent to the use of their contact details for the purposes described in this clause. The Promoter will not disclose entrant’s personal information to related entities or other appropriate third parties.
The Promoter makes no representations or warranties as to the quality, suitability or merchantability or any goods or services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner.
