1.   Instructions on how to enter form part of the conditions of entry into this competition (“Competition”). By participating in the Competition Entrants agree to be bound by these terms and conditions.
2.   The Promoter is MTV Networks Australia Pty Ltd of Ground Floor 4-16 Yurong Street, East Sydney, NSW 2010 ACN 107 601 418 (“Promoter”).
3.   Entry is only open to Australian residents aged 18 years or over (“Entrants").
4.   Employees (and their immediate families) of the Promoter, Sony Ericsson Mobile Communications
International AB (“Sony Ericsson”), suppliers and associated companies and agencies are not
eligible to enter either individually or as part of a group.
5.   The Promoter reserves the right to verify the validity of entries and to disqualify any Entrant who the
Promoter believes is a person described in paragraph 4 above, or who has manipulated, tampered with, or engaged in unfair practices relating to, the voting or competition process or has submitted an entry that is not in accordance with these terms and conditions.
6.   The Competition period commences at 9:01am (AEDST) on Saturday 11th December 2010 and closes at 11:59pm (AEDST) on Saturday 5 February 2011 (“Competition Period”)
7.   The finalists will be contacted by telephone by Monday 7 February 2011.
8.   The major prize winners will be notified by telephone by Monday 14 February 2011 and announced
to the general public by Sunday 27 February 2011.

9.   To enter, an Entrant must:
a)   choose a subject from 4 available blogging categories: music, film, fashion and technology (“Blogging Categories”);
b)   complete and submit an entry form (“Entry Form”) available at www.sonyericsson.com/bloggersearch including their name, address and phone details and answering in 100 words or less: “Tell us why you should be the Sony Ericsson Fashion, Music, Film or Gadget Blogger”;
c)   submit an image of themselves; and
d)   submit links to current blogs maintained by the Entrant (optional).

11. An Entrant may only submit one entry to the Competition per Blogging Category. If the Promoter believes that an Entrant has submitted multiple entries in any Blogging Category the Promoter may in its sole discretion disqualify all or some of the entries by that Entrant in any or all Blogging Categories.
12. The Promoter accepts no responsibility for any lost or misdirected entries, or entries not received for any reason by the Promoter during the Competition Period, or any delays in the delivery of entries for any reason.
13. Any information, photographs, audio-visual or other material provided to the Promoter by an Entrant as part on an entry to this competition will not be returned to Entrants. Entrants are advised to not send original material.
14. By submitting an entry the Entrants agrees that any tapes, files, disks, documents or other physical items included with your entry become the property of the Promoter.
15. By submitting an entry, the Entrant agrees (in consideration for the Promoter's review of the entry) that the Promoter has a non-exclusive and worldwide licence to use the entry (including all audio, visual or text) by way of any media for three years from the opening date for entries. Use of the entry may include, but is not limited to, publishing, performing in public, communicating in public and adapting the entry.
16. To the extent permitted by the law, the Entrant consents to the Promoter doing any act or omitting to do any act (including without limitation editing or adapting the entry) in respect of an entry that but for this consent would be an infringement of the Entrant’s moral rights in the entry. The Entrant also agrees to execute any document necessary to give effect to that consent.
17. By submitting an entry the Entrant warrants that it is the creator of the entry and that its entry does not breach any intellectual property rights of a third party.
18. The Promoter reserves the right, in its absolute discretion, to disqualify any entry which it considers depicts or encourages inappropriate, offensive or dangerous behaviour of any kind, or where the Promoter reasonably believes that the entry infringes another persons rights including without limitation intellectual property rights.
Competition Prizes
19. The top 3 Entrants (“Finalists”) from each of the four Blogging Categories will be chosen by a panel of judges representing the Promoter, and will be contacted by telephone no later than Monday 7 February 2011.
20. The twelve Finalists may each be required to sign a release warranting that they own or control all necessary rights in their entry necessary to allow the Promoter to exercise the rights referred to in these Terms and Conditions.
21. If a Finalist is at anytime unable or unwilling to provide any of the services required in accepting the Prize for whatever reason or if the Promoter believes that the Finalist does not hold all necessary rights in any entry, or if the Promoter believes that the Finalist has committed any act that would be detrimental to the Promoter, Sony Ericsson or any other person the Promoter may at its sole discretion revoke any Prizes awarded to that Finalist and re-award the prize to another Entrant.
22. The Promoter at its sole discretion may require Finalists to provide evidence that they hold sole and complete ownership of their entry.
23. The Finalists will be eligible for the prizes as set out in Clause 28 below. 24. Each of the Finalists will be required to participate in a Skype interview (“Interview”) with a panel of
judges representing the Promoter. The Promoter may record the Interview provided it notifies the Finalist of its intention to do so and the Finalist agrees that the promoter and Sony Ericsson may use the recording of the Interview by any media worldwide for the purposes of promoting the Competition, the Blogs (as defined below) and any subsequent competitions or promotions based on the Competition for a period of three years from the date of the Interview.
25. The Interviews will take place in the week commencing Monday 7 February 2011 between the hours of 10am and 4pm (AEDST). If any Finalist is unable or unwilling to participate in an Interview during this period at the time determined by the promoter the Promoter may at its sole discretion revoke any Prizes awarded to that Finalist and re-award the prize to another Entrant.
26. From the 12 Finalists, one major prize winner from each Blogging Category, being four major prize winners overall (“Major Prize Winners”) will be selected based on the content of their Entry and their performance in the Interview.
27. The 4 Major Prize Winners will win the prizes as set out below. Major Prize Winners of the Competition will be contacted by Monday 14 February 2011 (“Notification Date”), and announced to the general public by Sunday 27 February 2011.
28. Each Major Prize Winner will win:
•   3 x return economy class flights to Sydney, Australia from their nearest Australian state capital city, to be taken as directed by the Promoter – one flight will be to attend a training session, two flights will be to attend 2 blogger update sessions, as advised by the Promoter.;
•   1 x Photo shoot opportunity during training session to be held the week commencing Sunday 13 February 2011;
•   1 x Sony Ericsson XperiaTM handset – 1 of 4 x various models – Highest value handset will be Xperia X10 RRP $899
•   1 x prepaid SIM from Optus – value will not be unlimited, at Optus’s discretion - RRP •   1 x Mini WiFi Modem Starter Kit - RRP: $129
(Mini WiFi unit Terms - ^ Data is counted in 10 megabyte increments and includes uploads and downloads Modem is locked to the Optus network for a minimum of 12 months from activation unless you recharge to a minimum $100)
•   1 x Sony 15.5” VAIO E Series Notebook laptop RRP $1,099.00 •   Access to no less than two (2) events/exclusives relevant to each Major Prize Winner’s
Blogging Category; and •   $1,000 in prize money.
This is a money can’t buy opportunity.
29. Each Major Prize Winner will also be eligible for the Bonus Prize outlined in Clause 32. 30. As part of the Prize, Each Major Prize Winner will be expected to:
1.   Attend and participate in training to use Sony Ericsson Xperia phone to be held in Sydney; 2.   Maintain a dedicated blog (“Blog”) relating to the Blogging Category in which they have
been judged the winner. 3.   Submit at least one blog entry each weekday from Monday 28 February 2011 until Friday 20
May 2011, being a minimum total of 65 blog entries, to their Blog using their Sony Ericsson
Xperia phone. All blog entries must be made using the Sony Ericsson Xperia phone. 4.   Attend 2 x Sydney blogger update sessions on dates to be advised by the Promoter to film
blogger update spots. Each Major Prize Winner will be required to submit a subject and
outline of their update at least 3 days prior to these sessions.
31. The Major Prize Winners must be available to provide updates to their Blog and participate in any other promotional activities as reasonably advised by the Promoter between Monday 14 February 2011 and Monday 30 May 2011 (the “Prize Period”).
32. At the end of the Prize Period the Blogs will be judged by a panel of judges representing the Promoter and the Major Prize Winner who is judged to have submitted the most creative and comprehensive blog entries relating to their Blogging Category to their Blog during the Prize Period will be judged as the overall winner and will win an additional $2,000 (“Bonus Prize”).
33. The Promoter may record the training sessions and blogger update sessions provided it notifies the Finalist of its intention to do so and the Major Winner agrees that the Promoter and Sony Ericsson may use such recordings by any media worldwide for the purposes of promoting the Promoter, Sony Ericsson (and any Sony Ericsson product or service) the Competition, the Blogs (as defined below) and any subsequent competitions or promotions based on the Competition for a period of three years from the date of the Interview.
34. If the Promoter requires a Major Prize Winner to travel in order to participate in an element of the Prize during the Prize Period, the Promoter will, at its own expense, arrange travel and accommodation for that Major Prize Winner. For the avoidance of doubt, the Promoter will not be responsible for any travel that a Major Prize Winner undertakes of his or her own accord during the Prize Period.
35. Each Major Prize Winner will be required to enter into a services agreement with the Promoter and/or Sony Ericsson within 2 weeks of announcement of the Major Prize Winners. If a Major Prize Winner fails to enter into a services agreement with Promoter for the Services within two (2) weeks of the Notification Date, the Promoter may at its sole discretion revoke any prizes awarded to that Major Prize Winner and re-award those prizes and the title of Major Prize Winner to a different Finalist.
36. The Promoter reserves the right to suspend a Major Prize Winner’s access to the Blog or revoke the prize in its entirety if a Major Prize Winner fails to meet any obligations and requirements set out in the services agreement and these terms and conditions.
37. Where a Major Prize Winner has their prize revoked in accordance with this Agreement, the Promoter may, at its sole discretion, re-award the prize to a different Finalist but will be under no obligation to do so and will have no further liability to the first selected Major Prize Winner.
General Conditions
38. The judges' decision is final and no correspondence will be entered into. 39. The Promoter will not be responsible for any change in the value of a prize. The Promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
40. All prizes are non-transferable and cannot be exchanged for cash. 41. To the fullest extent permitted by law, the Promoter and its related bodies corporate shall not be
liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the Competition or any prize.
42. If any prize, or part of any prize, is no longer available, the Promoter, in its discretion, reserves the right to substitute the prize, or that part of the prize, with a prize of equal value.
43. Where applicable, winners should look to the prize manufacturer should they seek to enforce any manufacturers warranties relating to the prize. However, nothing in these terms and conditions attempts to exclude or limit the application of any statutory warranty under the Trade Practices Act 1974 (Cth) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
44. In the event of war, terrorism, state of emergency or disaster, or other force majeure event the Promoter reserves the right to cancel, terminate, modify or suspend the Competition at its discretion.
45. The Promoter assumes no responsibility for, and the Entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the Entrant's participation in this Competition or the conduct of the Competition generally or as a direct or indirect result of an Entrant's error, any technical problem of any kind including communications or network failure, unauthorized access to, transferring or theft of data, whether caused by the Entrant or associated with the equipment or programming used in the conduct of this Competition. If, because of any such problem, this Competition is not able to be conducted as planned and/or the Competition's administration, security, fairness or integrity are compromised or affected, the
Promoter may cancel, terminate, modify or suspend the Competition and/or disqualify any Entrant
involved in interfering or tampering with, the conduct of this Competition in any way. 46. Any costs associated with entering the Competition and accessing the website are the responsibility
of the Entrant. Any contact details entered incorrectly on the website shall be deemed invalid. All entries are deemed to be received at the time of receipt by the Promoter NOT the time of sending by the Entrant.
47. By entering the Competition, unless otherwise advised by the Entrant, each Entrant consents to the information they submit with their entry being entered into a database. All personal details of the Entrants provided by entering the Competition will be stored at the office of the Promoter. A request to access, update or correct any information should be directed to that office. See www.mtv.com.au to view the Promoter’s privacy policy in full. The Promoter will only use your personal details for marketing purposes in the future if you "opt in" to receiving marketing updates when prompted.
