1.Information on how to enter and prizes form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry. Entry is via SMS.
2.Entry is open to all Australian residents. Directors and employees (and their immediate families) of the Promoter, participating outlets and any of their agencies associated with this Promotion are ineligible to enter. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
3.The Promotion commences on 29/11/10 at 00:01 (AEDST) and concludes on 24/12/10 at 23:59 (AEDST) ("Promotion Period"). Entries will be deemed to be accepted at the time of actual invoice by the Promoter and not at the time of submission by the entrant. No responsibility will be accepted for lost, late, incomplete, incorrectly submitted, misdirected or redirected entries.
4.To enter, individuals must spend $50 or more in the one transaction at any participating Autobarn store during the Promotion Period, then send an SMS containing their full name, address and postcode (Castrol customers to also include the last 4 digits of the Castrol product barcode to receive their bonus entry) to 1978 2777 (SMS cost is 55c. Entrants must have premium service access. SMS entrants under 18 years old must obtain account holder’s consent. SMS helpline: 1800 205 596). Entrants will receive a reply message confirming their entry in the prize draw. All entrants must retain their Autobarn purchase receipt(s) or a copy of as proof of purchase. Illegible, late or incomplete entries will be invalid and therefore ineligible to enter the Promotion or win a prize.
5.Entrants who have purchased any Castrol product within their $50 or more transaction at any participating Autobarn store will also be awarded 1 bonus entry into the draw. Bonus entries will be automatically rewarded.
6.The SMS entry mechanic is only open to individuals with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account will be deemed to be invalid and will not be accepted.
7.All entries received during the Promotion Period will be entered into the Major Prize Draw.
8.Multiple entries from the same person will be accepted but each entry must relate to a separate Autobarn purchase transaction, which has not previously been the subject of an entry in the Promotion. Each entry must be sent via a separate SMS.
9.A maximum of 5 entries will be permitted per day.
10.Each entrant must retain a copy of their Autobarn store receipt(s) in respect of each entry made, and upon request, present them to the Promoter as proof of their purchase. Proof of purchase should be retained until after the unclaimed prize draw date as set out in Condition 23. The Promoter reserves the right, in its absolute discretion, to validate and check the authenticity of any prize claim or entry before awarding a prize, and, at its absolute discretion, to disqualify any entrant not able to produce, upon the request of the Promoter, a copy of store receipt(s) as proof of purchase in respect of any entry.
11.Entrants can only enter in their own name. The Promoter reserves the right to confirm and verify the identity of a winning entrant, by requesting the winning entrant to provide proof of age, proof of identity and proof of residency. Identification considered suitable is at the Promoter's absolute discretion. The Promoter reserves the right, in its absolute discretion, to disqualify any entrant for failing to comply with any of these Conditions of Entry in good faith.
12.If a drawn entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and the next drawn entry that does comply with these Conditions of Entry will be awarded the prize. The judges' decision is final and no correspondence will be entered into.
13.The Prize Draw will take place at 14:00 (AEDST) on 05/01/11 at Level 22, 385 Bourke Street, Melbourne VIC 3000.
14.Major Prize: The first valid entry drawn will win a Ford FG Falcon XR6 Euro4 Sedan, 4.0 Litre, 6 Speed Automatic vehicle (Model: 18135HA), Including all on road costs and delivery to winners nearest Ford dealership, vehicle colour to be selected by the Promoter and is not negotiable. Prize valued at up to RRP $41,500 (including all on road costs).
If the winner of the car is under the age of 18 as at the date of the draw, the vehicle will be transferred into the name of the winner’s parent or guardian until the winner turns 18 years of age. If the winner of the car does not have a driver’s licence, as at the date of the draw, the vehicle will be transferred into the name of a (licence holding) person nominated by the winner.
Comprehensive insurance, additional options and all ancillary costs (including travel to and from the dealership) are the responsibility of the winner. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
15.Runner Up Prizes: The next two (2) valid entries drawn will each win a Pioneer Blu Ray Home Theatre System (Model Number: STUDIO3), valued at RRP $5,000 each.
16.Minor Prizes: The next ten (10) valid entries drawn will each win an Autobarn Gift Card (Autobarn Gift Cards are subject to their own set of terms and conditions), valued at $500 each.
17.Total prize pool is valued at up to $56,500.
18.Winners will be contacted by telephone within 2 business days and notified by mail within 5 days after the prize draw and their name published in The Australian newspaper on 13/01/11.
19.If the winner of a prize is under the age of 18 years, the prize will be awarded to a parent or guardian of the winner.
20.Prizes are not transferable or exchangeable and cannot be taken as cash. All prize values stated are in Australian Dollars (AUD) and are correct at the time of printing. Tax implications may arise for the winners from the prize winnings. Independent financial and/or taxation advice should be sought. The Promoter accepts no responsibility for any tax implications that may arise for the winner.
21.Winners will receive their prize within 28 days after the draw date. Prizes will be delivered to each winner's residence upon confirmation and validation of their proof of purchase (such confirmation and validation will be at the Promoter's absolute discretion).
22.The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained, as a result of an entrant accepting a prize, except for any liability which cannot be excluded by law.
23.The Promoter may conduct such further draws as are deemed necessary at the same time and place as the original prize draw on 07/04/11 in order to distribute any prize unclaimed by that date, subject, however, to any written directions given under any State regulations and, where applicable, any prize winner(s) will be notified by mail and their name(s) will be published in The Australian newspaper on 14/04/11.
24.The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
25.If for any reason this Promotion is not capable of running as planned, including, but not limited to, due to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval or any written directions given by the relevant State government authorities.
26.All entries become the property of the Promoter. The information provided by entrants will be used by the Promoter for the purpose of conducting the Promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting the Promotion or communicating with entrants, and to State and Territory gaming authorities where required to do so.
