Bonjour Baby Giveaway Terms and Conditions
Information on how to enter and prizes form part of these Terms and Conditions. Entry to competition is free and constitutes acceptance of these Terms and Conditions.
Bonjour Baby Pty Limited (ACN 139 260 816) of PO Box 1263 Potts Point NSW 1335 is the promoter of the Competition (the "Promoter")
Entry is only open to Australian residents and members of the Bonjour Baby Site (the "Site"). Employees (and their immediate families) of the Promoter, participating retailers on the Site and agencies associated with this promotion are ineligible to enter.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
To be eligible to enter, participants must fully register their details from the Bonjour Baby website:
www.bonjourbaby.com.au, and complete the prize section.
Entrants can only enter in their own name. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the winner's identity, age, residential or email address, eligibility to enter and claim a prize and any information submitted by each winner in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter's satisfaction within the time requested, the winner's entry will be deemed invalid.
Multiple entries are permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Incomplete, incomprehensible and illegible entries will be deemed invalid. This is a game of skill and chance plays no part in determining the winner(s). Each entry will be individually judged based on the literary and creative merit of the answer provided to the question. The judge's decision is final and no correspondence will be entered into. Prizes are not exchangeable or transferable for cash.
Each Promotion commences on the first day of a calendar month and ends on each last day of that calendar month (each a "Promotional Period"). All entries must be received by 11:59pm Sydney, NSW time on the last day of each Promotion Period. Judging of the contest which will take place at the Promoter's office in Sydney NSW the first business day of each new month at 3:00pm Sydney, NSW time. Winners will be notified by telephone and/or email. In some instances, the winner's names will be published in newspapers.
Consent of parent or guardian should be obtained where a minor may be a participant in the competition. If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parents or guardian.
Prizes will be finalised and determined at the Promoter's sole discretion.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that prize or element of the prize.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
PRIZE DETAILS: The best entry as determined by the judges will win the prize. The details of the prize are available when you register for the competition.
Prizes are not transferable, exchangeable or redeemable for other prizes or cash. If any prize (or any part of any prize) is unavailable for any reason, the Promoter may in its sole discretion, reserve the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification.
Bonjour Baby will retain the prizes until the winner claims them. In the event that the prizes are unclaimed one (1) week after notification of the winner by email to the email address used for entry to the competition, Bonjour Baby will select the second best entry for the disposal of the unclaimed prize (as under Regulation 37 of the Lottery and Gaming Regulations, SA) and notify this second best winner by email on the 15th of each calendar month.
These terms and conditions are governed by the laws of NSW Australia. By entering the contest, the participants accept these Terms and Conditions. The participant's entry will be deemed void where it does not comply with any of these Terms and Conditions.
Privacy Policy
All entries become and remain the property of the Promoter. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter.
