TERMS AND CONDITIONS OF ENTRY
‘Win a SpongeBob prize pack, thanks to Nickelodeon’
1. Information on how to enter and prizes forms part of these conditions of entry. Entry is open to all residents of Australia who subscribe to FOXTEL magazine. Employees of the Promoter and their immediate families and agencies associated with this promotion. To enter simply email your completed entry to

Substv@acpmagazines.com.au and in the body of the email provide your full name, address, contact phone number and answer the following question, in 25 words or less, “Who is your favourite SpongeBob SquarePants character and why?” (the “ENTRY QUESTION”). This is a game of skill and chance plays no part in determining the winner. This promotion will be judged by a panel of judges appointed by the Promoter. Judging will take place at 66-68 Goulburn Street, Sydney, NSW 2000. Judging will begin on 7th February 2011. The winners name will be published on
www.foxtel.com.au/whats-on/competitions. Judges' decision in relation to all aspects of this promotion is final and binding on all who enter no correspondence will be entered into.
3. Only one entry per person permitted.
4. The 4 best entries, as determined by the judges, will each win a prize pack valued at $50.87. Each prize pack consists of 1x SpongeBob SquarePants “To Love a Patty” DVD, 1x SpongeBob Notebook, 1x Nickelodeon Cap, 1x Nickelodeon Blimp Key ring and 1x Nickelodeon Drawstring Bag.
5. Total prize pool valued at $203.48. Prize does not include any ancillary costs associated with redeeming the prize, these are the responsibility of the winner. Selection of items awarded to the winner in any of their prize winning prize pack (including but not limited to colours, designs, style, size and material) will be determined by the Promoter in its complete discretion. Prizes valued in Australian dollars. Prize values mentioned are the recommended retail value as provided by the supplier and are correct at time of printing
6. Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter is neither responsible nor liable for any change in value of a prize occurring between the publishing date and the date the prize is claimed.
7. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/or (g) redemption of a prize
8. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
9. The Promoter accepts no responsibility for late, lost or misdirected mail.
10. Winner will be notified by phone and mail using contact details provided in their entry.
11. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this promotion is governed by the Privacy Notice (see contents page for location in each issue).
