(The T&Cs say the winner will get a '6 share hire van'. Does that mean you get a minivan and have to share it with others, possibly other prize winners?)
CONDITIONS OF ENTRY
NASR’s Speedway Competition (“Promotion”)
National Association of Speedway Racing (“NASR”) (“Promoter”)
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry must be made via SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phone. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure.
2. Entry is open only to all Australian residents aged 18 years or over, except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies or companies associated with this competition.
3. The promotion commences at 12.01am (AEDST) on 20/11/10 and closes at 11.59pm (AEDST) on 27/02/11 (“Promotion Period”). All entries must be received during the Promotion Period.
4. To enter competition, participants will be required to attend a WSS or NSSS event at a speedway venue within Australia during the Promotion Period and then locate the ‘codeword’ advertised on the promotional posters and flyers displayed around the venue they are attending. Participants must then text the codeword together with their full name and email address to 199 97 007 eg: “CODEWORD” [space] “ENTRANT’S NAME” [space] “EMAIL ADDRESS”
5. Maximum SMS entry cost is $0.55 (including GST).
6. A reply SMS will be sent to each entrant immediately after a valid entry submission confirming that their entry has been successfully received. If an entry is not successful because it is not in the required format, mandatory entry fields are not completed, or code word submitted is invalid the entrant will be prompted to submit their entry again. In the event of an invalid SMS entry, if the entrant elects to resubmit their SMS entry, the entrant will be charged an additional $0.55 cents (including GST). SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Entrants must have the bill payer’s permission to enter the promotion or their entry will be invalid.
7. Participants may enter multiple times during the Promotion Period. The Promoter reserves the right to verify the validity of entries. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
8. Entrants can only enter in their own name. Entrants who enter using multiple names, phone numbers, email addresses or aliases may be disqualified. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, that the entrant obtained the bill payer’s consent to enter before submitting their entry/entries (if applicable), that the entrant has a clear relationship with the end mobile device used to enter via SMS (if applicable), and any information submitted by the winners in entering the promotion before issuing the prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
9. The prizes to be won in this competition are as follows:
MAJOR PRIZE:
The first valid entry randomly drawn in the Major Prize Draw will win a trip for two (2) people to the 2011 Speedway Star USA Tour. The Major prize includes; a 23 day tour for two (2) people, two (2) return economy airfares from Sydney airport to Los Angeles (LAX airport) (domestic flights will be included if a winner resides outside of Sydney), 23 night twin share accommodation, tickets for four nights at Knoxville Nationals and rental van (six share) for the duration of their stay. Total Major prize value is up to $13,000 AUD (including GST). MINOR PRIZES
The next valid entry randomly drawn in the Minor Prize Draw will win one (1) x V68 Series 32in (81cm) FULL HD LCD TV (HL81V68P), valued at $1,199 AUD (including GST)
The next valid entry randomly drawn in the Minor Prize Draw will win one (1) X-Box 360 Arcade Console, valued at $315.00 AUD (including GST)
10. The Major and Minor Prize Draws will commence at 11:00am (AEDST) on 02/03/11 at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade, Cremorne VIC 3121. All winners will be notified by telephone on 04/03/11 and by mail within 2 days of the draw. Winner’s names will be printed in The Australian newspaper on 11/03/11. All reasonable steps to notify the winner of the results of the draw will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
11. In respect of the Major Prize:
a.
If the Major winner resides outside of NSW, the winner and their companion will be provided with domestic flights from their nearest capital city to Sydney airport. b.
The winner and guest, are responsible for all other expenses including spending money, meals, drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. c. The winner and guest must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure.
d.
The Major Prize must be taken approximately 25/07/11 to coincide with the 2011 Speedway Star Tour event. In the event the winner is unable to travel during this time they can nominate a friend or relative to accept their prize on their behalf. The prize winner must notify promoter before booking arrangements have been made.e. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
f. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
g. No refund or credit to be given for any unused portion of this prize. The prize is transferable and cannot be sold or redeemed for cash.
h. The Promoter will not be responsible for any changes in times or dates, or cancellations or rescheduling of events that may prevent the prize winner from redeeming the prize or any part of it.
i.
Passport & Travel Insurance is required to be held by all Speedway Tour travellers and is not included in the prize.12. In respect to Minor Prizes prizes:
a. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
13. The Promoter, National Association of Speedway Racing Pty Ltd and other agencies associated with this promotion make no representation as to the safety, conditions or other issues that may exist at any destination.
14. The total promotional prize pool is valued at up to $14,514 (RRP including GST). All prices quoted are current and valid as at 20/09/10. Prizes must be taken as offered and cannot be varied. A prize or any unused portion of a prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
15. Major Prize second chance: If the Major Prize is unclaimed or the winning entrant is unable to satisfy these Terms and Conditions by 5:00pm (AEST) on 13/5/11, then a second chance prize draw will take place to distribute the prize at 11.00am (AEST) on 16/05/11 at the same address as the original prize draw. In the event of a second chance prize draw, the winner will be notified by mail and by telephone and their name and postcode published in The Australian newspaper on 20/05/11. Minor Prize second chance: If the minor prizes are unclaimed or the winning entrant is unable to satisfy these Terms and Conditions by 5:00pm (AEST) on 3/6/11, then a second chance prize draw will take place to distribute the prize at 11:00am (AEST) on 6/6/11 at the same address as the original prize draw. In the event of a second chance prize draw, the winner will be notified by mail and by telephone and their name and postcode published in The Australian newspaper on 13/6/11.
16. If any prize or any element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions under State or Territory legislation.
17. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
18. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved
19. Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded. Printing or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.
20. Caution: any attempt to cause malicious damage or interference with the normal functioning of the SMS applications or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.
21. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
22. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
23. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received.
24. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
25. The winners agree to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any release document provided by the Promoter, in its absolute discretion. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. The Promoter also may: (a) use the information to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages; and (b) share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way, should you not opt-out of receiving such information. To opt-out, participants must send ‘Stop’ to 199 97 007 or contact support on 1300 737 728. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
