CONDITIONS OF ENTRY
“MCDONALDS® MIGHTY ME, MIGHTY US® 2011 “BE YOUR LOCAL HERO
HAPPY MEAL PROMOTION”
GAME OF SKILL
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via mail and internet only.
2. Entry is open to residents of Australia. Entrants under 18 years of age must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about them. All entries of entrants who are under the age of 18 years and enter the promotion without disclosing (or who attempt to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required) will be deemed invalid. The Conditions of Entry will bind the entrants and any parent or legal guardian who gives their consent (for entrants aged 18 years and under). The directors, management and employees (and their immediate families, including their children and wards) of the Promoter, its related entities, corporations or franchisees, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.
3. Promotion commences at 12.01 am (AEST) on 06/01/2011 and closes at midnight (AEST) on 06/04/2011 (“Promotional Period”). No entries sent by post will be accepted by the Promoter after last mail on 15/04/2011.
4. To enter the promotion, eligible entrants must, during the Promotional Period, purchase a Happy Meal at a participating McDonald‟s restaurant and either:
a) log on to www.happymeal.com.au (“Promotional Website”) and fully complete and submit the online entry form including entering the code found on the „Be Your Local Hero‟ Happy Meal box; OR
b) cut out and fully complete the entry form coupon provided on the „Be Your Local Hero‟ Happy Meal box, attach the completed entry form coupon to a separate piece of paper that has their response to the question in condition 5, and send both in a stamped envelope addressed to: McDonald‟s „Local Hero‟ Competition, PO Box 97, Pennant Hills NSW 1715.
5. In order to fully complete their entry, eligible entrants will be required to provide a response in 100 words or less by explaining “How the $5000 grant will make a difference in your local community”.
6. Any costs associated with accessing the Promotional Website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the Promotional Website shall be deemed invalid and will result in an ineligible entry.
7. Multiple entries are permitted. However, each entry must be submitted separately and must independently comply with these Conditions of Entry. The entry form submitted by post must be an original and photocopies or images of entry forms will not be accepted. The same 100 word or less response cannot be used in more than one entry and multiple entries by entrants must be substantially unique. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, illegible or incomprehensible entries will be deemed invalid. Internet entries will be deemed to be accepted at the time of receipt and not at the time of transmission. The Promoter accepts no responsibility for late, lost or misdirected entries.
8. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter‟s sole discretion and no correspondence will be entered into.

9. The prize judging will take place at 10.00 am (AEST) on 24/06/2011. All eligible entries received will be judged by a panel of judges. Each entry will be judged on the basis of uniqueness, creativity, and the belief of the judges that the grant will contribute to the relevant community and also the extent to which the community group requires the grant. Chance plays no part in determining the winners. Prize winners‟ details will be published on 5/11/2011 at www.happymeal.com.au. All winners will be notified by telephone and mail (or email if provided). All reasonable steps to notify winners of the results of the judging will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
10. For the purpose of this promotion, an eligible community group is a registered and/or verifiable local community organisation that benefits and contributes to the local community for public good e.g. school, sporting, not-for-profit or charitable activities. It does not include professional sporting, political, or other groups which the Promoter may determine, at its sole discretion, are involved in the conduct of activities that may offend prevailing community standards. The Promoter at all times and in its sole discretion, may determine the eligibility of a community group with regards to: the nature of the activities, the structure and any other considerations determined by the Promoter in its sole discretion.
11. Community grants will be awarded to the community group nominated in an entrant‟s entry based on the location of the community group as follows:
a) QUEENSLAND/NORTHERN TERRITORY: The five community groups nominated in the five best valid entries judged to be the best in QLD/NT will each receive a $5,000 community grant; and
b) NEW SOUTH WALES/AUSTRALIAN CAPITAL TERRITORY: The five community groups nominated in the five best valid entries judged to be the best in NSW/ACT will each receive a $5,000 community grant; and
c) VICTORIA/TASMANIA: The five community groups nominated in the five best valid entries judged to be the best in VIC/TAS will each receive a $5,000 community grant; and
d) WESTERN AUSTRALIA: The five community groups nominated in the five best valid entries judged to be the best in WA will each receive a $5,000 community grant; and
e) SOUTH AUSTRALIA: The five community groups nominated in the five best valid entries judged to be the best in SA will each receive a $5,000 community grant; and
f) Total maximum prize pool value is $125,000. Prizes will be awarded in the form of a cheque in the name of the community group. Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
12. Entrants can only enter in their own name. The Promoter reserves the right to request an entrant to produce (within the requested time) appropriate photo identification or any other documentation (to the Promoter‟s satisfaction at its sole discretion) in order to confirm the entrant‟s identity, age, residential address and email address, eligibility to enter the Promotion and any information submitted by the entrant in entering the promotion (including, where a winner is under 18 years of age, consent of a winner‟s parent or legal guardian and also the name, age and address of the parent or legal guardian that gave their consent) before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant‟s eligibility has not been verified or validated to the Promoter‟s satisfaction within the time requested, the entry will be deemed invalid. A prize will only be awarded following any winning entrant‟s validation and verification that the Promoter requires in its sole discretion.

13. An entrant must retain and may be required to present the „Be Your Local Here‟ Happy Meal box for each entry submitted. If an entrant is unable to provide a „Be Your Local Hero‟ Happy Meal box for every entry, within the required timeframes, then all the entries of that entrant may be ineligible and deemed invalid.
14. The Promoter reserves the right to request any nominated community group to produce (within the requested time) appropriate identification or any other documentation (to the Promoter‟s satisfaction at its sole discretion) in order to confirm and verify the community group‟s eligibility to claim a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning community group‟s eligibility (as determined by the Promoter in its sole discretion) has not been verified or validated to the Promoter‟s satisfaction within the time requested, the entry will be deemed invalid. A prize will only be awarded following any winning community group‟s validation and verification that the Promoter requires in its sole discretion.
15. The Promoter may award a prize to the next best judged entries at 10:00 am on 04/10/2011 in order to award a prize if a prize remains unclaimed by that date or is not accepted, in writing, by a community group. If this occurs, prize winners‟ details will be published on 31/01/2011 at www.happymeal.com.au. All winners will be notified by telephone and mail (or email if provided). All reasonable steps to notify winners of the results of the judging will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into. The winner/s will be notified by telephone and mail.
16. The Promoter, its franchisees and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its associated agencies and companies accept no liability for prizes lost or damaged in transit.
17. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for: a) tampering with the entry process; or b) for submitting an entry which is not in accordance with these Conditions of Entry; or c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter‟s legal rights to recover damages or other compensation from such an offender are reserved.
18. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
19. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
20. The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
21. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion.

22. Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
23. As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner and also to procure the participation and use of the relevant community group‟s name (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
24. An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the entrant in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant cannot participate in the promotion. By participating in the promotion and opting in on the entry form, an entrant also acknowledges that a further primary purpose for collection of the entrant‟s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the entrant in the future with information on special offers or provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the entrant with special offers in this way. By entering the promotion and opting in on the online entry form, each entrant agrees that the Promoter may use entrants‟ personal information in this manner. Entrants can also gain access to, update or correct any personal information by contacting the McDonalds Privacy Officer by mail at PO Box 392, Pennant Hills NSW 2120. All personal information will be stored at the office of the Promoter. A copy of the Promoter‟s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter or by clicking on the Privacy Policy link on www.happymeal.com.au.
25. The Promoter is McDonalds Australia Limited, ABN 42 008 496 928, of 21 – 29 Central Avenue Thornleigh NSW 2120.
