Win a Family Holiday

Thanks to Queensland Tourism and Sony Pictures, BigPond Movies is offering the chance to win a family holiday to Queensland to celebrate the release of Grown Ups. The prize, valued at more than $6,000, includes return airfare to the Gold Coast, car hire, five nights accommodation at Q1 Resort and Spa, and VIP passes to Sea World, Warner Bros Movie World and Wet 'n' Wild Water World.

Terms and Conditions of Entry for the BigPond® Movies Grown Ups Promotion (“Promotion”) 1. Information on how to enter and prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry. 2. The promoter is Telstra Corporation Limited ABN 33 051 775 556 of 400 George Street, Sydney, NSW, 2000 ("Promoter"). 3. The Promotion will be open from 10:00 am Australian Eastern Daylight Standard Time ("AEDST") on 5 January 2011 and will continue until 11:59 pm AEDST on 26 January 2011 ("Promotion Period"). 4. Entry is open to all Australian residents other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with the Promotion (including suppliers of prizes), and their immediate families ("Eligible Entrants"). Entry 5. To enter and be eligible to win, Eligible Entrants must, during the Promotion Period: a) go to the BigPond Movies website, located at www.bigpondmovies.com (“Website”); b) click on the “Grown Ups BigPond Movie” competition link; c) answer the following question in 25 words or less, “What element of being a ‘grown up’ is over rated and why?”; d) complete all of the required entry details including full name, street address, phone number and email address ("Eligible Entry"). 6. Only one entry per Eligible Entrant will be accepted. All Eligible Entries received during the Promotion Period will be assessed in the judging process. Minors 7. If an entrant is under 18 years, they must have their parent or guardian's consent to enter this promotion. The Promoter reserves the right to request this consent in writing. 8. A parental or guardian consent referred to in these terms must: (a) consent to the matters referred to in these terms and conditions; and (b) include the words "in consideration of Telstra agreeing to admit the entrant into this Promotion, [name of Parent or Guardian] agrees to be bound by the terms of entry into the Promotion". Prizes 9. Judging of all Eligible Entries received during the Promotion Period will take place on 31 January 2011. The judging will take place at Level 3, 400 George Street, Sydney NSW 2000. Judging will be conducted by a representative of the Promoter. This is a game of skill only and chance plays no part in determining the winner. 10. The Eligible Entrant with the most creative answer to the Entry Question, as determined by the judge in their sole discretion, will each receive from the Promoter a Family Vacation package to the Goldcoast, Queensland, valued at up to $6,140.00 consisting of: (a) return economy class airfares for four people from the winner’s nearest Australian capital city to Coolangatta, Queensland, valued at up to $3,512.00 (inc GST) (unless the winner is located within 5 hours driving time from the Gold Coast, in which case this component of the Prize is forfeited); (b) five nights accommodation for four people in a 2 bedroom apartment at Q1 Resort and Spa, Goldcoast, Queensland, valued at up to $1,380.00 (inc GST); (c) four VIP passes to the Village Roadshow Theme Parks, which includes unlimited entry to Sea World, Warner Bros. Movie World and Wet ‘n’ Wild Water World (“Parks”), valued at $396.00 (inc GST) and; (d) six days car hire in an automatic 4 door sedan, valued at up to $852.00 (inc GST), (“Major Prize”). 11. The Eligible Entrants with the second to sixteenth most creative answers to the Entry Question, as determined by the judge in their sole discretion, will each receive from the Promoter a ‘Grown Ups’ prize package, valued at $27.85 (inc GST) consisting of: (a) 1 x “Grown Ups’ Micro Basketball set which includes a blackboard, hoop and mini basketball, valued at $2.85 (inc GST) (b) 1 x ‘Grown Ups’ T-shirt, valued at $15.00 (inc GST) (c) 1 x ‘Grown Ups’ Baseball Cap, valued at $10.00 (inc GST) (“Runner-Up Prize”) 12. The Prize winners will be notified by email on 1 February 2011. The Prize winners’ names will be published on the Website by 2 February 2011. 13. Any Prizes which have not been claimed by 28 April 2011 will be distributed at the Promoter's absolute discretion. General 14. The total Prize pool value is up to $6,557.75 (inc GST). 15. The VIP passes do not include entry to special events conducted outside advertised Park trading hours or entry to the Sea World Resort Water Park, Sea World Helicopters or Sea World Animal Adventures. Standard ticket terms and conditions also apply to the VIP passes and may be subject to change. The terms and conditions which apply to use of the VIP passes at the time it is issued to the Major Prize winner and their guests will prevail over these terms and conditions, to the extent of any inconsistency. 16. All other costs associated with the Major Prize are the responsibility of the winner and their guests, including but not limited to, travel arrangements to and from the Major Prize winner’s nearest capital city airport, spending money, meals, drinks, incidentals, mini bar, in-room services, activities, travel insurance and taxes. 17. The components of the Major Prize are valid for use between 17 January 2011 and 30 June 2011 only. Flights, accommodation and car hire are subject to availability at the time of booking. The Major Prize winner and their guests must travel on the same flight to and from Coolangatta, Queensland (unless the winner is located less than 5 hours driving time from the Gold Coast, in which case this component of the Major Prize is forfeited in accordance with clause 10(a)). It is a condition of taking the Major Prize that the winner must take out appropriate travel insurance prior to travel. 18. The Major Prize and Runner-Up Prizes are not transferrable or exchangeable and are not redeemable for cash. 19. The Runner-Up Prizes will be sent to the winners. 20. The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or tampered with in any way before it reaches the winner. 21. The Promoter accepts no responsibility for any variation in the value of a Prize. 22. If the Promoter is unable to provide a winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value. 23. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times. 24. If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations. 25. The judge’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. Incomplete, illegible or incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way will be ineligible to win. 26. By entering the Promotion, the entrant and their parent/guardian if they are under 18 understands and agrees that the Promoter may use and disclose the information provided by the entrant on the terms and for the purposes (including marketing) set out in the Promoter’s Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059, as if they were a customer of the Promoter. The entrant agrees that the Promoter can continue to contact them even after this Promotion ends. If the entrant would like to access or correct the personal information that the Promoter holds about the entrant, or if the entrant does not wish the information to be disclosed, the entrant should advise the Promoter by phoning 1800 039 059. 27. By entering into the Promotion, the entrant and their parent/guardian if they are under 18 years of age agrees and acknowledges that: (a) they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of them; (b) the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to them; (c) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same; (d) they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose; (e) they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights"); (f) they waive all Moral Rights in the Materials that arise outside Australia; and (g) they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials. 28. To the extent permitted by law, the Promoter, its advertising and promotion agencies and all entities providing prizing in this Promotion shall not be liable for any loss, damage or injury whatsoever (including but not limited to direct, indirect or consequential loss or damage) or personal injury suffered or sustained in connection with participation in this Promotion and/or use of any Prize. 29. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize.
