   1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry must be made via Internet or SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phones. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure.

   2. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.

   3. Entry into the promotion is open to Australian residents aged 18 years or older who purchase any Streets Ice Cream from a Participating Store in Victoria during the Promotion Period. Employees and directors of the Promoter and their immediate families, suppliers, providers and agencies associated with this promotion are ineligible to enter. Entrants must be identified as having a clear relationship with the end mobile device (evidenced by entrants entering by an SMS message originating from an MSISDN that identifies the entrant) and have the bill payer’s consent to enter by SMS.

   4. The promotion commences at 12:01am (AEDST) on 10/01/2011 and closes at 11:59pm (AEDST) on 25/02/11 (Promotion Period).

   5. To enter the promotion, an eligible entrant must purchase any two (2) Streets Ice Creams from a Participating Store in Victoria during the Promotional Period. Eligible entrants will receive a scratch ticket at the point of purchase which will have a unique code printed under the silver latex panel. Eligible entrants must then, during the Promotional Period enter by one of the following methods:

               1. send an SMS in the required format to 199 98 800. The required SMS format is “UNIQUE CODE” space ”ENTRANT’S FIRST NAME” space “ENTRANT’S LAST NAME” space “ENTRANT’S POSTCODE”; or
               2. Log onto www.grandprix.com.au and click on the competition link to go through to the online entry form. In order to complete the online entry form, eligible entrants will be required to provide their full name, address (including state), postcode, contact telephone number, current and valid email address and the unique code found on their scratch ticket. Neither the Australian Grand Prix Corporation (AGPC) the Promoter accept any responsibility for late, lost or misdirected entries for this promotion, including as a result of the website being unavailable.

   6. There will be a total of 201,600 scratch cards printed and distributed.

   7. SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Entrants must have the bill payer’s permission to enter the promotion or their entry will be invalid. Any form of automated entry using the Internet or any other device or software is invalid. Max SMS cost is $0.55 (including GST). Any SMS submitted after the Promotion Period has closed will not be included in the promotion and will be charged $0.55 cents (including GST). The charges for all SMS entry services will appear on each entrant's next mobile phone bill. All queries relating to mobile bills should be directed to the entrants' mobile phone carrier.

   8. Incomplete, ineligible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. Entries must be received by the Promoter during the Promotional Period. Entries will be deemed to be accepted at the time of receipt into the promotional database and not at the time of transmission.

   9. For all SMS entries a reply SMS will be sent to each entrant immediately after their entry has been received, confirming their entry has been successfully received. If an SMS entry is not successful because it is not in the required SMS format or the unique code submitted by an eligible entrant is not recognised by the Promoter as an eligible unique code for the promotion, a “try again” message will be sent to the entrant. The “try again” message will prompt the entrant to check their unique code and resubmit their SMS entry in the required form. If the entrant elects to resubmit their SMS entry, the entrant will be charged an additional $0.55 cents (including GST).

  10. For all online entries a notification page will advise consumers their entry has been successfully received. If an entry is not successful because it is not in the required format, fields are incomplete or the unique code submitted by an eligible entrant is not recognised by the Promoter as an eligible unique code for the promotion, a “try again” message will be sent to the entrant. The “try again” message will prompt the entrant to check their unique code and resubmit their entry in the required form.

  11. Multiple entries will be accepted but each entry must be based on a separate purchase, a separate SMS entry and each entry must contain a separate unique code and must fully comply with the entry requirements set out above.

  12. Prize Draw: The prize draw will take place at 11.00am (AEDST) on 28/02/2011 at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade Cremorne VIC 3121. All winners will be notified by telephone, SMS, mail and their name and postcode will be published on www.grandprix.com.au on 01/03/2011. The Major Prize Winners’ names and localities will also be published in the Australian on 02/03/2011. All reasonable steps to notify the winners of the results of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

  13. Each eligible entrant must retain and may be required to present the original scratch card in order to claim a prize. Entrants may be requested to provide to the Promoter original scratch cards for all entries made. If an entrant is unable to provide original scratch cards for all entries made, then all the entries of that entrant may be ineligible and deemed invalid.

  14. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, that the entrant obtained the bill payer’s consent to enter by SMS before submitting their entry/entries (if applicable), that the entrant has a clear relationship with the end mobile device used to enter via SMS (if applicable), and any information submitted by the winners in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry may become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

  15. Major Prize: There will be one (1) major prize awarded. The first valid eligible entrant randomly drawn in the Major Prize draw will win a Minardi experience (“the Hot lap”) and six (6) hospitality passes to the 2011 FORMULA 1 AUSTRALIAN GRAND PRIX (the “Event”) including access to the V8 Alley Supercar Club, valid Sunday only (“Major Prize”). The total major prize is valued at up to $23,160 RRP incl GST.

      The Major Prize includes:

          o 1 x F1 two seater Hot Lap consisting of 1 x ‘out’ lap, 1 x ‘flying’ lap and 1 x ‘in’ lap. The Hot Lap will take place on a day between the dates of 23/03/11 – 27/03/10 and a photograph taken during the activity by an AGPC official photographer.*
          o 6 x hospitality passes valid for Sunday 27th March 2011, with access to the new V8 Alley Supercar Club located at the Grand Prix Circuit and including:
          o Reserved dining seat
          o Morning tea, Buffet Lunch, Afternoon tea
          o Sparkling, Beer, Wines and Soft drinks
          o Flat screen televisions showing all the racing action live on Grand Prix TV
          o Superscreen viewing
          o Wheelchair accessibility
          o Facility hosts to assist you and your guests
          o Sunscreen and earplugs

      *In the event the Hot Lap prize takes place between 23/03/11 and 26/03/11, the winner will be provided with five (5) general adminission passes to the Grand Prix circuit for their companions to watch their Hot Lap experience. Maximum value of general admission passes is up to $99 each. Total value of prize is up to $594.

  16. Minor Prizes: There will be 23 minor prizes awarded. The first 3 valid entries drawn in the Minor Prize draw will each win 1 year’s supply of Mini-Magnum Ice creams (50 x 6 packs), valued at $326. The next twenty (20) eligible entrants randomly drawn from the remaining entries received will each win 2 x Sunday General Admission tickets to the Event valued at $198 RRP incl GST. The ticket must be taken on Sunday 27th March 2011 and are only available on that date. The total Minor prize pool is valued at $4938 RRP incl GST.

  17. Major Prize Special Conditions: The winner must be 18 years of age or older and must undertake a compulsory medical examination (which may include an ECG test) to obtain medical clearance by the date specified by the Promoter. The winner must consent to the test results being made available to CAMS for the purpose of assessing fitness to participate in the Hot Lap.

      In order to participate in the Hot Lap, the winner and their companion must also be within the following height, weight and body dimension restrictions:

      Maximum height: 1.8 m (6ft)

      Minimum height: 1.58 m (5 ft 2 in)

      Maximum weight: 88 kg (14 stone)

      Maximum girth (including upper arms): 139.7cm (55 in)

      If required, the winner may transfer their prize to another event patron (“Nominated Participant”) as designated by the prize winner in writing to the Promoter by no later than 11 March 2011, subject to such Nominated Participant meeting the requirements for participation, including without limitation medical clearance requirements, and agreeing that their participation will be deemed acceptance of these Conditions of Entry as if all references to the “winner” were references to the Nominated Participant, except where the context otherwise requires.

      As a condition of accepting the prize, the winner must sign a waiver of liability and indemnity form as required by the Promoter and/or AGPC.

      The winner must comply with all directions of the Promoter, race officials, and the nominated driver at all times and wear all safety and passenger equipment required. Winners and their companions will not be permitted to obtain drivers’ signatures and acknowledge that there will be no formal introduction to the driver of the car when participating in the prize. The winner and their companion must agree to take part in a briefing prior to the “Hot Lap”, and also undergo and pass all required medical tests and other requirements (including blood alcohol and drug testing) as determined by the Promoter and/or the operators of the prize in their absolute discretion. The winner must not be under the influence of any drugs or have a blood alcohol reading above .00 whilst taking part in the Hot lap. The winner must not have any heart condition, history of heart disease, or other medical conditions that would make it dangerous to participate in the Hot lap. The winner must declare to the Promoter any health-related issues that may affect their safe participation in the Hot lap and obtain a written clearance from their doctor in this respect. The Promoter reserves the right (but has no obligation) to refuse to allow a winner and/or their companion to take part in any or all aspects of the prize if the Promoter determines, in its absolute discretion, that the winner and/or their companion is not in the mental or physical condition necessary to safely participate in that aspect of the prize. Notwithstanding any other conditions set out herein, the Promoter at all times reserves the right to prevent any individual from participating in the prize for any reason whatsoever.

  18. The winners acknowledge that the Event may be cancelled or re-scheduled for any reason, other than as set out in the Conditions of Sale of tickets to the Event (available at www.grandprix.com.au) and neither the Promoter nor AGPC accepts any responsibility for such cancellations. The winner and companions also acknowledge that participation in any event may be subject to additional terms and conditions imposed by third parties. The winner and companions must become acquainted with any additional terms & conditions of participation prior to participation in any event. Neither the Promoter nor AGPC accepts any responsibility and neither will be liable for additional conditions imposed at any event nor for the breach of those conditions by any person.

  19. The total prize pool is valued up to $28,692 (Recommended Retail Price including GST). Prizes must be taken as offered and cannot be varied. Prizes are not transferable or exchangeable and cannot be taken as cash. Any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. Neither the Promoter nor AGPC accepts responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

  20. Unless expressly stated within these Terms and Conditions regarding all prizes, all other expenses, including but not limited to, accommodation, spending money, transport to and from the Event, become the responsibility of the winner.

  21. The Promoter may conduct such further draws as are necessary at the same time and place as the original prize draw on 07/03/2011 in order to distribute any prizes unclaimed by that date in order to distribute them before the date the prize must be taken. All unclaimed prize draw will be notified by telephone SMS, mail and their names and locality will be published on the promotional website on 09/03/2011. Unclaimed Major Prize Winner’s names and localities will also be published in the Australian on 09/03/2011. All reasonable steps to notify the winners of the results of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

  22. If any prize or any element of a prize becomes unavailable for any reason beyond the Promoter’s or AGPC’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable State or Territory legislation.

  23. Neither the Promoter, AGPC or any of their respective associated agencies and companies shall be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Neither the Promoter nor AGPC nor any of their respective agents associated with this promotion take any responsibility for prizes damaged or lost in transit.

  24. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

  25. Any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, the promotional website or the information on the promotional website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter or AGPC suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter and AGPC for those losses, damages and costs.

  26. Neither the Promoter nor AGPC is responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

  27. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter or AGPC which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, both the Promoter and AGPC each reserve their absolute right to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.

  28. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  29. Programming and other quality control errors will not invalidate an otherwise valid prize claim.

  30. Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.

  31. Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.

  32. SMS is not a guaranteed delivery communication tool. Neither the Promoter, AGPC nor the service provider will accept responsibility for any SMS messages not received.

  33. Neither the Promoter nor AGPC will be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

  34. The winners agree to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and AGPC and each of their respective agents, and sign any release document provided by the Promoter or AGPC. Entrants consent to each of the Promoter and AGPC using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or AGPC.

  35. All entries and any copyright subsisting in the entries become and remain the property of the Promoter and AGPC. Each of the Promoter and AGPC collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, unless otherwise advised, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter and AGPC is to enable the Promoter and AGPC to use the information to assist the Promoter and AGPC in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. Each of the Promoter and AGPC may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter and AGPC may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter and AGPC may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter.   36. Unless otherwise advised, the winner also consents to AGPC using the winner’s name, photograph and likeness in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the winner. All personal information collected by AGPC will be dealt with by AGPC in accordance with the Information Privacy Act 2000 (Vic) and AGPC’s privacy policy. All details of the entrants will be used and preserved in accordance with the relevant State’s Privacy legislation. A request to access, update or correct any personal information held by AGPC, or to access AGPC’s privacy policy, should be directed to AGPC by contacting AGPC at 220 Albert Road, South Melbourne, Victoria 3205.

  37. Neither the Promoter nor AGPC shall be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss, including loss of profits or loss of earnings) or personal injury suffered or sustained arising from or in connection with the competition, any omission to enter a person into the draw, acceptance of the prize or the prize itself, except for liability which cannot be excluded by law. Neither the Promoter nor AGPC accept any responsibility in the event that the Event is cancelled, or the Event dates are re-scheduled for any reason beyond the reasonable control of AGPC. By entering this Promotion, each entrant who wins a prize that includes entry to the Event and any other person who shares the prize with the winning entrant (Winning Entrant) (whom the Winning Entrant must make aware of these Conditions), must comply with the Corporate Facility Standard Terms and Conditions, Conditions of Entry and Conditions of Sale to the Event (posted at the entry to the Albert Park Grand Prix circuit and also available at www.grandprix.com.au or by calling AGPC on 03 9258 7100) and reproduced below.

      ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.

      Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at entrants’ own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), hereby exclude, release and forever discharge the Promoter, AGPC the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Fédération Internationale de l'Automobile, Formula One Administration Limited, Formula One Management Limited, Confederation of Australian Motor Sport Limited, Parks Victoria, the State Sports Centres Trust, APP Corporation Pty Limited, Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize (Associated Entities) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event (including the prize) including but not limited to: any technical difficulties or equipment malfunction (whether or not under the Promoter’s or AGPC’s control); any theft, unauthorised access or third party interference; any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter or AGPC; any variation in prize value to that stated in these Conditions; or any tax liability incurred by a winner or entrant. Each Winning Entrant must, on request of AGPC, execute any and all documentation (if any) necessary to give effect to this clause.

      To the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), entrants acknowledge that, to the extent to which they participate at the Event in:

               1. a sporting activity or similar leisure time pursuit; or
               2. an activity that:

                     1. involves a significant degree of physical exertion or physical risk; and
                     2. is undertaken for the purposes of recreation, enjoyment or leisure,

      (Recreational Services),

      including, without limitation, participation in the prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.

      WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this notice.

      NOTE: The change to your rights as set out in this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004.

      For the purpose of this Condition 37 “the supplier” shall mean and include the Associated Entities.

      Without limiting any other release or limitation of liability contained in the Conditions, the Associated Entities will not be liable for any indirect or consequential loss suffered by any Entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or the prize.

      Nothing in this Condition 37 or these Conditions generally affects your rights under the Trade Practices Act 1974 (Cth), Fair Trading Act 1999 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties not be excluded by law.
