PARTICIPATION


1.This competition (“Competition”) is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Food Australia, of 4 Corella Close, Berkeley Vale NSW 2261 (“Promoter”).


2.Entry to the Competition constitutes acceptance of these conditions.


3.The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 18 years, or older, as at the time of entry; (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.


4.Competition entry opens at 9am on 17/1/11 and closes at 9am on 28/2/11 ("Entry Period"). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date.

ENTRY


5.To enter, an Eligible Entrant must, during the Entry Period, first make a Qualifying Purchase from a Woolworths or Safeway supermarket anywhere in Australia, or from Woolworths Homeshop (www.homeshop.com.au). A Qualifying Purchase is the purchase, in one transaction, of any two Qualifying Products (2 of the same product, or any combination). Each of the following products is a Qualifying Product:

(i) a MASTERFOODS Table Sauce
(ii) a MASTERFOODS Marinade
(iii) a MASTERFOODS Relish
(iv) a MASTERFOODS Mustard
(v) a PRAISE Salad Dressing
(vi) a PRAISE Deli Style Dressing
(vii) a PRAISE Spritz Dressing
(viii) a PRAISE Mayonnaise
(ix) a CRISCO Oil



6.Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Qualifying Purchase that they make during the Entry Period.


7.On any one day: (i) an Eligible Entrant may submit no more than 5 entries; and (ii) no more than 5 entries will be accepted containing the same e-mail address.


8.Entry can only be made by internet. To submit an entry, an entrant must use a compatible browser to visit www.summerbbq.com.au ("Competition Website") and follow the directions there. For each entry, the entrant must provide: (a) the entrant's first name; (b) the entrant's last name; (c) the entrant's post code; and (d) the last 6 digits of the barcode from each of the two products in their Qualifying Purchase that are being used to enter.

9.All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.


10.For each and every Qualifying Purchase that an Eligible Entrant uses to submit an entry, he/she MUST retain the receipt (or a photocopy of it) from the purchase of the products comprising the Qualifying Purchase that is issued during the Entry Period: (a) (i) by the Woolworths/Safeway supermarket from which the products were purchased, if the products were purchased from a Woolworths/Safeway supermarket, or (ii) by Woolworths Homeshop, if the products were purchased from Woolworths Homeshop; and (b) lists each product in the Qualifying Purchase as an item purchased.


11.All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.

(i) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 10 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
(ii) An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked,
allow the Promoter to inspect and copy the original of any such document.


12.The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:

(i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or
(ii) fails to produce items as required by condition 11 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these conditions.


13.An entry by more than one person (ie a joint entry) is invalid.

INTERNET


14.Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.


15.Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.

BEACH HOUSE HOLIDAY PRIZE DRAW


16.A draw will be held at 3pm on 28/2/11 at Suite 403, 62 Beach Street, Port Melbourne NSW 3207.

17.The Eligible Entrant who submitted the first valid entry drawn will win the Major Prize, a Beach House Holiday, valued at a maximum of $26,325 (further details of this prize are set out below).


18.The Beach House Holiday comprises:

(i) for its winner and, subject to condition 20, five guests of his/her choice:

(a) return economy flights to Promoter’s choice of Brisbane, Coolangatta or Ballina airport from the Australian State or Territory capital city nearest to the winner's place of residence (except where that city is Brisbane) (“Flights”) and, if Flights are provided, return ground transfers between the destination airport and the Accommodation;
(b) 13 nights accommodation in the Pavillion Home, Childe Street, Belongil Beach, Byron Bay, NSW ("Accommodation");
(c) an evening meal prepared by a professional chef;
(d) a BBQ prepared by a professional chef;
(e) the option of 14 days hire of a 7 seat car with a kilometer allowance of 200km per day; and
(ii) for its winner:

(a) $1,000 worth of beach toys of the Promoter’s choice (“Beach Toys”);
(b) $1,000 worth of food of the Promoter’s choice (“Food”).


19.The Flights and Accommodation will be arranged by the Promoter. The winner of the Beach House Holiday must give at least 30 days notice of proposed commencement of travel which must commence on, or after, 28/2/11 and must be completed no later than 1/4/12. The Accommodation and related travel is subject to availability at the time of booking and, if any component of the Byron Holiday is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which the Beach House Holiday will be booked.


20.All aspects of the Beach House Holiday Flights and Accommodation are for the winner and five guests travelling and staying together. The winner of the Beach House Holiday is free to select any person as a guest, provided that the Promoter may require the guests to confirm in writing that they agree to comply with the provisions of these conditions relating to guests (see condition 39).


21.To accept the option of car hire, the winner of the Beach House Holiday, or one of the winner’s guests, must meet the rental car conditions imposed by the Promoter’s nominated rental car provider (including a minimum age of 25 years and the holding of a full, non-provisional, driver’s licence), and must enter into a hire contract direct with that provider.


22.Once tickets/bookings have been arranged by the Promoter, changes to the Beach House Holiday Flights and Accommodation arrangements are at the expense of the Beach House Holiday winner.


23.All components of the Beach House Holiday must be taken together as a single trip to be booked by the Promoter. Any part of the Beach House Holiday that is not taken for any reason is forfeited.


24.The Beach House Holiday does not (except as expressly stated) include:

(i) any transport between a traveller's residence and the departure airport (if flights are provided) or the Accommodation (if flights are not provided);
(ii) any overnight accommodation while travelling to the departure airport or destination;
(iii) any other travel or accommodation;
(iv) any meals;
(v) any incidental accommodation charges (such as, telephone calls and video rentals);
(vi) any spending money;
(vii) any insurance (such as travel or health cover);
(viii) any vaccinations or other medical or health related services;
(ix) any other ancillary costs which may be incurred by the winner or his/her guests in relation to the Beach House Holiday.



25.The Beach House Holiday cannot be exchanged for other travel or accommodation at other destinations.


26.The Beach Toys and Food will be provided to the winner at the Accommodation, upon the commencement of the Accommodation, and ownership of the Beach Toys and Food and all related risk will pass to the winner at that time.

INSTANT WIN PRIZES


27.The following 1,055 instant win prizes (each an "Instant Win Prize") are available to be won during the Entry Period:

(i) 10 x Coleman “The Slats” Esky (Patent Application Product – 2010900436), each valued at $130;
(ii) 75 x Beach Tent, each valued at $55;
(iii) 170 x $50 Woolworths Groceries Only Gift Card (more details of this prize are set out below);
(iv) 50 x Coleman Roadtrip Grill Tools Set, each valued at $25;
(v) 250 x Beach Racket Set, each valued at $20;
(vi) 250 x Inflatable 30cm Beach Ball, each valued at $8; and
(vii) 250 x Frisbee, each valued at $6.



28.1,055 times during the Entry Period (each a “Time”) will be randomly selected. One Instant Win Prize will be allocated to each Time. For each Time:

(i) The Eligible Entrant who submits the first valid entry that is received by the Promoter at or after the Time will, subject to condition 28(ii), win the Instant Win Prize allocated to that Time.
(ii) A valid entry will be disregarded for the purposes of allocating the Prize for the Time if that entry has previously been allocated a Prize for another Time.


29.If, at the end of the Entry Period any Instant Win Prizes have not been won, they will be awarded in a second chance draw which will be drawn from all entries except entries that have already won a prize. This second chance draw will commence at 3.30pm on 28/2/11 at Suite 403, 62 Beach Street, Port Melbourne NSW 3207.

WOOLWORTHS GROCERIES ONLY GIFT CARD PRIZE


30.Each Woolworths Groceries Only Card:

(i) is issued by Woolworths Ltd, ABN 88 000 014 675 (“Woolworths”);
(ii) is issued subject to the Groceries Only Card Terms and conditions (Full terms and conditions are available at www.everydaygiftcards.com.au);
(iii) may only be used for purchases (excluding alcohol, tobacco products and Gift Cards) up to a total value of $50, at Groceries Only Card Participating Stores (listed at www.everydaygiftcards.com.au);
(iv) is not redeemable for cash and cannot be used to make a credit card payment or purchase alcohol, tobacco products or Gift Cards; and
(v) expires when it reaches a nil balance, or 12 months after issue, whichever occurs first.



PRIZES GENERALLY


31.The maximum total value of all prizes is $50,000.


32.Each prize is valued as at 6/12/10. The Promoter takes no responsibility for any variations in value of a prize.


33.If a prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.


34.A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment


35.Unless expressly stated in these conditions, all expenses incurred in relation to enjoyment of a prize are the responsibility of the winner.

WINNERS


36.Each winner, whenever determined, will be notified in writing sent by e-mail to the e-mail address indicated in their drawn entry. The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.


37.The name of each prize winner in the draw on 28/2/11 will be published on the Competition Website within 7 days of the draw for at least 1 week and the name of the Beach House Holiday winner will also be published in The Australian on 14/3/11.


38.Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not claimed by a winner within 3 months of winner being determined, the prize will be awarded to another Eligible Entrant in a redraw for that prize commencing at 12 noon on 30/5/11 at Suite 403, 62 Beach Street, Port Melbourne VIC 3207. If the Beach House Holiday is awarded in the redraw, the name of the winner will be published in The Australian on 14/6/11.


39.In order to be entitled to any prize, the winner (and, if he/she wins the Beach House Holiday, each person accompanying the winner on the Beach House Holiday must, if requested by the Promoter, agree to and sign and return:

(i) an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and
(ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.

If any guest on the Beach House Holiday is under 18 years of age, the winner must ensure that a parent or guardian of any guest under 18 years of age agrees to and signs the documents referred to above (if requested by the Promoter). A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize (or participation in that prize) are signed and returned in accordance with this condition, as and when required by the Promoter.

GENERAL


40.If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.


41.The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any email communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.


42.All of the Promoter’s decisions are final and no correspondence will be entered into.


43.The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant or any winner's guest on the Beach House Holiday in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010.


44.If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.


45.Entrants' personal information and that of any winner's guest on the Beach House Holiday will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner and any winner's guest on the Beach House Holiday may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 or by calling 1800 816 016 during business hours to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
