Information on how to enter forms part of these Terms and Conditions. Entry into the competition constitutes acceptance of these Terms and Conditions.
To be eligible for entry into this competition, a person must be a resident of Australia or New Zealand, aged 18 years or over and a current Jacqui E VIP Member (“Eligible Entrant”). Employees of Jacqui E Pty Ltd or their related entities and agencies are not eligible to enter this promotion. This promotion excludes purchases from Jacqui E Factory Outlets.
This promotion commences at 9.00am (AEDST) Thursday 10th February 2011 and closes at 5:00pm (AEDST) Sunday 20th February 2011 ("Promotion Period").
To enter the prize draw, an Eligible Entrant must make a purchase of $200 or over in a single transaction and then swipe their Jacqui E VIP Membership card upon their transaction during the promotional period within a participating Jacqui E store (“Qualifying Purchase”) their entry will automatically go into the major prize draw.
Only one entry per Qualifying Purchase will be permitted per Eligible Entrant.
The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the winner in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winners’ entry will become invalid. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
The Major Prize draw will take place at 11:00am (AEDST) on Thursday 24th February 2011 at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade, Cremorne VIC 3121. Winners will be notified in writing and the major winner’s name will be published in The Australian newspaper on Tuesday 1st March 2011.
The first (1) eligible entry randomly drawn from all entries received will each win an Apple iPad with Wi-Fi 32GB, valued at $759
Total maximum prize pool is valued up to $759 AUD (including GST).
Once the prize has left the Promoter’s premises, the Promoter takes no responsibility for prize damaged, delayed or lost in transit.
The prize or any component of a prize cannot be transferred and cannot be redeemed for cash. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. The prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.
Dollar values are in Australian dollars. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
If the Major prize is unclaimed or the winning entrant is unable to satisfy these Terms and Conditions by 5:00pm (AEST) on Monday 23rd May 2011 then a second chance prize draw will take place at 11.00am (AEST) on Tuesday 24th May 2011 at the same location as the original prize draw. All Eligible Entrants who have submitted an entry during the Promotion Period will be entered into the second chance prize draw. In the event of a winner, they will be notified by mail and telephone and will have their name and postcode published in The Australian on Monday 30th May 2011.
If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
The Promoter reserves the right to request the winner’s provide proof of identity and proof of residency at the nominated prize delivery address in order to claim a prize. Proof of identification and residency considered suitable for verification is at the discretion of the Promoter.
The winner agrees to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any release document provided by the Promoter, in its absolute discretion. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below.
Jacqui E Pty Ltd and its respective related bodies corporate, officers, employees and agents will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained in connection with this competition, the promotion of this competition or the use of the prize, except for any liability that cannot be excluded by law.
