“THE ULTIMATE GAME” COMPETITION
CONDITIONS OF ENTRYInformation on how to enter and prize details form part of these Conditions of Entry. Entry into the “Ultimate Game” Competition is deemed to be acceptance of these Conditions of Entry.
The Competition commences on 1 February2011. Entries close at 11.59pm 28 February 2011.
Entry is only open to residents of Australia who are BLOCKBUSTER®members (Eligible Entrants). Employees and family members of the Promoter, agencies or companies associated with the Competition, including BLOCKBUSTER® franchisees, are ineligible to enter.
There are 5 prize packs to be won. A prize pack contains a Test Drive Unlimited 2 on PS3 or X360 or a Killzone 3 on PS3. Total prize pool is worth approximately $1,100.
Prize value is correct at time of printing. The sharing of a Prize is not permitted and the Prizes are not transferable, not exchangeable, cannot be taken for cash and are not valid with any other offer.
All prices stated are in Australian dollars, represent the recommended retail price (“RRP”) and include GST. All references to times and dates are to times and dates in Melbourne
How to enterTo enter the Competition, an Eligible Entrant must log on to http://www.blockbuster.com.au, click through to the “Ultimate Game” competition page, and answer this question in 25 words or less ‘If you had a choice which car would you like to test drive and why?”.Eligible Entrant must be a member of
www.blockbuster.com.auto enter and must complete all mandatory fields of the entry form in order to be eligible to receive a prize.
Eligible Entrants can enter once during the promotional period.Eligible Entrants can only win a maximum of one prize for the duration of the competition.
How winners will be determined
This is a game of skill and chance plays no part in determining the winner.
A panel of judges will judge the creativeness of entries in answering the question.
The judges will determine the 10 most creative entries and those entries will win the prize packs based on creative merit.
The judges have absolute discretion in their determinations and their decisions are final. No correspondence will be entered into.
The winners will be notified in writing.
The Promoter may require an entrant to show that they are an Eligible Entrant. Showing that an entrant is an Eligible Entrant may (in the Promoter’s sole discretion) include the Eligible Entrant providing, or showing to, the Promoter:
1. Proof of Australian residency; and
2. The Eligible Entrant’s BLOCKBUSTER® membership card.
In the event that any entrant does not claim his or her Prize or cannot show that he or she is an Eligible Entrant within 30 days of written notice being given to that entrant that his or her entry is a winner, the judges may reallocate the Prize to the next most creative entry that has not yet received a Prize.
No responsibility accepted for lost, late, stolen, damaged or misdirected mail.
If for any reason the Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Competition including the Prizes and these Conditions of Entry, subject to the approval (if required by law) of any relevant government authority.
The Promoter and the agencies and companies associated with the Competition will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of entering the Competition or receiving, accepting or using any prize except for any liability which cannot be excluded by law.
The Promoter assumes no responsibility for:
1. any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
2. any theft, destruction or unauthorized access to, or alteration of such communications;
3. any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion;
4. any incorrect or incomplete information which may be communicated in the course of the administering this Promotion.
CAUTION:Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
The Promoter and the agencies and companies associated with the Competition accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
If the winner of a Prize is under the age of 18 years, the Prize will be awarded to the winner’s parent or guardian.
If for any reason a prize is not available, the Promoter reserves the right to substitute it for another item, in its sole discretion, of an equal or greater recommended retail value.
All claims and entries become the property of BLOCKBUSTER®. Each entrant agrees to do all things requested by BLOCKBUSTER® to ensure that the intellectual property rights in and to his or her entries become the property of the BLOCKBUSTER® and to provide all consents necessary or requested by the BLOCKBUSTER® in relation to moral rights.
BLOCKBUSTER® may use the information an entrant provides for the purpose of conducting the Competition and in any media for further promotional, marketing and publicity purposes unless otherwise advised by the entrant.
BLOCKBUSTER® may disclose entrants’ personal information to its contractors and agents who assist it in conducting the Competition, communicating with entrants and conducting promotional, marketing and publicity activities. BLOCKBUSTER® is bound by the NationalPrivacy Principles in the Privacy Act 1988. Entrants can access and correct the personal information BLOCKBUSTER® holds about them by contacting BLOCKBUSTER® on (03) 9321 1600.
