“BUY-SMART 2011” PROMOTION
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in the Buy-Smart 2011 promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
2. The promoter is Colonial First State Property Management Pty Ltd (ABN 96 101 504 045) of 1341 Dandenong Road, Chadstone VIC 3148. Telephone: 03 9936 1222 (”Promoter”).
3. Entry is only open to Australian residents. Officers, management and employees (and their immediate families) of the Promoter, the Promoter’s associated companies and contractors, participating retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promotion commences at 9am (local time) on 14.02.2011 & ends at close of business 27.02.2011 (“Promotional Period”).
5. This Promotion is being conducted at the following shopping centres (“Participating Centres”): NSW: Ballina Fair Shopping Centre (Cnr Kerr & Fox Streets, Ballina NSW 2478); Lake Haven Shopping Centre (Lake Haven Drive, Lake Haven NSW 2263); Salamander Bay Shopping Centre (2 Town Centre Circuit Salamander Bay NSW 2317 ) SA: Castle Plaza Shopping Centre (992 South Road, Edwardstown, SA 5039) QLD: Clifford Gardens Shopping Centre (Corner James St and Anzac Ave Toowoomba Clifford Gardens Qld 4350); Mt Pleasant Shopping Centre (Cnr Bucasia Road and Phillip Street, North Mackay QLD 4740); Beenleigh Shopping Centre (114-118 George Street, Beenleigh QLD 4207); Runaway Bay Shopping Centre (10-12 Lae Drive, Runaway Bay QLD 4216); VIC: Brimbank Central Shopping Centre (Cnr Neale & Station Roads Deer Park VIC 3023 ); Altona Gate Shopping Centre (124 - 134 Millers Road Altona North VIC 3025); Corio Shopping Centre (Bacchus Marsh Road (Cnr Purnell Road), Corio VIC 3214); Bendigo Marketplace Shopping Centre (37 Garsed Street, Bendigo Vic 3550); Rosebud Plaza Shopping Centre (Cnr Boneo Road and McCombe Street, Rosebud Vic 3939); TAS: Northgate Shopping Centre (387-393 Main Road Glenorchy TAS 7010); Eastlands Shopping Centre (Bligh Street Rosny Park, Tasmania, 7018) ACT: Tuggeranong Hyperdome (Cnr Anketell and Reed Street, Tuggeranong ACT 2900) (each a “Local Participating Centre”); AND:
QLD: The Myer Centre Brisbane (91 Queen Street, Brisbane QLD 4000); Grand Plaza Shopping Centre (Cnr Browns Plains Rd and Mt Lindesay Hwy Browns Plains, QLD, 4118); SA: Elizabeth Shopping Centre (Suite 1 Raleigh Chambers 50 Elizabeth Way, Elizabeth SA 5112); VIC: Northland Shopping Centre (2-50 Murray Road, Preston VIC 3072), Broadmeadows Shopping Centre (1099 - 1169 Pascoe Vale Road, Broadmeadows VIC 3047); Forest Hill Chase Shopping Centre (270 Canterbury Road, Forest Hill VIC 3131); WA: Rockingham Shopping Centre (1 Council Avenue, Rockingham WA 6168) Midland Gate Shopping Centre (274 Great Eastern Highway Midland WA 6056) (each a “Metro Participating Centre”).
6. To be eligible to receive a game card, an individual must, during the Promotional Period, either: (a) spend $80 or more at participating retailer(s), during the course of one (1) day, at a Local Participating Centre; OR (b) spend $120 or more at participating retailer(s), during the course of one (1) day, at a Metro Participating Centre.
7. The qualifying spend may include purchases made at multiple participating retailers within the same Participating Centre, and may include purchases of gift card(s), however, the qualifying spend must be made during the course of one (1) day during the Promotional Period. Transactions undertaken at major retailers such as department stores, and supermarkets are ineligible. For a full list of participating retailers see the participating centres website / Customer Service Desk or Centre Management Office.
8. To receive a game card, an individual must present their receipt(s) at the Customer Service Desk, Centre Management Office or promotion information booth of the relevant Participating Centre during the Promotional Period, while the game cards last in each Participating Centre. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period, and show that the minimum qualifying spend has been achieved.
9. A limit of one (1) game card will be awarded per person per Participating Centre, per day.
10. Individuals must scratch the game card in order to find out if they have either won an instant win prize of a $10 centre gift card or the chance to enter a prize draw.
11. Individuals with game cards that reveals the chance to enter a prize draw (i.e. non-winners of an instant win prize) can enter a prize draw by fully completing their details on the back of the game card, and presenting the original game card to a staff member at the Customer Service Desk, Centre Management Office or promotion information booth at the Participating Centre where the game card was received.
12. Individuals with game cards that reveal a $10 centre gift card must surrender their original game card to a staff member at the Customer Service Desk, or place of Promotion entry in order to receive the $10 centre gift card.
13. VIP members of a Participating Centre have the opportunity to enter the prize draw by visiting the website of their Participating Centre, logging on to their online account, updating their online profile during the Promotional Period, and following the prompts to download the entry form online. Once the VIP member has then made a qualifying spend, they can present the entry form at the Customer Service Desk, or place of Promotion entry, along with their qualifying spend receipt(s) for a bonus chance to enter the prize draw.
The VIP member will also receive a game card, while the game cards last in each Participating Centre. They must then scratch their game card to reveal whether they have won an instant win prize or chance to enter a prize draw. If the VIP member has won an instant win prize, they will be able to hand in the entry form they downloaded online to enter the prize draw. If the game card reveals that the VIP member has won an entry into a prize draw, they will be able to

complete the back of the game card then present the original game card to a staff member at the Customer Service Desk, Centre Management Office or Promotion information booth at the Participating Centre where the game card was received, along with the downloaded entry form, in order to receive two (2) entries into a prize draw. In the event that stocks of game cards have been exhausted, the VIP member is still able to enter a prize draw by submitting the entry form they downloaded online to a staff member at the Customer Service Desk, Centre Management Office or promotion information booth at the Participating Centre.
14. The Promoter reserves the right, at any time, to verify the validity of entries and prize claims and to disqualify any entrant who submits a prize claim or entry that is not in accordance with these Terms and Conditions or who tampers with the claims process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
15. Incomplete, indecipherable, or illegible prize claims or entries will be deemed invalid.
16. The Promoter’s decision is final and no correspondence will be entered into.

17. The following tables outline the breakdown of instant win prizes available to be won, number of games cards to be distributed and the total instant win prize pool, in each Participating Centre.

Drawn prizes
18. The prize awarded in the prize draw for all entries received from the Local Participating Centres is 16 x $500 gift cards (to a total of $8,000 worth of gift cards) redeemable at Participating Centre(s) of the winner’s choice. The prize awarded in the prize draw for all entries received from the Metro Participating Centres is 24 x $500 gift cards (to a total of $12,000 worth of gift cards) redeemable at Participating Centre(s) of the winner’s choice.

19. The prize draw winners will be notified in writing within 2 days of the draw and will be published in The Australian newspaper on 24.03.2011.
20. The prize draws will be conducted by electronic drawing system and will be held on 17.03.2011 at 11am at the Promoter’s office; 1341 Dandenong Road, Chadstone VIC 3148.
21. Total maximum prize pool value in each participating State/Territory is: up to $16,100 (NSW); up to $37,600 (QLD); up to $41,400 (VIC); up to $14,300 (TAS); up to $28,000 (SA); up to $19,900 (WA); and up to $10,800 (ACT). This is a grand total of $92,100 in instant win and drawn prizes nationally.
22. Any ancillary costs associated with redeeming the Prize are not included. Any unused balance of the prize will not be awarded as cash. Redemption of the Prize is subject to any terms and conditions of the issuer including those specified on the prize.
23. If for any reason a winner does not claim the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
24. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority.
25. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
27. Any un-won instant win prizes remaining at a Participating Centre after the Promotion has ended, will be distributed randomly to individuals at that Participating Centre who sign up to become a member of that Participating Centre.
28. A second chance prize draw will be held on 17.06.2011 at 11am at the Promoter’s office to distribute the $8,000 or $12,000 gift card prize(s), if unclaimed. The second chance prize winner will be notified in writing within 2 days of the draw and will be published in The Australian newspaper on 24.06.2011.
29. It is a condition of accepting a prize, that winners consent to the Promoter or Participating Centres using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without any remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products or services, distributed and/or supplied by the Promoter or the Participating Centres.
30. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate. Printing and other quality control errors will not invalidate an otherwise valid instant prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all instant prize claims in excess of the advertised prize pool will be honoured. Instant win game cards void if stolen, forged, mutilated or tampered with in any way. There will be a total of 19,500 instant win game cards distributed to Local Participating Centres and 16,550 instant win game cards distributed to Metro Participating Centres for this Promotion. This is a total of 36,050 instant win game cards.
31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
32. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
33. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry into this Promotion is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic or mail messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
