Terms and Conditions of Entry for the Trading Post Make Up A Story To Win
Information on how to enter and the prizes form part of the conditions of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.
2. The Promoter is Telstra Corporation Limited (ABN 33 051 775 556) of Level 2, 400 George Street, Sydney, NSW 2000 (“Promoter”).
Entry is open to all Australian residents, other than management, employees or contractors of the Promoter and other agencies, firms or companies associated with this Promotion (including suppliers of prizes) and their immediate families (“Eligible Entrants”).
The Promotion commences at 12:01am Australian Eastern Daylight Savings Time ("AEDST") on 20 February 2011 and ends at 11:59pm AEDST on 3 April 2011 (“Promotion Period”).
To enter and be eligible to win a Weekly Prize or the Major Prize, Eligible Entrants must, during the Promotion Period:
visit the Trading Post website, located at www.tradingpost.com (“Website”);
navigate to the “Make Up A Story to Win” banner available at the top of the page where you will see three random items (“Random Items”);
in 150 words or less, submit a story (“Story”) using the three Random Items (each week during the Promotion Period (as set out in clause 12) (“Week”) the three Random Items will change and Eligible Entrants need to use the Random Items for the Week the entry is submitted*; and
complete the online entry form, (“Eligible Entry”) *For example, if an Eligible Entry is submitted in Week 2, it must use the Week 2 Random Items.
The entry must be:
the original, independent creation of the entrant; and
free from any claims, including copyright or trademark claims by other parties.
Only one Eligible Entry per Week will be accepted per Eligible Entrant.
Standard browsing charges may apply, where applicable, in accessing the internet.

Weekly Prize
Judging for Weekly Prizes ("Weekly Judging") will take place at Level 2, 400 George Street, Sydney NSW 2000 ("Weekly Judging Location") on the dates and at the times set out in clause 12, from all Eligible Entries received during the relevant Week. Weekly Judging will be conducted by a representative of the Promoter (“Judge”). The Judge’s decision is final and no correspondence will be entered into.
The public can vote (“Vote”) for their favourite Story by visiting the website. The Eligible Entrants deemed by the Judge, in the Judges sole and absolute discretion, to have the five (5) highest number of Votes for their Story for the Week will proceed to the Judging for the Weekly Prize.
The Eligible Entrant deemed by the Judge, in the Judges sole and absolute discretion, to have the most creative Eligible Entry (from the five Eligible Entries with the highest Votes) each Week will receive from the Promoter a cheque in the sum of Two Thousand Dollars (AUD$2,000.00) (inc GST), each a (“Weekly Prize”). For the avoidance of doubt, Eligible Entries submitted in Week 1 will not be included in the Judging of Winners with Week 2 and so on. An Eligible Entrant may win a Weekly Prize more than once during the Promotion Period but it must be with a new Story.
Weeks and Weekly Judging details are as follows (all times given are AEDST):

Weekly Prize winners will be notified by telephone and in writing on the relevant Announcement Date set out in clause 12. The winners’ details will be published in The Australian on the relevant Publication Date set out in clause 12.
The total Prize pool for the Weekly Prizes is $12,000.00 (inc GST).
In determining the Weekly Prize winners the Judges may look at how entertaining the entry is. Each Eligible Entry will be judged on the basis of humour, creative merit, originality and uniqueness. Entrants can be as serious, silly, cheeky (without being inappropriate) as they wish.
This is a game of skill. There is no element of chance in the judging of the Competition or determination of the winners.
The judges' decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result.
Any Weekly Prizes which have not been claimed by 11 July 2011 it will be awarded to the Eligible Entrant the Judge determines to have the second most creative Eligible Entry from that Weeks top five highest Voted Stories.

Major Prize
Judging of the Major Prize will take place between 5 April 2011 and 6 April 2011 ("Major Prize Judging Period”), at Level 2, 400 George Street, Sydney, NSW, 2000 (“Major Prize Judging Location”), from all Eligible Entries received during the Promotion Period. The judging will be conducted by representatives of the Promoter (“Judges”).
The Eligible Entrant deemed by the Judges, in the Judges’ sole and absolute discretion, to have the most creative valid Eligible Entry (from all of the Eligible Entries received during the Promotion Period) will receive from the Promoter a cheque in the sum of Ten Thousand Dollars (AUD$10,000.00) (inc GST), (“Major Prize”). For the avoidance of doubt, the Major Prize winner may or may not be a Weekly Prize winner.
The Major Prize winner will be notified by telephone and in writing on 8 April 2011. The winners’ details will be published in The Australian on 13 April 2011.
The total Prize pool for the Major Prize is $10,000.00 (inc GST).

Minors
If an entrant is under 18 years, they must have their parent or guardian's consent to enter this promotion. The Promoter reserves the right to request this consent in writing.
If a Prize winner is under the age of 18 years, the Prize will be awarded to their parent or legal guardian on behalf of the winner.
Minors may use the Prize, but they must be accompanied by a person over 18 years when doing so, and have consent from their parent or legal guardian (which the Promoter may request in writing).
A parental or guardian consent referred to in these terms must:
consent to the matters referred to in these terms and conditions; and
include the words "in consideration of Telstra agreeing to admit the entrant into this Promotion, [name of parent or guardian] agrees to be bound by the terms of entry into the Promotion".


General
The total Prize pool value is $22,000.00 (including GST).
The Prizes are non transferable or exchangeable and the cheques will be non negotiable. All other costs associated with the Prizes, are the responsibility of the winners.
The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or tampered with in any way before it reaches the winner.
The Promoter accepts no responsibility for any variation in the value of the Prize.
If the Promoter is unable to provide a winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of equal or greater monetary value to the nominated prize, subject to any written directions given by State or Territory gaming departments.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
CAUTION: Any attempt to deliberately damage any website or the information on a website, or to otherwise undermine the legitimate operation of this competition, may be a violation of criminal and civil laws an should such attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry process in any way, or who does not properly comply with the entry process, will be ineligible to win.
Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant.
The judges’ decision is final and binding and no correspondence will be entered into. Incomplete and incomprehensible entries and entries with defamatory or offensive content or incorrect contact details, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
By entering the Promotion, the entrant and their parent/guardian if they are under 18 understands and agrees that the Promoter may use and disclose the information provided by the entrant on the terms and for the purposes (including marketing) set out in the Promoters Privacy Statement available at here or by calling 1800 039 059, as if they were a customer of the Promoter. The entrant agrees that the Promoter can continue to contact them even after this Promotion ends. If the entrant would like to access or correct the personal information that the Promoter holds about the entrant, or if the entrant does not wish the information to be disclosed, the entrant should advise the Promoter by phoning 1800 039 059.
By entering into the Promotion, the entrant (and their parent/guardian if they are under 18 agrees and acknowledges that:
they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of them;
the Promoter may use such comments or photos (including their entry if they are under 18 years of age (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere and by any means;
the Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
they acknowledge that, by entering the Promotion, they grant to the Promoter on creation of the Materials a royalty-free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
they waive all Moral Rights in the Materials that arise outside Australia; and
they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
To the extent permitted by law, the Promoter will not be liable for any loss or injury whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion.
The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize

It's a shame that only the top five voted stories each week will be considered by the judges for a prize.  Confused
I think the very best stories should be chosen by the judges on their merits, regardless of how many "votes" they have received.
The way the competition has been set up means that unfortunately the best stories will not always win the prizes.  Sad

I think the very best stories should be chosen by the judges on their merits, regardless of how many "votes" they have received.
The way the competition has been set up means that unfortunately the best stories will not always win the prizes.  Sad

Couldn't agree more.

The best pieces should win, not the most "popular".

I think the judges pick the overall winner of the $10000, only the weekly prizes are based on votes.
