Terms and Conditions
1.Information on how to enter the Together Brisbane Competition (Competition) forms part of these Competition terms and conditions.
2.Competition entry is deemed acceptance of these terms and conditions.
3.Prizes: There are multiple prizes for this Competition:
The Major Prize: Tickets for You and 9 friends/family to attend Moreton Island Adventure’s Riverfire event aboard the luxury ship the Micat, including dinner and drinks. The value of this Major Prize package is $1,250.00. The Major Prize is valid for the SunsuperRiverfire event to be held on Saturday, 3 September 2011.
The Second Prize: Tickets for You and 5 friends/family to view Brisbane Festival Opening Night Celebrations from a private gondola on the Wheel of Brisbane, South Bank. The minimum value of this Second Prize package is $1000.00. The Second Prize is valid for the SunsuperRiverfire event to be held on Saturday, 3 September 2011.
Five (5) Runners-Up Prizes: Premium double passes to a selection of Brisbane Festival shows. The minimum value of each pass is $100.00. The 5 Runners-Up Prizes are valid for Brisbane Festival shows to be shown from 3 – 24 September 2011.
The prizes are not exchangeable or transferable and cannot be redeemed for cash. If the prize is not redeemed by the prize winner, the prize is forfeited. Any additional expenses incurred by the prize winner, other than those outlined in these terms and conditions, are the responsibility of the winner. Prizes are themselves subject to the specific terms and conditions of the providers.
If the prize-winner is under the age of 18, the prize may (at the absolute discretion of the Promoter) be awarded to the prize-winner’s parent or guardian.
Persons under 18 years of age must be accompanied by an adult at the event and when redeeming the prize package.
4.The competition period: The Competition opens at 9am on Wednesday the 20 April 2011 and closes at 10am on Monday the 15 August 2011.
5.How to enter: Entrants must fully and correctly complete and submit the entry form via this website. Multiple entries are accepted, and each entry will form an entry in the prize draw.
6.Eligibility: To be eligible to enter this competition, a person must:
* be permanent resident of the State of Queensland;
* fully and correctly complete and submit the Competition entry form on this website;
* not be an employee or contractor of the Promoter or an immediate family member of employees or contractors of the Promoter; and
* be over the age of 18 (proof of age may be required to receive prize) or have the consent of one of his or her parents or guardians to enter the Competition.
7.Competition Draw: Winners will be randomly drawn by an officer of the Promoter at 3pm on Monday the 15 August 2011. The winner of the prize will be the first eligible entry randomly drawn. The decision of that officer shall be conclusive and no correspondence will be entered into.
8.Winner Notification: The winner will be notified by telephone or email and their name and suburb will be published at
http://www.togetherbrisbane.com.au. The winner will not be officially published in a newspaper.
9.Re-Draw: If the winners do not claim their prize or cannot be contacted by email within three days of the competition draw date the Promoter will redraw the prize-winners for each unclaimed prize until a contactable winner has been located and the prize is claimed.
10.Copyright
You acknowledge that You are responsible for any material You may submit via the site, including the legality, reliability, appropriateness, originality and copyright of any such material. You may not upload to, distribute or otherwise publish through this site any content that:
(i) is confidential, proprietary, false, fraudulent, libellous, defamatory, obscene, threatening, an invasive of privacy or publicity rights, infringing on intellectual property rights of any person, abusive, illegal or otherwise objectionable;
(ii) may constitute or encourage a criminal offence, violate the rights of any person or otherwise give rise to liability or violate any law; or
(iii) may contain software viruses, political campaigning, chain letters, mass mailings, or any form of "spam".

If You do submit material You grant Brisbane Marketing and its Media Partners an unrestricted, nonexclusive, royalty-free, perpetual, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such material throughout the world in any media.
You represent and warrant that You own or otherwise control all the rights to the content You post; that the content is accurate; that use of the content You supply does not violate any provision herein and will not cause injury to any person or entity; and that You will indemnify Brisbane Marketing for all claims resulting from content You supply.
If You accept these terms and conditions, You warrant that:
(i) Your submitted content does not infringe any copyright, right of privacy or any other third-party rights and does not contain anything that is defamatory, obscene or otherwise offensive; and
(ii) You own the copyright to Your submitted content as its author and represent and warrant that You have (and will continue to have during the duration of the Competition) all necessary licenses, rights, consents, and permissions which are required to enable the Promoter to use Your entry;
(iii) You will provide evidence of such on our reasonable request that Your submitted content is Your own original work, that it is not defamatory, obscene and that it shall not infringe any third party rights including, without limitation, privacy and You will provide evidence of such on our reasonable request.
11.Publicity: By entering this Competition and taking part in the activities forming the Prize You agree to take part in or co-operate with a reasonable amount of publicity or other promotional activity and agree that we may publish Your name and submitted content, including any photographs and videos, and/or recordings made by us or on our behalf and featuring You and/or Your submitted content.
12.No Liability of Promoter: The Promoter accepts no responsibility whatsoever for late, misplaced, lost or ineligible entries. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of the prizes. To the extent permitted by law, the Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury sustained in connection with the entry into the competition or acceptance of the prize. This paragraph is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of the prize. Brisbane Marketing shall not be liable for any damage, loss, liabilities, injury or disappointment incurred or suffered by any person as a result of entering the Competition or accepting any Prize.
13.The Promoter reserves the right to alter or amend these terms and conditions and/or to cancel the competition at any time prior to the competition opening without further recourse to the entrants.
14.Important – Privacy: By entering into this competition, the entrant consents to the personal information entered on the entry form being collected, stored and used by the Promoter or entities acting on its behalf for the purpose of internal statistical analysis relating to the Promoter’s competitions. If the entrant wishes to unsubscribe from the Promoter’s database for this purpose, the entrant must contact Brisbane Marketing on 07 3006 6200.
By marking the “Please send me a regular email” opt-in box on the Together Brisbane entry form, You consent to the storage and use of Your personal information by the Promoter for the marketing purposes as set out next to the opt-in box. Entrants can unsubscribe to marketing correspondence at any time by responding to the “UNSUBSCRIBE” link in any email-newsletter they receive.
By marking the “I’m willing to be interviewed” box on the Together Brisbane entry form, You consent to the sharing of Your contact details, as supplied on the entry form, to selected media partners of the Together Brisbane campaign by the Promoter for further marketing and editorial purposes. Entrants can decline interview opportunities at their discretion.
15.Force Majeure: If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter), which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition. The Promoter reserves the right in its sole discretion to disqualify all entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
16.The Promoter of the competition is Brisbane Marketing Pty Ltd ABN 86 094 633 262 whose principal offices are at Level 12, 15 Adelaide Street, Brisbane, in the State of Queensland, 4000. Any complaints regarding the Competition should be sent to this address.
17.The Promoter reserves the right to disqualify, without liability, any entrant if we have reasonable grounds to believe that the entrant has breached any of the Rules.
