If you’re a creative and passionate Territorian, here’s your chance to become part of our history.

2011 marks the Northern Territory’s Centenary Year with the theme: '100 years of the Territory, over 50,000 years of stories.'

To celebrate and recognise this important milestone in the Territory’s history, Music NT and the Northern Territory Government are running a song writing competition to find a Territory Anthem.

The competition runs from Monday 18th April – Monday 16th May and is open to all NT residents, community groups and schools.

You don’t need to be an experienced songwriter or have your song professionally recorded; the Territory Anthem is about capturing the spirit of the Northern Territory and what it means to be a proud Territorian.

The competition is free and easy to enter, and your song could win the $10,000 prize and be performed live on Territory Day.

Terms and Conditions
The following information forms part of the terms and conditions of entry to the Centenary Anthem for the Northern Territory. By entering. the Nominees agree to be bound by these terms and conditions.

The purpose of the Competition is to create a Centenary Anthem for the NT. It is anticipated that all entries will be written and recorded for this purpose.

1. ORGANISER

a.The organiser of the Centenary Anthem of the Northern Territory competition (“the Competition”) is Music NT Inc. (ABN 34 792 015 203) of 1st Floor, 29 Cavenagh Street, Darwin NT 0801 (“Organiser”)
2. ELIGIBILITY

a.Entry into the Competition is limited to songwriters who:
i.are Northern Territory residents for a minimum of 2 consecutive years on 1 January 2011;
ii.comply with these terms and conditions of entry.
b.Employees (and members of their immediate families) of the Organiser are ineligible to enter.
3. ENTRY CRITERIA AND PRIZE

a.Nominees for the Competition must submit a properly completed Nomination Form together with a recording of an original musical composition written or co-written by the Nominee (both online and hardcopy).
b.Where there are 2 or more co-writers, the Nomination Form must include the name and details of all co-writers and each co-writer must sign the Nomination form. All co-writers are deemed to accept and be bound by these Terms and Conditions.. 
c.Nominees for the Centenary Anthem of the Northern Territory must submit a properly completed Submission Form together with a recording of an original musical composition written or co-written by the Nominees and the lyrics of the submitted song(s).  All co-writers must sign the application form (and, if the work is the subject of a publishing agreement, the consent of the publisher) prior to entry.  The Organiser will provide all entrants with APRA membership forms (for non members)and a song registration form and the completion and acceptance by APRA of these is a condition of entry.
4. ENTRY

a.Nominees must submit an online application AND hardcopy submission by mail.
b.To enter online, Nominees must follow the directions on the Centenary Anthem of the Northern Territory online Nomination Form and properly complete and submit an online Nomination Form, together with recordings of their song in MP3 format and lyric sheets, via the website specified on the Nomination Form before the closing date.
c.To enter by physical mail, Nominees must follow the directions on the Centenary Anthem of the Northern Territory Nomination Form and properly complete and submit a physical Nomination Form, together with recordings of the song in CD format (clearly labelled with Nominee’s name and song title) and lyric sheet, to the Organiser specified on the Nomination Form before the Closing Date.
5. CLOSING DATE

a.All entries must be received online or by post no later than 11.59pm on 16th May 2011. The Organiser accepts no responsibility for any changes in the Competition closing dates. Late nominations will not be accepted.
6. ENTRY MATERIALS

a.It is the Nominee’s responsibility to ensure that the recording submitted in respect of each song is complete and playable. The Organiser is not responsible for late, lost, damaged, misdirected, postage due, stolen, or misappropriated entries.
b.No entry materials (Nomination Forms, MP3 recordings, CD recordings, and lyric sheets) submitted will be returned to Nominees. Copies of entry materials may be retained by the Organiser for purposes in accordance with these terms and conditions. Otherwise, all entry materials will be destroyed after the Winner is announced.
c.Any false information provided as part of a Nominee’s entry materials will result in the automatic disqualification of that Nominee.
7. OWNERSHIP

a.Subject to clause 14, all Nominees (or their publisher if applicable) will retain all copyright and all other rights controlled by them in all songs entered in the Centenary Anthem of the Northern Territory. For the avoidance of doubt, no copyrights in any song entered will be assigned to the Organiser or the Territory by virtue of a Nominee entering the Centenary Anthem of the Northern Territory.
8. JUDGING

a.Music NT will co-ordinate the judging of all entries;
b.The decision/choice of short listed nominees and winners are final;
c.There will be no feedback or critique on any songs entered in the Competition.
9. AWARDS

a.Subject to the clause 13, the winner will receive cash prize to the value of $10,000.
10. PRIZE CONDITIONS

a.The Organiser is not liable in any way if a winner cannot receive, accept or use any element of an Award for any reason. An Award (or any part thereof) may be cancelled in the Organiser’s discretion if a winner attempts to transfer it.
b.Any taxes payable in relation to Awards are the sole responsibility of the Winners.
c.The Organiser reserves the right, in its absolute discretion, at any time during the Centenary Anthem of the Northern Territory period, to vary, withdraw, postpone or cancel the Competition, including without limitation, in circumstances where it cannot conduct the Competition or grant any part of the prize for any reason beyond its control.
d.In the event that the Organiser postpones or varies in any way whatsoever, the Competition or any part of an Award, the Organiser (and any party associated with the Competition, including but not limited to the Northern Territory of Australia (“Associated Party”)) shall not be liable to any person for any loss or damage of any kind (including but not limited to indirect or consequential loss or loss or damage caused by the Organiser’s or associated party’s negligence, act or omission) arising out of, or in connection with, the postponement or variation of the Competition or prizes (or part thereof). Nor will the Organiser or associated party be liable for any loss, damage, payment or expense of any kind (including but not limited to indirect or consequential loss or loss or damage caused by the Organiser’s or other party’s negligence) or personal injury or other damage suffered or sustained as a result of the entering, judging, running, cancellation or acceptance, enjoyment or use of the Competition or Award (or part thereof).
e.The Organiser has the right to refuse to allow a winner to take part in all or part of the award ceremony or receive the Award, if the Organiser deems, at its discretion, that a winner is not in an appropriate physical or mental condition to ensure the safety of the winner or the other parties involved, or the Organiser otherwise deems that it is not appropriate for a winner to take part in all or part of an award ceremony or receive the Award for any reason.
f.The Organiser reserves the right to amend or substitute any of the details described above at its discretion without notice to Nominees.
g.If a winner is under the age of 18 years, the Award will be awarded to the winner's parent or guardian on the Nominee's behalf.
11. WARRANTIES AND REPRESENTATIONS

a.Nominees warrant and represent that:
iii.each of their submitted recordings comprises an original musical work written (or co-written) by them, which does not infringe third party copyrights, or contravene any applicable statute, law, order, rule or regulation;
iv.if any of their songs are co-written or co-created, they have the consent of their co-writers to submit such song, grant the licenses and releases herein, receive any or all Award and participate in the Competition;
v.they own and control all copyrights and other rights in and to the materials they provide to Organiser hereunder in connection with the Competition, or are otherwise legally able to grant the rights set forth herein;
vi.if they are engaged under a publishing or recording agreement, they will obtain all necessary authorisations, consents and licences in order to participate in the Professional Development Awards  and to allow the use of their songs and other materials by Organiser as set forth herein;
vii.their songs were recorded and otherwise prepared in all respects in accordance with the rules and regulations of all unions and similar associations having jurisdiction;
viii.any songwriter, publisher, artist and/or producer credits that they provide to Organiser will be accurate; and
ix.they have read these Terms and Conditions and that they meet all the eligibility requirements to participate.
x.they understand that by entering the Competition, pursuant to clause 14 they agree to grant an exclusive licence to the Northern Territory of Australia (“the Territory”) to the exclusion of all persons, including the copyright owner.
12. PRIVACY AND RELEASES

a.Nominees agree that, as a condition of their application for the Centenary Anthem of the Northern Territory, they:
i.release the Organiser, and the Territory and their employees, directors, officers, subsidiaries, affiliates, promotional agents, and judging panelists from any and all liability, claims, or actions in connection with their participation in the Competition;
ii.agree that their name, photos, likeness, statements, submitted songs and recordings may be publicised, published, communicated, or used at or in connection with the Competition, without compensation, by the Organiser, the Northern Territory of Australia, Associated Party, including but not limited to internet sites, press releases, conferences or award shows, and for distribution to media organisations or any third party requesting such materials in connection with Organiser, the Territory or the Centenary Anthem of the Northern Territory;
13. INTELECTUAL PROPERTY

a.Subject to clause 15, by entering the NT Anthem Competition, Nominees agree that they
i.grant to the Territory, on submitting any and all entry song recording and lyrics, a royalty free, world-wide, perpetual, exclusive licence to use the Nominee’s submitted song(s) and lyrics (“the Materials”) for any purpose whatsoever, including but not limited to the right to record, reproduce, publish, perform, communicate (including by digital streaming or download technology), adapt or sub-license or assign such rights.
ii.unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the song (as defined in Part IX of the Copyright Act 1968 (Cth) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (“Moral Rights”);
iii.waive all Moral Rights in the song that arise outside Australia; and
iv.agree not to institute, maintain or support an claim or proceeding for infringement of their Moral Rights in the song.
14. NO SALES OR EXTRAORDINARY PAYMENTS

a.The Territory or the Organiser will not sell copies of any songs or recordings entered in the Competition. Nominees acknowledge that they will receive no royalty payments or payments of any kind from the Organiser or the Territory, including for the performance of their songs in connection with the Centenary Anthem of the Northern Territory, other than those that they may be eligible to receive through APRA' s usual distribution system (if they are an APRA member).
15. JURISDICTION AND CHOICE OF LAW

a.The Centenary Anthem of the Northern Territory and these terms and conditions shall be governed by and construed in accordance with the laws of the Northern Territory and all Nominees irrevocably and unconditionally consent to the exclusive jurisdiction of the Northern Territory and federal courts of the Northern Territory.
By entering your songs in Centenary Anthem of the Northern Territory you (the Nominee) agree to the terms and conditions as listed above.
