Australian unions have launched the biggest ever survey of workers in Australia’s history.

This is your chance to have a say on the challenges in today’s workplace and to tell us what’s important to you.

With our hundreds of thousands of voices acting together as one, we know that we can't be ignored.

The survey will be conducted across Australia and will involve workers of all ages and across all industries.

Three prizes of $1000 or its equivalent are offered by the ACTU and will be drawn at its offices at noon on Wednesday, 20 July, and results published in The Australian on Monday, 25 July. Terms & Conditions
1. Who is conducting the Competition
The Competition is being conducted by the Australian Council of Trade Unions (ACTU) of Level 6, 365 Queen Street Melbourne VIC telephone (03) 9664 7333 ABN: 67 175 982 800 in order to encourage and promote union membership and participation by union members in union research activities.

2. Prizes
There is one first Prize, one second Prize and one third Prize. The item that is awarded as as a Prize depends on where there entrant who is Winner is resident.

For entrants resident in New South Wales:

•First Prize in the Competition is gift vouchers to the value of $1,000. The first Prize Winner will be offered the choice of either Coles Group & Myer Gift Cards to the full first Prize value or Woolworths Wish Gift Cards to the full first Prize value. First Prize is not redeemable for cash. First Prize is not transferrable save where otherwise permitted by the retailer issuing the card.
•Second Prize in the Competition is gift vouchers to the value of $1,000. The second Prize winner will be offered the choice of either Coles Group & Myer Gift Cards to the full second Prize value or Woolworths Wish Gift Cards to the full second Prize value. •Third Prize in the Competition is $1,000, payable by cheque to the Winner. Third prize is not transferrable.

3. Eligibility
The Competition is open only to Union Members who are Australian Residents aged 18 years and over. We do not charge a fee for entering the Competition. Only one entry per person will be accepted.

Officers and Employees of the ACTU, TUEF, APHEDA, ACTU Member Connect, ACTU Call Centre, ACTU Organising Centre, Essential Media Communications and Your Source and members of their immediate family are not eligible to enter the Competition.

4. Method of Entry and Closing Date
Entries to the Competition will be accepted from Monday 2nd May 2011. You must complete the Survey and submit it online at www.workingasutralia.org.au or to a union collection centre (contact your unions for details) by no later than 11:59PM Melbourne time on Friday 8 July 2011. If you are a Union Member and eligible pursuant to clause 3 above and you provide your contact details, you will be automatically entered into the Competition upon completion and submission of the Survey. If you are not a Union Member you will not be entered into the Competition.

5. Selection of Winners
Each eligible person that enters the competition has an equal chance of winning a Prize. All Prize draws will be conducted by Us at our premises at 365 Queen Street Melbourne Victoria commencing at noon Melbourne time on Wednesday 20 July 2011, in the following order: First Prize, then Second Prize and then Third Prize. Entrants are not required to be present at the drawing of the Competition. The Prize draws will be conducted by placing the contact details of all entrants into a vessel and drawing out an entry. The Winner of first Prize will be eliminated from the draw for second prize. The Winners of first and second prize will be eliminated from the draw of third Prize.

6. Announcement of winnings
We will attempt to notify Winners in writing in accordance with the contact details (email and phone) supplied to us in their response to the Survey, within 2 days of the Prize draw. In addition, we will cause to be published an announcement of winnings in “The Australian” newspaper on Monday 25th July 2011.

Further, we are required to display a list of the drawn Prizes and their Winners in a prominent place at our premises for at least 7 days after the date of the draw.

7. Claiming a Prize
If you are a Winner, we will contact you using the contact information you supplied to us in your Response to the Survey and inform you that you are a Winner. We will also arrange with you for your Prize to be delivered to you. We will not charge you an administrative or delivery fee for your Prize.

8. Unclaimed Prizes.
In the event that a Prize is unclaimed as at 9:00AM Melbourne time on Monday 31st October 2011 we intend to conduct an unclaimed Prize draw. The method of conducting the draw will be as specified in clause 5 above. Announcement of winnings will be as per the method specified in clause 6 above with announcements in “The Australian” newspaper on Monday 7th November 2011.

9. Integrity
We reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and union membership status) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

Errors and omissions may be accepted at Our discretion. Failure by Us to enforce any of its rights at any stage does not constitute a waiver of those rights.

If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond Our reasonable control, We reserve the right, in Our sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.

Our decision is final and no correspondence will be entered into.

10. Indemnity
Except for any liability that cannot be excluded by law, We (including Our officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition and Survey, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Our control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Us) due to any reason beyond Our reasonable control; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a Prize.

11. Privacy
We will retain all records relating to the Competition for a minimum period of 5 years after the determination of Winners. This includes all Survey responses. We may be required by law to disclose any of these records to regulatory and law enforcement officers.

We are required to display a list of the drawn prizes in our premises for at least 7 days after the date of the prize draw. We will display this list in the reception area at Level 6, 365 Queen Street Melbourne Victoria. We are also required to place public notices of Winners and will do so in accordance with clause 6 above.

The organisation conducting the Competition is the ACTU of Level 6, 365 Queen Street Melbourne VIC telephone (03) 9664 7333. The Competition is being conducted in association with the Survey. We have retained Essential Media Communications Pty Ltd (03) 9929 9999 ABN: 48074671462 and Your Source Pty Ltd (03) 9569 0333 ABN: 14123270413 to assist in the conduct of the Survey. Each of the organisations mentioned in this paragraph will have access to the personal information you supply to Us in the Survey and the Competition. You may gain access to your personal information held by Us by writing to Us.

The personal information you supply to Us in connection with the Survey and the Competition will be used for the purposes of administering the Competition and awarding prizes. When the Competition has been completed, the information you have provided to Us will also be used for our ongoing research and campaign activities in a de-identified form. When the Competition has been completed your personal information will not be disclosed by Us to anyone unless you consent or we are required to do so by law.

12. Compliance
These terms and conditions are issued to comply with the Gaming Control Act (NT), Gaming Control Act 1993 (TAS), Gambling Regulation Act 2003 (VIC), Gaming and Wagering Commission Act 1987 (WA), Lotteries and Art Unions Act 1901 (NSW), Lottery and Gaming Act 1936 (SA), Charitable and Non-Profit Gaming Act 1999 (QLD) and the Lotteries Act 1964 (ACT, Permit Number: ACT TP 11/01536.1).


Definitions
Union Member means a person who identifies themselves in their response to the Survey as a member of an organisation of employees Registered or Transitionally Recognised under the Fair Work (Registered Organisations) Act 2009 which is affiliated to the Australian Council of Trade Unions.

Competition means the ACTU Working Australia Census 2011 Prize Draw conducted pursuant to these Terms and Conditions.

Prizes are indentified in clause 2

Winner means a person who is entitled to receive a Prize in accordance with these Terms and Conditions.

We (and Us and Our) are/is the Australian Council of Trade Unions of Level 6, 365 Queen Street Melbourne VIC telephone (03) 9664 7333.

Survey means the Working Australia Census 2011, an electronic survey the completion of which constitutes entry into the Competition by an eligible person.

**Please note, the closing date on the web page states 1st July 2011, however the T&C's specify 8th July 2011.  (I've put the closing date as the 8th July, but anyone entering may want to complete the survey before the 1/7, just in case  Smile )
