TERMS AND CONDITIONS

1. Information in the promotion for this competition on how to enter and prize details form part of the conditions of entry. Participation in this competition is deemed acceptance of these Terms and Conditions.
2. This competition is restricted to RACV members who are 18 years or older and residents of the State of Victoria. All employees of the promoter and its related bodies corporate and the immediate families of such employees are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Competition commences at 9am (Melbourne time) on [July 1] and closes at 5pm (Melbourne time) on 29th August 2011.
4. All eligible RACV members who complete the RoyalAuto July 2011 issue Reader Survey including providing name, daytime telephone number and RACV membership number, will be entered into the draw. Only the RACV member whose details appear on the completed survey will be entered into the draw. Only one entry per person is allowed and any attempt to submit multiple entries gives the Promoter the right to disqualify any and all such entries.  No purchase is necessary for entry.  Entries may be made:

5. The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, RACV membership and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. A random draw will take place at RACV, 550 Princes Highway, Noble Park North on 2nd September 2011 at 10.00am (Melbourne time). The first entry drawn that fulfils the competition entry criteria will win the first prize, the second entry drawn that fulfils the competition entry criteria will win the second prize and the third entry drawn that fulfils the competition entry criteria will win the third prize. 
7. The total prize pool is valued at A$21,579 based on recommended retail price and consists of:
· First prize: a 15-day APT Magnificent Europe river cruise for two people plus Melbourne-Europe return flights for two, valued at $20,000 (including air flight taxes of up to $700 per person)
· Second prize: a $1,000 voucher for RACV Inverloch Resort
· Third prize: an iPad 2 WiFi, valued at $579
8. First prize only includes the items specifically described in the promotion for this competition and does not include: travel insurance; passports; visas; items of a personal nature; government taxes or levies except port charges; laundry; telephone calls; additional nights; room or flight upgrades; or any other costs not specified as included in the prize. Prize is for two people to be taken on a twin/double share basis.  Prize is subject to booking availability. Prize is also subject to the terms and conditions of the supplier of the prize. Frequent flyer points may not be collected or redeemed as part of the prize. Winner may be required to present credit card at time of accommodation check-in.
9. Travel included in the first prize departs from Melbourne only; prize includes airport transfers only within Melbourne and between European airport and river ship and does not cover regional transfers.  Any additional costs associated with departing from and returning to your place of residence are at your own expense.  Flight bookings are subject to availability in economy class on Malaysian Airlines, Lufthansa or other airline nominated by the promoter at its sole discretion.
10. First prize must be fully redeemed by making a booking with APT by close of business on 30th September 2011.  This prize is valid for travel from 1 March to 31 December 2012.  The promoter reserves the right to offer alternative dates and/or itineraries.  Upgrades and pre- and post-accommodation may be available at additional cost to the winner.
11. Second prize includes no additional benefits beyond the $1,000 voucher.  Second prize must be claimed by 30th September 2011.  Bookings using the voucher are subject to availability and further standard voucher terms and restrictions on use may apply.
12. Third prize must be claimed by 30th September 2011.
13. Subject to the unclaimed prize draw clause below, if for any reason a winner does not redeem an element of the prize at the time stipulated by the promoter, then the prize or that element of the prize will be forfeited.
14. The prize winners will be published in the RoyalAuto in November and notified by telephone and mail.
16. The prize is non-transferable and cannot be exchanged or taken as cash.   
17. The promoter’s decision is final and binding, and no correspondence will be entered into.   
18. Except for any liability that cannot be excluded by law, the promoter and its related bodies corporate (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the promoter) due to any reason beyond the reasonable control of the promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) use of the prize; (g) cancellation of a prize by the supplier for whatever reason; or (h) any passport, visa, customs, immigration, prompt arrival time or other travel requirements which are not met by the winner. All claims relating to the prize should be directed to the supplier. The promoter does not warrant that services relating to the competition or the prizes will be error-free or uninterrupted. The promoter may in its absolute discretion substitute a prize with a prize of a similar value in the event that the prize becomes no longer available.
19. The promoter is RACV Sales & Marketing Pty Ltd, ABN 11 005 258 702, 550 Princes Highway, Noble Park North, Victoria 3174.  The supplier is Australian Pacific Touring Pty Ltd, trading as RACV Cruises and Tours, ABN 44 004 684 619.
20. The information gained from the RoyalAuto survey will be used to enhance the content of RoyalAuto and not for any other purposes.
21. Entrants consent to the promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the promoter.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the promoter, the promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
23. These competition terms and any non-contractual obligations arising from or in connection with them shall be governed by the law in force in Victoria, Australia.
24. Any disputes under these competition terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
